Chauhan,<br \/>\n\tlearned advocate waive the service of notice of admission on behalf<br \/>\n\tof the respondent No.3 and Mr.M.A. Kharadi, learned advocate waive<br \/>\n\tthe service of notice of admission on behalf of the respondent No.4.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocate appearing on behalf of the<br \/>\n\trespective parties, the petition is taken up for final hearing<br \/>\n\ttoday.\n<\/p>\n<p>By<br \/>\n\tway of this petition under sec.24 of the Code of Civil Procedure,<br \/>\n\tthe petitioner ?  original appellant ?  Insurance Company ?<br \/>\n\tdefendant No.2 of Motor Accident Claim Petition No. 652 of 1997, has<br \/>\n\tprayed for appropriate order to transfer Motor Accident Claim<br \/>\n\tPetition No. 652 of 1997 from Motor Accident Claim Tribunal, Nadiad<br \/>\n\tto Motor Accident Claim Tribunal, Kalol submitting that for the same<br \/>\n\taccident and the cause of action, two claim petitions have been<br \/>\n\tfiled in two different tribunals. It is submitted that Motor<br \/>\n\tAccident Claim Petition No. 652 of 1997 is filed by the husband of<br \/>\n\tthe deceased in the Motor Accident Claim Tribunal, Nadiad and the<br \/>\n\tparents of the deceased have filed Motor Accident Claim Petition No.<br \/>\n\t1036 of 2004 before the Motor Accident Claim Tribunal, Kalol. It is<br \/>\n\tsubmitted that Motor Accident Claim Petition No. 1036 of 2004 is<br \/>\n\tfiled in prior point of time.\n<\/p>\n<p>Mr.Asif<br \/>\n\tShaikh, learned advocate apparing for Mr.M.A. Kharadi, learned<br \/>\n\tadvocate appearing on behalf of the respondent No.4 ?  husband  has<br \/>\n\tsubmitted that he has no objections if the proceedings are<br \/>\n\ttransferred from Motor Accident Claim Tribunal, Nadiad to Motor<br \/>\n\tAccident Claim Tribunal, Kalol.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocate appearing on behalf of the  resepctive<br \/>\n\tparties and in the facts and circumstances of the case and<br \/>\n\tconsidering the fact that there are two claim petitions arising out<br \/>\n\tof one accident and cause of actions  and the Motor Accident Claim<br \/>\n\tPetition No. pending in the Motor Accident Claim Tribunal, Kalol is<br \/>\n\tprior in time and considering the fact that learned advocate<br \/>\n\tappearing on behalf of the original claimant of Motor Accident Claim<br \/>\n\tPetition No. 652 of 1997 has no objection, the present application<br \/>\n\tis allowed. It is hereby ordered<br \/>\n\tto transfer Motor Accident Claim Petition No. 652 of 1997 from the<br \/>\n\tMotor Accident Claim Tribunal, Nadiad to Motor Accident Claim<br \/>\n\tTribunal, Kalol and the said claim petition to be heard with Motor<br \/>\n\tAccident Claim Petition No. 1036 of 2004.
