Shukla,J.\n<\/pre>\n<p>Present writ petition has been filed by State of U.P. questioning<br \/>\nthe validity of the order dated 3.11.2009 passed by the<br \/>\nAdditional District Judge, Court No. 10, Kanpur Nagar in Misc.<br \/>\nCase No. 2\/74\/08 wherein delay condonation application has<br \/>\nbeen rejected. Further prayer has been made for issuance of writ<br \/>\nin the nature of mandamus to recall exparte judgement and<br \/>\naward dated 1.4.1995 and for deciding the claim petition on<br \/>\nmerits.\n<\/p>\n<p>Brief background of the case is that respondent no.1 has filed<br \/>\nClaim Petition under Section 166 of Motor Vehicle Act, 1988<br \/>\nclaiming compensation of Rs. 2,75,000\/- on account of injuries<br \/>\nsustained by him in a motor accident which took place on<br \/>\n3.9.1989. Claim petition was registered as Motor Accident Case<br \/>\nNo. 67 of 1990 and therein opposite parties-petitioner appeared<br \/>\nand file written statement. Said claim petition was initially<br \/>\ndismissed in default on 27.9.1994. Petitioner submits that<br \/>\nthereafter, they have no knowledge of notice of ex parte<br \/>\njudgement dated 1.4.1995. On 4.1.2004 they acquired<br \/>\nknowledge and then application was moved without any further<br \/>\ndelay on 28.2.2004 for recalling of the ex party judgment dated<br \/>\n1.4.1995, same was registered as Misc. Case No. 74 of 2004. In<br \/>\nthe said proceedings steps were not at all undertaken in spite of<br \/>\ndirection of Claim Tribunal and it was dismissed on 2.11.2007.<br \/>\nThereafter, an application was moved on 10.1.2008 and said<br \/>\napplication has been dismissed on 3.11.2009. At this juncture<br \/>\npresent writ petition has been filed.\n<\/p>\n<p> Sri V.C. Dixit, Advocate, learned counsel for the petitioner<br \/>\ncontended with vehemence that valid and cogent reasons were<br \/>\nthere on account of which liberal view ought to have been taken<br \/>\nin the matter and as such order which has been passed, same is<br \/>\nliable to be set aside.\n<\/p>\n<p>Countering the said submission, Sri S.N. Singh, Advocate<br \/>\nappearing with Sri A.K. Singh, Advocate on the other hand<br \/>\ncontended that in the fact of the present case and looking into<br \/>\ncallous attitude of the petitioner, rightful view has been taken in<br \/>\nthe matter and the fact of the matter is that in execution<br \/>\nproceedings, petitioners had entered appearance and had been<br \/>\nparticipating, as such liberal view is not at all liable to be taken,<br \/>\nas such writ petition deserves to be dismissed.<br \/>\nAfter respective arguments have been advanced, undisputed<br \/>\nfactual position which is emerging in the present case is that<br \/>\nclaim petition has been filed way back in the year 3.9.1989 and<br \/>\nmore then 20 years period have already elapsed in the said<br \/>\nproceeding. Petitioners had entered appearance by filing written<br \/>\nstatement. It is reflected from the record that said proceedings<br \/>\nwere dismissed for want of prosecution on 27.9.1994. Petitioners<br \/>\nhave proceeded to mention that they have no knowledge or<br \/>\ninformation. Fact of the matter is that on 27.9.1994 when the<br \/>\nclaim petition was dismissed in default, on the same day in the<br \/>\npresence of Pairokar of the petitioners, said order in question<br \/>\nwas recalled as it has been passed due to inadvertence. On<br \/>\n27.9.1994 orders were passed to proceed exparte and then on<br \/>\n1.2.1995 statement was got recorded and on 1.4.1995 claim<br \/>\npetition was allowed. Execution of the said award had been<br \/>\nundertaken and same had been on going, and in the said<br \/>\nproceedings, petitioners had entered appearance and had been<br \/>\nparticipating. Thereafter, application was moved on 28.2.2004<br \/>\nfor recalling of the said exparte judgment. In the said<br \/>\n proceedings, notices were issued and in spite of specific order<br \/>\nbeing there, no steps whatsoever had been undertaken and then it<br \/>\nwas rejected on 3.11.2007. Thereafter, on 10.1.2008 an<br \/>\napplication was moved supported by section 5 application for<br \/>\nsetting aside of the said order. Additional District Judge has<br \/>\ntaken into account the conduct of the petitioners and the way and<br \/>\nmanner in which proceedings have been conducted and<br \/>\nthereafter has found that there was no sufficient cause for<br \/>\nrecalling of the said order, and has consequently proceeded to<br \/>\nreject the delay condonation application.\n<\/p>\n<p>In the fact of the case, it cannot be said that view which have<br \/>\nbeen taken by the court of the Additional District Judge Court<br \/>\nNo. 10 suffers from any infirmity, rather looking into the<br \/>\nconduct of the petitioners and the way and manner in which<br \/>\nproceedings have been undertaken by the petitioners, this court<br \/>\nrefuses to exercise its authority of judicial review.<br \/>\nConsequently, writ petition is dismissed.\n<\/p>\n<p>No order as to cost.\n<\/p>\n<p>Order Date :- 4.1.2010<br \/>\nT.S.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court State Of U.P.
