This claim for compensation was<\/p>\n<p>dismissed by the court below taking the view that the allegations<\/p>\n<p>in the petition are inconsistent with the real manner in which the<\/p>\n<p>accident had taken place. This is revealed convincingly from the<\/p>\n<p>alleged cause narrated to the doctor by the claimant in Ext.A7<\/p>\n<p>wound certificate, which is proved satisfactorily in the case. The<\/p>\n<p>allegation in Ext.A7 was that the appellant had suffered the<\/p>\n<p>injuries while he was loading articles in a tempo van. According<\/p>\n<p>to the statement in Ext.A7 to the doctor, when the rope broke,<\/p>\n<p>the appellant had fallen down. The court below took the view<\/p>\n<p>that inasmuch as there is no allegation of negligence validly<\/p>\n<p>raised, the claim is not liable to succeed.<\/p>\n<p>      2.   We have heard arguments on both sides.              After<\/p>\n<p>discussions at the bar, the learned counsel for the appellant<\/p>\n<p>submits that if not on the basis of tortious liability, the appellant<\/p>\n<p>is at any rate entitled to compensation under the Workmen&#8217;s<\/p>\n<p>Compensation Act and the insurer cannot dispute the liability for<\/p>\n<p><span class=\"hidden_text\">M.A.C.A No.2374 of 2007         2<\/span><\/p>\n<p>payment of compensation for loading and unloading workers<\/p>\n<p>engaged for loading articles in the vehicles. The court below<\/p>\n<p>should at least have considered the claim under Section 167 of<\/p>\n<p>the Motor Vehicles Act and awarded at least the compensation<\/p>\n<p>payable under the Workmen&#8217;s Compensation Act.<\/p>\n<p>     3.    Called   upon   to   substantiate    the  claim   for<\/p>\n<p>compensation under the Workmen&#8217;s Compensation Act, the<\/p>\n<p>learned counsel for the appellant submits that the matter may be<\/p>\n<p>remanded to give the appellant an opportunity to adduce proper<\/p>\n<p>evidence, as at the moment there is no satisfactory evidence<\/p>\n<p>adduced to prove that there has been permanent physical<\/p>\n<p>disability and consequent reduction in earning capacity.<\/p>\n<p>     4.    We feel that the appellant is entitled to compassion,<\/p>\n<p>notwithstanding the fact that apparently unacceptable version<\/p>\n<p>appears to have been advanced in the claim petition. But that<\/p>\n<p>cannot take away his right to claim amounts which, on the<\/p>\n<p>finding recorded by the Tribunal, he may be entitled to. In this<\/p>\n<p>view of the matter, we are persuaded to agree that the request<\/p>\n<p>for remand can be accepted.\n<\/p>\n<p>     5.    In the result:\n<\/p>\n<pre>     a)    This M.A.C.Appeal is allowed in part;\n\n<span class=\"hidden_text\">M.A.C.A No.2374 of 2007          3<\/span>\n\n     b)    Accepting the request of the learned counsel for the\n\n<\/pre>\n<p>appellant, the dismissal of the claim petition is set aside and the<\/p>\n<p>Tribunal is directed to dispose of the O.P afresh in accordance<\/p>\n<p>with law after giving the parties opportunity to adduce<\/p>\n<p>appropriate evidence. The parties shall be given opportunity to<\/p>\n<p>amend their pleadings also at the discretion of the court below;<\/p>\n<p>     c)    Parties are directed to appear before the Tribunal on<\/p>\n<p>15.02.2010.\n<\/p>\n<p>     6.    The Registry shall forthwith forward the records to<\/p>\n<p>the Tribunal. We direct the Tribunal to dispose of the matter<\/p>\n<p>afresh as expeditiously as possible &#8211; at any rate, within a further<\/p>\n<p>period of 4 months from 15.02.2010. We say so, because the<\/p>\n<p>accident in the instant case, we note, had taken place as early as<\/p>\n<p>on 15.01.1997.\n<\/p>\n<p>     7.
