S.J.MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nwrit petition &#8211; Special Civil Application No.4353\/2008 has been<br \/>\npreferred by the Liquidator &#8211; Petrofils Co-operative Limited<br \/>\n(in liquidation) challenging the notice issued under Section 13(2) of<br \/>\nthe Securitisation and Reconstruction of Financial Assets and<br \/>\nEnforcement of Security Interest Act, 2002. On 23rd June<br \/>\n2010, the Court, having noticed that no measures were taken under<br \/>\nSection 13(4) of the said Act, did not choose to pass any order but<br \/>\nallowed the parties to make settlement to solve the problem. On the<br \/>\nrequest of the parties, the case was adjourned, to be listed on 8th<br \/>\nJuly 2010.\n<\/p>\n<p>\tIn<br \/>\nthe said case, Civil Application No.4459\/2010 has been filed by one<br \/>\nVinubhai Chhotabhai Patel and 28 others, wherein the Court, having<br \/>\nnoticed the aforesaid facts, did not choose to pass any order.\n<\/p>\n<p>\tThe<br \/>\npresent Civil Application has been filed by Vinubhai Chhotabhai Patel<br \/>\nand 28 others, praying to quash and set-aside the sale<br \/>\ncertificate-cum-possession letter issued by the Official Liquidator<br \/>\nin favour of respondent nos.15 and 16. It is alleged that during the<br \/>\npendency of the case, the Official Liquidator has sold the property<br \/>\nof the applicants of the present Civil Application.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the petitioner submits that earlier on 6th<br \/>\nApril 2010 in Civil Application No.3036\/2010 in Special Civil<br \/>\nApplication No.4353\/2008 when this Court noticed that the auction has<br \/>\nalready taken place pursuant to the Court&#8217;s order, allowed the<br \/>\nLiquidator to confirm the sale in absence of any objection made by<br \/>\nany of the parties.\n<\/p>\n<p>\tWe<br \/>\nhave heard learned counsel for the parties and perused the matters.\n<\/p>\n<p>\tIn<br \/>\nthe present case, as the Liquidator has made auction sale of the<br \/>\nproperty, giving rise to a fresh cause of action, though it is always<br \/>\nopen to the aggrieved persons to challenge the same by filing a case<br \/>\nbefore a Court of competent jurisdiction but such prayer cannot be<br \/>\nmade by way of intervention petition (Civil Application).
