The<br \/>\n\tclaims Tribunal has rejected claim petition filed by claimant for<br \/>\n\tthe claim of Rs. 7,70,000\/- with costs and interest against<br \/>\n\tappellant.\n<\/p>\n<p>The<br \/>\n\taccident occurred on 17\/2\/1997. According to claimant vehicle of<br \/>\n\topponent no. 2 is having insurance from opponent no. 3 traveling in<br \/>\n\tMotor No. GJ-11-T-2042 with family members at Jogwad Village for<br \/>\n\tDarshan of Kuldevi.  At about 3.30 while going to Jamkhambhalia to<br \/>\n\tDwarka, at that occasion, driver of Motor Car No. GJ-11-T-2042 was<br \/>\n\tdriving this vehicle in rash and negligent manner and dashed with<br \/>\n\ttree, which resulted into serious injuries to occupants of Car those<br \/>\n\twho are claimants.\n<\/p>\n<p>The<br \/>\n\tclaims Tribunal has considered claim of claimants.  The driver and<br \/>\n\towner has filed reply vide exh 9 and insurance company has also<br \/>\n\tfiled reply vide exh 17.  Thereafter, issues were framed vide exh\n<\/p>\n<p>\t23.  Before claims Tribunal, relevant record was produced vide exh<br \/>\n\t41 to 45, 47 and 48.  Vide exh 41 FIR, Vide exh 42 Panchnama and<br \/>\n\tcomplaint was filed by complainant Kishorchandra Joshi before<br \/>\n\tJamkhambhalia Police station on 19\/2\/1997.\n<\/p>\n<p>The<br \/>\n\tTribunal has come to conclusion after appreciating evidence on<br \/>\n\trecord that FIR vide exh 41 and Panchnama vide exh 42 are doubtful<br \/>\n\tbecause for some bad intention after having advice from experts<br \/>\n\tperson, this episode has been prepared by claimants.\n<\/p>\n<p>The<br \/>\n\tclaims tribunal has come to conclusion that if certified copy of<br \/>\n\tcharge sheet vide exh 43 is to be considered then FIR vide exh 41<br \/>\n\tand Panchnama vide exh 42 is clearly made doubt to the extent that<br \/>\n\tboth are wrong and fabricated documents. In fact, claim petition was<br \/>\n\tfiled on the basis of wrong case or after thought by claimants.  The<br \/>\n\tclaims Tribunal has examined reply vide exh 9 given by owner and<br \/>\n\tdriver, those who remained silent just to fulfill bad intention of<br \/>\n\tKishorchandra Purshottam Joshi and merely just show has been created<br \/>\n\tby owner and driver that apparently some objection has been raised<br \/>\n\tbut no evidence was led by opponent no. 1 and 2 not only that<br \/>\n\tdocuments, which has been produced by claimants FIR vide exh 41,<br \/>\n\tPanchnama vide exh 42 and charge sheet vide exh 43 has been accepted<br \/>\n\tby opponent no. 1 and 2.\n<\/p>\n<p>Therefore,<br \/>\n\tclaims Tribunal was having clear doubt against proceeding initiated<br \/>\n\tby claimants. The story, which has been developed by claimants to<br \/>\n\tthe extent that accident occurred by vehicle, in place of another<br \/>\n\tvehicle has been mentioned, which covered risk of third party.  That<br \/>\n\thas been done with help of other surrounding person because an<br \/>\n\teducated person, who has taken benefit of technicality can not<br \/>\n\tcommitted this kind of mischief and other vehicle was mentioned in<br \/>\n\tplace of original vehicle. In original vehicle risk of 3rd<br \/>\n\tparty was not available, but in other vehicle risk of 3rd<br \/>\n\tparty was available.  Therefore, this vehicle was changed, in<br \/>\n\tpanchnama, FIR and charge sheet, mischief has been committed by<br \/>\n\tclaimants to have compensation.\n<\/p>\n<p>Therefore,<br \/>\n\taccording to my opinion, claims Tribunal has rightly considered<br \/>\n\tclaim petition and also appreciated documents, which were on record<br \/>\n\tand find out real truth behind curtain after examining documentary<br \/>\n\tevidence and find out bad intention of claimants to have<br \/>\n\tcompensation as 3rd party by changing of vehicle.\n<\/p>\n<p>Therefore,<br \/>\n\tview taken by claims tribunal is correct and rightly examined the<br \/>\n\tissue.  For that, claims tribunal has not committed any error which<br \/>\n\twould require any interference by this Court.\n<\/p>\n<p>Hence<br \/>\n\tthere is no substance in the present appeal. Accordingly, present<br \/>\n\tappeal is dismissed.  Today, first appeal is dismissed by this<br \/>\n\tCourt.  Therefore, no order is required to be passed in civil<br \/>\n\tapplication. Therefore, civil application is disposed of.\n<\/p>\n<p>After<br \/>\n\tthe judgment and order was dictated by this court and before it<br \/>\n\tcould be signed by this court, learned advocate Mr. Dagli requests<br \/>\n\tto give him audience as he wants to argue some point, therefore,<br \/>\n\tthis court has given audience to learned advocate Mr. Dagli in<br \/>\n\tconsonance with the principles of natural justice.\n<\/p>\n<p>It<br \/>\n\twas submitted by the learned advocate Mr. Dagli that accident<br \/>\n\toccurred  in motor car no. 2042 and not by vehicle no. 2402 because<br \/>\n\taccording to him, vehicle NO. 2402 was manufactured in year 2000,<br \/>\n\ttherefore, it was not possible to have accident in year 1997. Such<br \/>\n\tcontention was not raised before claims tribunal by claimants and<br \/>\n\tfindings have been given by claims tribunal after considering<br \/>\n\toriginal record. Claims tribunal has in terms come to conclusion<br \/>\n\tthat accident occurred in vehicle bearing No.GJ-11-T-2402 and not in<br \/>\n\tvehicle bearing No. GJ-11-T-2042 because there is no reason to<br \/>\n\tutilise wrong number by Shri JD Chavda, Head Police Constable.<br \/>\n\tTherefore, claims tribunal has rightly appreciated evidence on<br \/>\n\trecord and claims tribunal has not committed any error while<br \/>\n\tdismissing claim petition and question which was not raised relating<br \/>\n\tto facts now that question cannot be raised for first time before<br \/>\n\tthis court.\n<\/p>\n<p>Therefore,<br \/>\n\tthat contention raised by learned Advocate Mr. Dagli is rejected. In<br \/>\n\tclaim petition, claimants shall have to prove accident, vehicle<br \/>\n\tinvolved in accident and injury\/death.
