BASANT, J.\n\n                         - - - - - - - - - - - - - - - - - - - - - -\n\n                         Crl.M.C.No.  2461  of   2007\n\n                         - - - - - - - - - - - - - - - - - - - - - -\n\n                   Dated this the  2nd  day of   August, 2007\n\n\n                                      O R D E R\n<\/pre>\n<p>        The  petitioner faces indictment in a prosecution in S.T. 294 of<\/p>\n<p>2005  (not  294  of 1995  as  shown  in  the  petition)  before  the  C.J.M.,<\/p>\n<p>Manjeri.     Consequent to his non-appearance, the learned Magistrate<\/p>\n<p>has   issued   a   non-bailable   warrant   to   procure   the   presence   of   the<\/p>\n<p>petitioner.     Other   coercive   processes   have   also   been   taken.         The<\/p>\n<p>petitioner   now   finds   such   warrant   of   arrest   and   coercive   processes<\/p>\n<p>chasing him.\n<\/p>\n<\/p>\n<p>        2.   According  to  the  petitioner  he  is   absolutely  innocent.   He<\/p>\n<p>has   paid   the   entire   amount   due   to   the   complainant.     But   the<\/p>\n<p>complainant is not withdrawing the case.    He is willing to surrender<\/p>\n<p>before the learned Magistrate and seek bail.  He shall co-operate with<\/p>\n<p>the Court for the expeditious disposal of the case.  But he apprehends<\/p>\n<p>that   his   application   for   bail   may   not   be   considered     by   the   learned<\/p>\n<p>Magistrate on merits, in accordance with law and expeditiously.     In<\/p>\n<p>these  circumstances it is   prayed   that appropriate directions may be<\/p>\n<p>issued  to  the  learned  Magistrate  to  release  the  petitioner  on  bail  on<\/p>\n<p>the date of surrender itself.\n<\/p>\n<p>\n Crl.M.C.No.  2461  of   2007<\/p>\n<p><span class=\"hidden_text\">                                                      2<\/span><\/p>\n<p>           3.       It   is     certainly   for   the   petitioner   to     appear   before   the   learned<\/p>\n<p>Magistrate and   explain to the learned Magistrate the circumstances  under<\/p>\n<p>which he could not earlier appear before the learned Magistrate.  I have no<\/p>\n<p>reason   to   assume   that   the   learned   Magistrate   would   not   consider   the<\/p>\n<p>application for bail to be filed by the petitioner when he surrenders before<\/p>\n<p>the   learned   Magistrate,   on   merits,   in   accordance   with   law     and<\/p>\n<p>expeditiously.     Every   court   must   do   the   same.     No   special   or   specific<\/p>\n<p>direction   appears   to   be   necessary.     Sufficient   general   directions   have<\/p>\n<p>already   been   issued   by   this   Court   in   the   decision   in  <a href=\"\/doc\/147290035\/\">Alice   George    v.<\/p>\n<p>Dy.S.P. of Police<\/a>  (2003 (1) KLT 339).\n<\/p>\n<\/p>\n<p>           4.  This application  is accordingly dismissed.   I may however hasten<\/p>\n<p>to  observe  that if the petitioner appears before the learned Magistrate and<\/p>\n<p>applies  for  bail  after  giving  sufficient  prior  notice to  the  Prosecutor  in<\/p>\n<p>charge of the case,   the  learned Magistrate must  proceed to pass orders on<\/p>\n<p>merits, in accordance with law and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself.<\/p>\n<pre>\n\n\n\n\n\n                                                                     (R.
