Justice N.K.BALAKRISHNAN\n\n Dated :10\/01\/2011\n\n O R D E R\n                  N.K.BALAKRISHNAN, J.\n                  --------------------------------\n                  W.P.(C) No.3197 of 2010\n                  ---------------------------------\n        Dated this the 10th day of January 2011\n\n\n                       J U D G M E N T\n<\/pre>\n<p>     As per Ext.P10 order the learned Munsiff directed the<\/p>\n<p>revision petitioner herein to produce certain documents<\/p>\n<p>mentioned in Ext.P8. Resisting the request for summoning the<\/p>\n<p>documents, objection statement was filed by the petitioner<\/p>\n<p>herein.   The objection raised by the petitioner was that the<\/p>\n<p>documents sought for are not necessary for the determination of<\/p>\n<p>the point involved in the application filed by the respondent<\/p>\n<p>complaining of violation of the order of injunction. The objection<\/p>\n<p>was turned down by the learned Munsiff and summons was<\/p>\n<p>issued to the witnesses to produce the documents.<\/p>\n<p>     2.    The learned counsel for the petitioner submits that<\/p>\n<p>the order passed by the learned Munsiff under Order XXXIX Rule<\/p>\n<p>1 CPC was not violated by the petitioner herein and that no<\/p>\n<p>evidence as such is required in that matter. It is a fact that an<\/p>\n<p>W.P.(C) No.3197 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 2 :-<\/span><\/p>\n<p>application was filed by the respondent under Rule 2A of Order<\/p>\n<p>XXXIX CPC. What are the documents to be produced to prove<\/p>\n<p>the alleged violation of the order of injunction is not supposed to<\/p>\n<p>be said by this Court at this stage. The main grievance of the<\/p>\n<p>petitioner is that SNDP Yogam is a company whereas the High<\/p>\n<p>Range SNDP Union is a Sakha. It is stated that this Sakha is not<\/p>\n<p>directly under the control of the Yogam. Any way those are not<\/p>\n<p>matters to be dealt with in this writ petition. The grievance<\/p>\n<p>voiced by the learned counsel for the petitioner is that under the<\/p>\n<p>guise of a petition under Rule 2A of Order XXXIX the respondent<\/p>\n<p>is trying to fish out evidence for some other case by collecting<\/p>\n<p>documents from the Sakha which are absolutely not necessary<\/p>\n<p>for the proper adjudication of the petition filed under Rule 2A of<\/p>\n<p>Order XXXIX CPC.\n<\/p>\n<p>      3.   The learned counsel for the respondent submits that<\/p>\n<p>the order passed by the court below summoning the witnesses to<\/p>\n<p>produce certain documents is not something to be interfered<\/p>\n<p>with invoking jurisdiction under Article 227 of the Constitution<\/p>\n<p>of India. Jurisdiction under Article 227 of the Constitution of<\/p>\n<p>India is only visitorial in nature. I find force in that submission.<\/p>\n<p>W.P.(C) No.3197 of 2010<\/p>\n<p><span class=\"hidden_text\">                               -: 3 :-<\/span><\/p>\n<p>This Court should not interfere in the matter as the court below<\/p>\n<p>has only summoned the witnesses to produce documents. The<\/p>\n<p>relevancy or otherwise of those documents for the purpose of<\/p>\n<p>adjudication of the petition filed under Rule 2A of Order XXXIX<\/p>\n<p>CPC will certainly be considered when those documents are<\/p>\n<p>brought in evidence. So much so, I find no reason to interfere<\/p>\n<p>with the order passed by the learned Munsiff. The petitioner can<\/p>\n<p>either produce the document or file an affidavit to the effect that<\/p>\n<p>the documents are not with them, if it is so.\n<\/p>\n<p>           In the result, this writ petition is dismissed.
