DABHI, APP, for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr. Dabhi, learned APP, appears and waives service of rule on behalf<br \/>\nof the respondent State of Gujarat.\n<\/p>\n<p>2.\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>3.\t\tBy<br \/>\nfiling instant application under Section 389 of the Code of Criminal<br \/>\nProcedure, the applicant-convict prisoner, who, by judgement and<br \/>\norder dated 13.1.2009 rendered in Sessions Case No. 274 of 2007 by<br \/>\nlearned 6th Additional District &amp; Sessions Judge,<br \/>\nSurat, has been convicted under Section 304 Part-I of the Indian<br \/>\nPenal Code and sentenced him to rigorous imprisonment for 10 years,<br \/>\nhas prayed for suspension of sentence and to enlarge him on regular<br \/>\nbail during the pendency and final hearing of the above numbered<br \/>\nCriminal Appeal.\n<\/p>\n<p>4.\t\tAt<br \/>\nthe time of hearing of the application, Mr. Pandey, learned advocate<br \/>\nfor the applicant does not press the application and seeks leave to<br \/>\nwithdraw the same.\n<\/p>\n<p>5.\t\tMr.\n<\/p>\n<p>Dabhi, learned APP, has no objection if leave as prayed for is<br \/>\ngranted.\n<\/p>\n<p>6.\t\tHence<br \/>\nleave to withdraw the application is granted.
