7   12.10.2011                  These cases are of Teachers of Magadh University.\n<\/p>\n
                    They had filed these contempt applications for implementation of<\/p>\n
                    judgment of this Court in the case of Dr Binod Kumar Pandey &<\/p>\n
                    Others -Versus- T M Bhagalpur University & Others being CWJC<\/p>\n
                    No 18552 of 2009 and analogous cases delivered on 05.07.2010.\n<\/p>\n
                    The said judgment related to the pay scale that was liable to be given<\/p>\n
                    to Teachers upon pay revision with effect from 01.01.1996. This<\/p>\n
                    Court allowed the writ petitions. As by the time the writ petitions
\n                                   5<\/span>
\n          were filed and heard, pay scales were revised and recoveries were<\/p>\n
          made, enhanced pay scales were reduced, there was huge liability on<\/p>\n
          the University to refund and pay the amounts and not having<\/p>\n
          complied with the order in the writ petitions, these contempt<\/p>\n
          applications as against the Magadh University were filed.\n<\/p>\n
                      In MJC No 215 of 2011, a show cause has been filed on<\/p>\n
          behalf of the State stating that substantial compliance has been<\/p>\n
          made. One wonders what steps State is taking to seek compliance of<\/p>\n
          order of this Court not only in Magadh University because several<\/p>\n
          cases are still, as per show cause itself, languishing for compliance<\/p>\n
          what to talk of other Universities where there have been no<\/p>\n
          compliance whatsoever. Theses cases are those cases in which both<\/p>\n
          parties have agreed that orders of this Court have been complied<\/p>\n
          wherever refund was due, refund has been made and their salaries<\/p>\n
          restored accordingly.\n<\/p>\n
                      In my view, in such a situation, these contempt<\/p>\n
          applications have now become infructuous and are disposed of<\/p>\n
          accordingly.\n<\/p>\n
