Koshy,J.\n<\/p>\n<\/p>\n
            Appellant sustained injuries in a motor accident.<\/p>\n
Tribunal awarded an amount of Rs.52,386\/- against a claim of<\/p>\n
Rupees Two lakhs and directed the third respondent insurance<\/p>\n
company of the offending vehicle to deposit the amount. The only<\/p>\n
dispute is regarding the quantum of compensation. Ext.A6 wound<\/p>\n
certificate shows that he had sustained fracture of left clavicle,<\/p>\n
fracture of C7 lamina and other injuries.      He was treated as an<\/p>\n
inpatient for 22 days. Ext.A10 disability certificate shows that he<\/p>\n
has got 25% permanent disability. It says as follows:<\/p>\n
                  “The    above     mentioned    patient was
\n            admitted    in   this   hospital on    16.11.1995
\n            following a RTA. He had cervical cord injury and
\n            (L) clavicle #. At present, he has the following
\n            Neurological problems:\n<\/p><\/blockquote>\n
                       1. Wasting of (L) deltoid muscle and
\n                 restricted (L) shoulder movement due to
\n                 these he has difficulty in self care, i.e.,
\n                 disability is 20%.\n<\/p><\/blockquote>\n
                       2.     Significant restriction of neck
\n                 movement disability 5%.\n<\/p><\/blockquote>\n
M.F.A.No. 463\/2003                     2<\/span><\/p>\n
               So, his total permanent disability is 25%
\n               (Twenty five percent).”\n<\/p><\/blockquote>\n
Ext.A8 MRI scan report reads as follows:<\/p>\n
                     “Disruption of the C6-C7 disc with mild
\n               posterior listhesis of C7.\n<\/p><\/blockquote>\n
                     The posterior longitudinal ligament is
\n               backled, but, intact.\n<\/p><\/blockquote>\n
                     The continuity of the dark line
\n               representing the ligamenta Flava at the C6-C7
\n               level is lost.\n<\/p><\/blockquote>\n
                     Abnormal high signal in the interspinous
\n               area on T2 images indicate injury of the
\n               interspinous ligament.\n<\/p><\/blockquote>\n
                     The spinal cord is of normal morphology
\n               and signal character.\n<\/p><\/blockquote>\n
                     The left C6 lamina and the left C6-C7
\n               facets are fractured.\n<\/p><\/blockquote>\n
                     Axial image shows obliteration of the left
\n               C6-C7 neural foramen by soft tissue and bone
\n               fragment.\n<\/p><\/blockquote>\n
                     Coronal scans show normal Brachial
\n               Plesus trunks and divisions on both sides.\n<\/p><\/blockquote>\n
                     Vertbrae and idscs at other levels are
\n               normal.\n<\/p><\/blockquote>\n
                     CV junction is normal.\n<\/p><\/blockquote>\n
               Impression:-\n<\/p><\/blockquote>\n
                     C6-C7 fracture dislocation.
\n                     Rupture of ligamenta Flava, Rupture\/Injury
\n               of interspinous ligaments.\n<\/p><\/blockquote>\n
                     Fracture of left C6-C7 facets with probable
\n               left C7 root injury.”<\/p>\n
The tribunal awarded no compensation for disability and loss of<\/p>\n
earning power on a multiplier method, but, on a rough and<\/p>\n
reasonable basis Rs.12,000\/- was awarded.             According to the<\/p>\n
M.F.A.No. 463\/2003                  3<\/span><\/p>\n
claimant, that is too low an amount and tribunal ought to have<\/p>\n
awarded compensation on a scientific method. The claimant was<\/p>\n
aged 45 at the time of accident. Therefore, the apt multiplier is 13.<\/p>\n
The tribunal fixed monthly income of the claimant as Rs.2,500\/-.<\/p>\n
The accident occurred on 16.11.1995. The tribunal might have fixed<\/p>\n
Rs.100\/- per day as the income and he would have got work for at<\/p>\n
least 25 days in a month and Rs.2,500\/- might have fixed as the<\/p>\n
monthly income.       Further, in the absence of evidence, we are<\/p>\n
unable to enhance the monthly income assessed by the tribunal.<\/p>\n
With regard to the disability, even though the permanent disability<\/p>\n
was certified as 25%, considering the disabilities mentioned, we are<\/p>\n
of the view that only compensation for 10% disability would have<\/p>\n
awarded.       If that is so, compensation payable for permanent<\/p>\n
disability and loss of earning power will be Rs.2,500 x 12 x 10 x 13<\/p>\n
                                                            100<\/span><\/p>\n
= 39,000\/-. The tribunal awarded only Rs.15,000\/- under the above<\/p>\n
head. Therefore, additional compensation payable under this head<\/p>\n
will be Rs.24,000\/-. We are of the view that compensation granted<\/p>\n
under other heads are just and reasonable.             In the above<\/p>\n
circumstances, we direct the third respondent insurance company to<\/p>\n
deposit the above additional compensation of Rs.24,000\/- over and<\/p>\n
M.F.A.No. 463\/2003                  4<\/span><\/p>\n
above the amount decreed by the tribunal with 7.5% interest from<\/p>\n
the date of application till its deposit. On deposit of the amount,<\/p>\n
the appellant is allowed to withdraw the same.<\/p>\n
