Today, when the matter is taken up<br \/>\nfor hearing, Mr. Puj, the learned counsel for the respondent Bank<br \/>\nconfirms the position that all arrears of the installments are duly<br \/>\npaid by the petitioner and now the petitioner will be required to pay<br \/>\nregular installments as and when it becomes due.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Jani, learned advocate for the petitioner states that henceforth<br \/>\nregular installment shall be paid as and when it becomes due.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, as the account is regularized and the petitioner<br \/>\nhas also shown willingness to pay regular installment as and when it<br \/>\nbecomes due, the action under the Act, would not survive since there<br \/>\nwould not be outstanding due. So far as future liabilities are<br \/>\nconcerned, the parties may abide by agreement of loan transactions.\n<\/p>\n<p>5.\tAs<br \/>\nthe respondent Bank invoked power under the  Act and had approached<br \/>\nbefore the learned Metropolitan Magistrate and based on the same, the<br \/>\nlearned Metropolitan Magistrate had passed order for providing<br \/>\nassistance of the police for taking over the possession, such<br \/>\nimpugned order under Section 14 of the Act would also not survive, in<br \/>\nview of subsequent developments referred to hereinabove.\n<\/p>\n<p>6.\tHence,<br \/>\npresent petition is disposed of with the observation that the action<br \/>\nof the bank in view of the aforesaid fact as well as the order passed<br \/>\nby the learned Metropolitan Magistrate, both under the Act, which are<br \/>\nimpugned in the present petition would not survive. It is also<br \/>\nclarified that for the future recovery of the loan, the parties may<br \/>\nabide by the terms and conditions of the agreement. In the event,<br \/>\nthere is any failure on the part of the petitioner to pay the amount,<br \/>\nthe bank shall be at liberty to resort to an appropriate proceedings<br \/>\nunder the Act in accordance with law and at that stage, right and<br \/>\ncontentions of both the sides under the Act shall remain open.<br \/>\nDisposed of. Rule is made absolute accordingly.
