JUSTICE BHAGWATI PRASAD)<\/p>\n<p>\t\tThese<br \/>\ntwo appeals have been filed challenging the judgment and order dated<br \/>\n02.01.1998 passed by the learned Additional Sessions Judge<br \/>\n(Atrocity), Special Court, Kutch-Bhuj in Special Case No.126 of 1997<br \/>\nwhereby the Special Court has convicted the appellants of both the<br \/>\nappeals for the offence punishable under Section 302 read with<br \/>\nSection 114 of the Indian Penal Code [?SIPC?? for short] and<br \/>\nsentenced them to suffer life imprisonment and imposed fine of<br \/>\nRs.5000=00 each, in default S.I. for six months.\n<\/p>\n<p>2.\t\tBriefly<br \/>\nstated the case of the prosecution is that two years prior to the<br \/>\nincident of 13.02.1997, a quarrel had taken place between the<br \/>\ndeceased Harijan Vajabhai and the present appellants over fence<br \/>\nallegedly put up by the appellants outside their hut in the slum<br \/>\nbehind Cargo Petrol Pump. As a result of the said quarrel, the<br \/>\nrelationship between the deceased and accused had become bitter. On<br \/>\n13.02.1997, at about 6.00-6.30 p.m., the accused persons had an<br \/>\naltercation with deceased Harijan Vajabhai Bhavabhai outside their<br \/>\nslum quarters; abuses were hurled by the accused and the deceased;<br \/>\nand the accused thereafter getting enraged gave one blow each with<br \/>\nthe wooden-log on the face and head of the deceased. The accused<br \/>\nSuleman Husain gave a blow on the head of Vajabhai and accused Sajan<br \/>\nHusain gave a blow on the face of Vajabhai. Because of the injuries<br \/>\ncaused by the said blows, Vajabhai died and a case of offence under<br \/>\nSection 302 IPC came to be registered against the present appellants.<br \/>\nIt was also the case of the prosecution that deceased Vajabhai<br \/>\nbelonged to  Scheduled Caste and the appellants gave him castiest<br \/>\nabuses. Therefore, a charge under Section 3(2)(5) of the The<br \/>\nScheduled Castes &amp; The Scheduled Tribes (Prevention of<br \/>\nAtrocities) Act, 1989. The trial Court after appreciating the<br \/>\nevidence led by the prosecution found  the appellants guilty of the<br \/>\noffence punishable under Section 302 IPC, but acquitted them of the<br \/>\ncharge under the Atrocities Act.\n<\/p>\n<p>3.\t\tHeard<br \/>\nMs.Shilpa Shah, learned advocate for the appellants-accused in both<br \/>\nthe appeals and Mr.Maulik Nanavati, learned Additional Public<br \/>\nProsecutor for the respondent-State. They have also taken us through<br \/>\nthe entire record of the trial Court.\n<\/p>\n<p>4.\t\tMs.Shah,<br \/>\nlearned advocate for the appellants, argued at length, inter alia,<br \/>\ncontending that most<br \/>\nof the witnesses examined by the prosecution including the<br \/>\ncomplainant ?  Babu Kaya Harijan have turned hostile and not<br \/>\nsupported the case of the prosecution. Each of these witnesses has<br \/>\nstated in their evidence that they reached the place of the offence<br \/>\nonly after the deceased had fallen on the ground and that they have<br \/>\nnot seen the actual commission of crime. Only two witnesses, P.W.-6<br \/>\nVelabhai Maheraman (uncle of deceased) and P.W.-8 Lakhibai Vajabhai<br \/>\nHarijan (wife of deceased) have supported the case of the<br \/>\nprosecution. However, she has submitted that neither of these two<br \/>\nwitnesses had actually witnessed the incident and had come at the<br \/>\nplace of the offence only after the deceased had fallen on the<br \/>\nground. Even otherwise, being close relatives of the deceased, they<br \/>\nare interested witnesses and, therefore, also their evidence should<br \/>\nnot be believed. She has also pointed out that there are several<br \/>\ncontradictions and omissions in the evidence of these two witnesses<br \/>\nand there is no grain in their evidence which can form the basis of<br \/>\nthe conviction and, therefore, the conviction of the appellants is<br \/>\nunsustainable.\n<\/p>\n<p>5.\t\tOn<br \/>\nscrutinizing the evidence of these two witnesses, we are not in a<br \/>\nposition to accept the said submissions of the learned counsel. So<br \/>\nfar as the assault on the deceased by the appellants is concerned,<br \/>\nthe evidence of these two witnesses has remained unchallenged and on<br \/>\nthe other hand, it gets corroboration from the evidence of the<br \/>\ndoctor, who conducted the postmortem examination of the deceased.\n<\/p>\n<p>6.\t\tIt<br \/>\nis true that the complainant? Babubhai Kaya has turned hostile, but<br \/>\nin his cross-examination by the learned Prosecutor, he has admitted<br \/>\nto have given the complaint. As far as witnesses Vela Maheraman<br \/>\n(P.W.-6) and Lakhibai Vajabhai Harijan (P.W.-8) are concerned, though<br \/>\nthey are related to the deceased, on this ground alone their evidence<br \/>\ncannot be discarded. Both these witnesses have stated about the<br \/>\nmanner in which the incident had happened; the role played by the<br \/>\naccused and how the deceased was transferred to the hospital from the<br \/>\nplace of incident. Nothing has been brought out in the<br \/>\ncross-examination, which would render their evidence doubtful or<br \/>\nincredible. On the contrary, we find that their evidence is<br \/>\ntrustworthy and inspires confidence.\n<\/p>\n<p>7.\t\tMs.Shah,<br \/>\nlearned advocate for the appellants, then urged that even if the<br \/>\nprosecution has been able to establish that appellant? Suleman<br \/>\nKumbhar gave a blow on the head of the deceased and appellant? Sajan<br \/>\nHusen gave a blow on the face of the deceased, the evidence led by<br \/>\nthe prosecution unhesitantly and unequivocally points out  that the<br \/>\naccused never came with the intention of killing the deceased though<br \/>\nultimately on account of certain hot exchange of words between the<br \/>\ndeceased and the accused, the appellants gave blows with the<br \/>\nwooden-log and, therefore, the conviction will not be one under<br \/>\nSection 302 IPC but one under Section 304 IPC.\n<\/p>\n<p>8.\t\tThe<br \/>\nlearned counsel appearing for the State on the other hand contended<br \/>\nthat looking  to the severity of the blow and the situs of the body<br \/>\nof the deceased where the blow was given, conclusively indicates the<br \/>\nintention, the same being to cause the murder and, thus, the offence<br \/>\nunder Section 302 IPC.\n<\/p>\n<p>9.\t\tTo<br \/>\nappreciate the correctness of the rival submissions, we have examined<br \/>\nthe evidence of P.W.-6, Velabhai Meraman and P.W.-8, Lakhiben<br \/>\nVajabhai as also the complaint and the evidence of complainant P.W.-1<br \/>\nBabu Kaya. Their evidence clearly discloses that there was heated<br \/>\naltercation between the appellants and the deceased and that both<br \/>\nsides were abusing each other. As a result of such animated<br \/>\nconversation, the appellants got enraged and in the heat of the<br \/>\nmoment gave a blow each on the head and face of the deceased. The<br \/>\nvery fact that the appellants did not immediately assault the<br \/>\ndeceased on his coming out of his quarter and that there was an<br \/>\naltercation preceding the actual assault suggests that the accused<br \/>\nnever came with the intention of causing death of the deceased and it<br \/>\nwas only because of circumstances they developed on spur of the<br \/>\nmoment that the appellants gave the respective blows to the deceased.<br \/>\nAt the same time, we are of the opinion that the appellants must be<br \/>\nheld to have known the consequences of the blows being given and<br \/>\nsince it was a single blow, the offence would be one under Part I of<br \/>\nSection 304 IPC.\n<\/p>\n<p>\t\tWe<br \/>\nare inclined to set aside the conviction of the appellants under<br \/>\nSection 302 IPC and instead convict them under Section 304 Part-I of<br \/>\nthe IPC and sentence them to undergo rigorous imprisonemnt for ten<br \/>\nyears and fine of Rs.5,000=00 each, in default, S.I. for six months.\n<\/p>\n<p>10.\t\tFor<br \/>\nthe foregoing reasons, both the appeals are partly allowed. The<br \/>\nconviction of both the appellants is altered from Section 302 IPC to<br \/>\none under Section 304 Part I of the IPC and the sentence is reduced<br \/>\nto ten years&#8217; R.I. and fine of Rs.5,000=00, in default S.I. for six<br \/>\nmonths. On undergoing the sentence imposed and deposit of fine, the<br \/>\nappellants be set at liberty if not wanted in any other offence.\n<\/p>\n<p>[Bhagwati<br \/>\nPrasad, J.]<\/p>\n<p>[Bankim<br \/>\nN.
