(C) No.7461 of 2009)\n\nPushpchand                                                 ...Appellant(s)\n\n\n                                   Versus\n\n\nBuilam Kanwar (Dead) through L.Rs.                        ...Respondent(s)<\/pre>\n<p>                               O   R   D   E   R<\/p>\n<p>         Leave granted.\n<\/p>\n<p>         Heard learned counsel for the parties.<br \/>\n         This    is     the    tenant&#8217;s    appeal    for     setting   aside<br \/>\njudgment dated 17th January, 2009 of the learned Single<br \/>\nJudge of the Rajasthan High Court who allowed the second<br \/>\nappeal   filed     by    the    landlord,      set   aside    judgment    and<br \/>\ndecree dated 2.2.2005 of the lower appellate court and<br \/>\nrestored the decree of eviction passed by the trial Court.\n<\/p>\n<p>         A perusal of the impugned judgment shows that after<br \/>\nmaking a mention of the judgments and decrees passed by<br \/>\nthe courts below, the High Court proceeded to observe:<br \/>\n&#8220;The   following      substantial      questions     of    law   arises   for<br \/>\nconsideration by this Court:\n<\/p>\n<blockquote><p>          &#8220;Whether the first appellate court<br \/>\n          could reverse the findings of facts<br \/>\n          recorded by the learned trial Court on<br \/>\n          issue No.1(a) and 1(b) simply because<br \/>\n          the learned first appellate court did<br \/>\n          not agree with the findings recorded by<br \/>\n          the learned trial Court and no error<br \/>\n          much less any jurisdictional error has<br \/>\n          been committed by the learned trial<br \/>\n          court.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                                          &#8230;.2\/-\n<\/p><\/blockquote>\n<blockquote><p>                                  &#8211; 2 &#8211;\n<\/p><\/blockquote>\n<blockquote><p>        It is borne out from the record that at the time of<br \/>\nissuance of notice in the second appeal, the High Court<br \/>\ndid   not   frame   any    substantial      question   of    law.     Even<br \/>\nbefore commencement of hearing of the second appeal, the<br \/>\nHigh Court is not shown to have formulated any substantial<br \/>\nquestion of law.<\/p><\/blockquote>\n<p>        It is settled law that when a second appeal is<br \/>\nplaced before the High Court for consideration, it has to<br \/>\nconsider whether any substantial question of law arises<br \/>\ntherein.    In case the High Court feels satisfied that the<br \/>\ncase involves a substantial question of law, then it is<br \/>\nrequired to formulate such question.              The appeal is then<br \/>\nrequired to be heard on the question so formulated.                    The<br \/>\nrespondent can, at the hearing of the appeal, argue that<br \/>\nthe case does not involve any substantial question of law<br \/>\nincluding the one framed by the High Court.                 Of course, it<br \/>\nis open to the High Court, for reasons to be recorded, to<br \/>\nformulate any other substantial question of law.\n<\/p>\n<p>        Since the impugned judgment was passed by the High<br \/>\nCourt without formulating any substantial question of law<br \/>\narising in the case, the same is liable to be set aside.<br \/>\nAccordingly, the appeal is allowed, the impugned judgment<br \/>\nis set aside and the matter is remitted to the High Court,<br \/>\nwhich shall now consider whether any substantial question<br \/>\nof law arises in the appeal.              If the High Court comes to<br \/>\nthe conclusion that such question arises, then it shall<br \/>\nformulate    the    same   and,   thereafter,     decide      the   appeal<br \/>\nafter giving opportunity of hearing to the parties.\n<\/p>\n<p>        As the suit for eviction was filed in the year<br \/>\n1991, the High Court is requested to dispose of the appeal<br \/>\nwithin a period of six months from the date of receipt \/<br \/>\nproduction of copy of this order.\n<\/p>\n<p>                                                                    &#8230;.3\/-\n<\/p>\n<p>                             &#8211; 3 &#8211;\n<\/p>\n<p>       All the parties are represented before this Court.<br \/>\nTherefore, the High Court is not required to issue fresh<br \/>\nnotice to any of them.     It will be open to the parties to<br \/>\ninform their respective advocates before the High Court<br \/>\nand arrange for their appearance on the date which may be<br \/>\nfixed by the High Court.\n<\/p>\n<p>                                      &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                                     [B.N.
