(CJ)\nPARIPOORNAN, K.S.(J)\n\nCITATION:\n 1996 AIR 1563\t\t  1996 SCC  (2) 155\n JT 1996 (1)   673\t  1996 SCALE  (1)591\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nSEN J.\n<\/p>\n<p>     Special leave granted.\n<\/p>\n<p>     These  appeals   relate  to  admission  to\t the  Second<br \/>\nProfessional MBBS course in Maharishi Dayanand University by<br \/>\nmigration  from\t  other\t universities.\t The  case   of\t the<br \/>\nappellants, Ms.\t Bhawana  Narula,  Manish  Jain\t and  Anjali<br \/>\nHooda,\tis   that  they\t  have\tsatisfied  the\trequirements<br \/>\nstipulated  by\t the  Medical  Council\tof  India  and\talso<br \/>\nMaharishi Dayanand  University and  were  granted  migration<br \/>\nfrom the  colleges where they were pursuing the MBBS course.<br \/>\nThey joined Maharishi Dayanand University on the strength of<br \/>\nmigration granted  by the University. On 4th June, 1994, the<br \/>\nappellants received  communication from\t Maharishi  Dayanand<br \/>\nUniversity that\t their applications  for  migration  to\t the<br \/>\nSecond\tProfessional   MBBS  course  in\t Maharishi  Dayanand<br \/>\nUniversity had\tbeen granted. On receipt of this intimation,<br \/>\nthey left  the colleges\t in  which  they  were\tstudying  in<br \/>\nKarnataka and  joined Maharishi Dayanand University, Rohtak,<br \/>\nsince  June,  1994  they  were\tpursuing  their\t studies  in<br \/>\nMaharishi Dayanand University.\n<\/p>\n<p>     Some of  the persons, who could not obtain migration to<br \/>\nMaharishi Dayanand University from other universities, field<br \/>\nwrit petitions\tchallenging the\t validity of  the  migration<br \/>\ngranted to  the appellants.  These writ petitions were heard<br \/>\nalong  with  the  batch\t of  other  cases  relating  to\t the<br \/>\nmigration  to\tthe  BDS   course  of\tMaharishi   Dayanand<br \/>\nUniversity. It\tappears from  the  affidavit  filed  by\t the<br \/>\nRegistrar on  behalf of\t the University\t that there  is\t one<br \/>\nfundamental  difference\t  in  the   principle  followed\t  by<br \/>\nMaharishi Dayanand  University for  considering the cases of<br \/>\nmigration of  candidates of  MBBS course  from the manner in<br \/>\nwhich  migration   was\tallowed\t  in  the  BDS\tcourse.\t For<br \/>\nconsidering the\t case  of  migration  to  MBBS\tcourse,\t the<br \/>\nMaharishi Dayanand  University set up a Committee to examine<br \/>\nthe cases  of various  students who  were seeking migration.<br \/>\nThe Committee comprised of :-\n<\/p>\n<p>\t  (a) Professor Ravi Parkash, Head of the Department<br \/>\nof Bio-Science, M.D. University, Rohtak.\n<\/p>\n<p>\t  (b) Professor\t R.K. Tuteja, Head of the Department<br \/>\nof Statistics, M.D. University,. Rohtak.\n<\/p>\n<p>\t  (c) Dr.  S.B. Siwach, Professor &amp; Head, Department<br \/>\nof Medicine, Medical College, Rohtak.\n<\/p>\n<p>\t  (d)  Asstt.\tRegistrar  (R&amp;S),  H.D.\t University,<br \/>\nRohtak.\n<\/p>\n<p>The recommendations  made by  the Committee were accepted by<br \/>\nthe University without making any change at all. There is no<br \/>\nallegation of  bias  against  any  of  the  members  of\t the<br \/>\nCommittee. It  has been\t stated in the affidavit of Devender<br \/>\nSingh, IAS,  Registrar, Maharishi  Dayanand University, that<br \/>\nout of\t20 eligible students seeking migration, 7 of the top<br \/>\n14 students  in merit were granted migration. Since there is<br \/>\nno question of bias of personal animus against any member of<br \/>\nthe Committee,\tit will\t not be\t fair at  this stage  to set<br \/>\naside the selection made by the Committee.\n<\/p>\n<p>     The judgment  of the  High Court  dated 23rd  February,<br \/>\n1995 is\t set aside.
