A.L.DAVE)<\/p>\n<p>\tThe<br \/>\npetitioner has approached this Court making the following prayers:-\n<\/p>\n<p>&#8220;(a)\tYour<br \/>\nLordship may be pleased to direct the respondent No.2 and 3 to refund<br \/>\nan amount of Rs.32,500\/- which is charged in wrong and illegal manner<br \/>\nfrom the petitioner by way of issue a writ of mandamus and\/or<br \/>\ncertiorari or any other writ, order or directions as the Hon&#8217;ble<br \/>\nCourt deems just and proper.\n<\/p>\n<p>(b)\t\t&#8212;&#8211;\t\t&#8212;&#8211;\t\t&#8212;&#8211;\n<\/p>\n<p>(c)\t&#8212;\t\t&#8212;&#8211;\t\t&#8212;-\t\t\t&#8212;&#8211;&#8221;\n<\/p>\n<p>2.\tIt<br \/>\nis clear from the averments made in the petition that the petitioner<br \/>\nseeks recovery of the fee collected by the respondents, which<br \/>\naccording to the petitioner, is in excess of the entitlement of the<br \/>\nrespondents to charge. Differently put, this petition is a civil suit<br \/>\nfor recovery of money couched as a petition and, therefore, it cannot<br \/>\nbe entertained. The petition need not be entertained on the ground of<br \/>\ndelay as well.
