By the said order. the Karnataka Admiiiistrative
\nTribunal [in short ‘the KAT’) has dismissed the
\napplication of the petitioner. The petitioner was before<\/p>\n
the Tribunal questioning t.he order dated l5.09.2G(\u00a5l5aby<\/p>\n
which. she was discharged from service  <\/p>\n
of the Karnataka Civil Service (Probation)   {in5  b <\/p>\n
short “the Rules’).\n<\/p>\n

 ap’p1ViVea.tion\u00ab,oi7__t.he petitioner. It is pointed out that<\/p>\n
iziioiighidvtiiie:—dAiIsel1a1*ge is under Rule 6 of the Rules. the<\/p>\n
Q reason Tor such discharge was by only placing reliance<\/p>\n
  tiudgment of the Horfble Supreme Court in the<\/p>\n
  of Prof. Yeshpal & Another V\/s State of<\/p>\n

\nChhattisgarh & Ors. (AIR 200% SC 420}. in this regard<\/p>\n
it is pointed out that the question which arose for<\/p>\n
consideration before the Hon’ble Supreme Court. iswwith<\/p>\n
regard to the correctness of the UniVersit.ie’s”be’ieng<\/p>\n
constituted by the Gover’nmer.xt and the re’e.og11jitio’n of ”<\/p>\n
the same for the purpose of {JiGC”‘(Lir’i\u00abiversit3r_ <\/p>\n
Commission}. Hence it isecontendeed th.:\u00e9i’t ‘then<\/p>\n
Judgment could not have beerfmade”a.pp.1ir;ah1e’Hto the
\nfacts of the present c.ase_.  ‘ai’sojpoin.tedvout that in
\nthe said Judgment  vii-‘.:’V_Enstitution was<\/p>\n

\nbe made and * iv1iUI’es’pec’t;.\u00abof the students who were<\/p>\n
pursuing their studies “in existing institutions, they<\/p>\n
traiisferred to other colleges recognised by<\/p>\n
 Therefore, when the interest of the<\/p>\n
studerits  were in the college was protected by the<\/p>\n

–\u00bb.a\u00a7pp1i(:ab1e to the students who had aiready<\/p>\n
 ..completed the course and secured their degrees since<\/p>\n

there was no cancellation of withdrawal of the degree
\ncertificate after complying with principies of natural
\njustice. Therefore, the Government at this point. in any
\nevent. could not have dewecognised the <\/p>\n
which had been accepted.\n<\/p>\n

however strongly contended tha.t  'i'.ri_buna1dV<\/p>\n
justified in its conclusion. It–va.is'–rco11tei1de'd  VI:{o1'1'bie
\nSupreme Court had. 'eX_ami.ned' r.iEi:eV""r1f1atter"'thVorough}y
\nand had come to the codncl=.d';'sion Universities<\/p>\n
which V':Vwerc set.'u_p'tcanjfie.t. 'remain in existence. Vifhen
\nsuch decision Vwvas rendered, the Universities which were<\/p>\n

obtainedd'   petitioner herein cannot be considered<\/p>\n

\nwhiie considering a public interest. litigation had come
\nto the conclusion that the Universities Could not have<\/p>\n
estabiished and the approval granted byfr’\u00bbthe<\/p>\n
Chhattisgarh Government under Chhattisg’arh.’_.’__i’iSIijVi<\/p>\n
Khetra Vishwavidhyalaya {Sthapana  <\/p>\n
Adhiniyam, 2002 was iI1~ap’p’ro:priatei } <\/p>\n

Supreme Court however did not go into those aspects of
\nthe matter since at that poirit. the learned Additional
\nSolicitor General had contended that some of the<\/p>\n
universities were never in existence. The Hoifble<\/p>\n
Supreme Court felt that the said aspect. of <\/p>\n
would require the factual assessment asto, the  b <\/p>\n
colleges were in existence or notlzbandele to ‘\u00a7’\u00ab4IAl1e_tlI’;er_tyth,ey’<\/p>\n

such _instit”et_i’ons’;.affiliated to the already existing, State<\/p>\n

‘  in so far as National Technological<\/p>\n
U1’1.i_ver_sity’,}’ Raipur, under which the petitioner had<\/p>\n
 studied and obtained the degree, even as of today there<\/p>\n
 material on record to indicate that there is factual<\/p>\n
at<\/p>\n
