Justice P.R.RAMACHANDRA MENON\n\n Dated :26\/03\/2009\n\n O R D E R\n                 P.R.RAMACHANDRA MENON, J.\n                  -----------------------------------\n                   W.P.(C).No.8449 of 2007 - E\n                   ---------------------------------\n             Dated this the 26th day of March, 2009\n\n\n                          J U D G M E N T\n<\/pre>\n<p>      The petitioner is an organisation registered under the<\/p>\n<p>Travancore Cochin Literary, Scientific and Charitable Societies<\/p>\n<p>Registration Act and members of the petitioner are the workers<\/p>\n<p>engaged in sand mining in the various Panchayaths in Idukki<\/p>\n<p>District. The main grievance is that the respondents\/Panchayaths<\/p>\n<p>having decided to assign the right to collect sand from the<\/p>\n<p>various &#8216;kadavus&#8217; situated in the Panchayaths on a contract basis,<\/p>\n<p>the petitioner, being a society is unable to adopt the tactics being<\/p>\n<p>followed by the contractors, particularly when the maximum<\/p>\n<p>amount that could be quoted per load is only Rs.250\/-.          The<\/p>\n<p>petitioner contends that at least some &#8216;kadavus&#8217; in the<\/p>\n<p>Panchayaths shall be reserved to associations like the petitioner<\/p>\n<p>so as to protect the interest of the actual working class who are<\/p>\n<p>the members of the petitioner.\n<\/p>\n<p>      2.   Learned counsel for the petitioner submits that the<\/p>\n<p>petitioner has already projected their grievances by filing Ext.P2<\/p>\n<p>W.P.(C).No.8449 of 2007 &#8211; E<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>representation before the 1st respondent, which is stated as still<\/p>\n<p>pending. The petitioner will be at liberty to supplement Ext.P2<\/p>\n<p>representation by filing any additional representation within a<\/p>\n<p>period of one month from today. The 1st respondent is directed<\/p>\n<p>to consider Ext.P2 representation and pass appropriate orders in<\/p>\n<p>accordance with law, after giving an opportunity of being heard<\/p>\n<p>to the petitioner and also to the respondents\/Panchayaths, as<\/p>\n<p>expeditiously as possible, and at any rate, within a span of four<\/p>\n<p>months.
