The respondent without<br \/>\nfollowing due procedure of law, dismissed the petitioner from service<br \/>\nw.e.f. 15.01.1995. Thereafter, the petitioner was again appointed on<br \/>\nthe post of Watchman as reliever at Junagadh Branch vide order dated<br \/>\n23.03.1998. As the petitioner was residing at Kalol, he requested the<br \/>\nrespondent to transfer him to a nearby place. However, the respondent<br \/>\nvide order dated 08.05.1998 terminated the service of the petitioner.\n<\/p>\n<p>2.1.\t\tBeing<br \/>\naggrieved by the said order of termination, the petitioner raised a<br \/>\ndispute, which was ultimately referred to the Labour Court for<br \/>\nadjudication being Reference [LCK] No. 730\/1998.  Before the Labour<br \/>\nCourt, both the parties adduced evidence and after appreciating the<br \/>\nmaterial produced before it, the Labour Court partly allowed the<br \/>\nreference with the aforesaid directions. Hence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.  The learned counsel for the respondent states that the<br \/>\nrespondent is agreeable to pay additional amount of Rs.5,000\/- to the<br \/>\npetitioner  over and above the retirement dues which are payable<br \/>\nunder the Rules.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the facts of the case and in view of the aforesaid statement made<br \/>\nby the learned counsel for the respondent, the respondent is directed<br \/>\nto pay an additional amount of Rs.5,000\/- to the petitioner,  over<br \/>\nand above the retirement dues which are payable under the Rules,<br \/>\nwithin a period of six months from today.\n<\/p>\n<p>5.\t\tWith<br \/>\nthe above clarification and directions, the petition stands disposed<br \/>\nof.
