With the consent of learned advocates for the<br \/>\nrespective parties, petition is taken up for final disposal.\n<\/p>\n<p>2.\t\tPetitioner<br \/>\nhad availed loan from respondent no.1. Thereafter, respondent had<br \/>\npreferred Lavad Case No.203 of 2004 against present petitioner to<br \/>\nrecover an amount of Rs.31,24,000\/-.  In the said case, order of<br \/>\nattachment before the judgment has been passed by the Board of<br \/>\nNominees on 28.06.2005. The petitioner preferred appeal before the<br \/>\nGujarat State Cooperative Tribunal, Ahmedabad challenging the decree<br \/>\npassed by the Board of Nominees in Lave Case No.203 of 2004. As there<br \/>\nwas delay in preferring appeal, the petitioner also filed delay<br \/>\ncondonation application being M.C.A.No.557 of 2006 on various ground.<br \/>\n Gujarat State Cooperative Tribunal, Ahmedabad  by impugned order<br \/>\ndated 03.02.2009 rejected the delay condonation applications. Hence,<br \/>\npresent petition.\n<\/p>\n<p>3.\t\tLearned<br \/>\nadvocate for the petitioner submitted that learned Tribunal ought to<br \/>\nhave considered the grounds urged in the application in its true<br \/>\nspirit.   It is submitted that while deciding the application for<br \/>\ncondonation of delay, sufficient cause has to be construed liberally.<br \/>\n Therefore, it is requested to quash the impugned order passed by the<br \/>\nTribunal in delay condonation application.\n<\/p>\n<p>4.\t\tLearned<br \/>\nadvocate for the respondent submitted that order by the Tribunal is<br \/>\nlegal and not required to be interfered with. It is submitted that<br \/>\nmaterial facts have been suppressed by the petitioner, so he is not<br \/>\nentitled to get any relief.  It is requested to dismiss the petition.\n<\/p>\n<p>5.\t\tHeard<br \/>\nlearned advocate for the respective parties.  In opinion of this<br \/>\nCourt, matter should be thrown out on technical ground of delay and<br \/>\nopportunity should be given to the petitioner to submit the case on<br \/>\nmerits.  Reference is made to the decision of this Court in the case<br \/>\nof Shree Ambica Coled Storage and Ors. v\/s. Netpur Cooperative<br \/>\nBank Ltd. and Ors. reported in 2010 (1) GLH (UJ)<br \/>\n10, wherein in para 5, while considering the aspect of<br \/>\ndelay, this Court in para 5 has observed as under :-\n<\/p>\n<p>\t&#8220;5.\tHowever,<br \/>\nthe fact remains that there was delay in preferring the<br \/>\nappeal. Even if it was a strong case on merits in favour of the<br \/>\nappellants to the extent that the award could not stand in law then<br \/>\nalso the Tribunal could have considered the matter for condonation of<br \/>\nthe delay by imposing suitable cost by way of compensation to the<br \/>\nrespondent bank. The Tribunal has not awarded any cost but has<br \/>\ndirected the petitioners to deposit the 15% of the awarded amount,<br \/>\nwhich as per the statement made by the learned counsel for the<br \/>\npetitioner at bar comes to approximately Rs. 20 to 21 lacs.<br \/>\nTherefore, it appears to the Court that it would be just and proper<br \/>\nif the question is considered only on the aspect of cost to be<br \/>\nawarded to the respondent bank for the delay on the part of the<br \/>\npetitioners in preferring the appeal when there is a very strong case<br \/>\non merits to be considered by the Tribunal. Considering the facts and<br \/>\ncircumstances of the case, the appropriate cost would be Rs. 5,000\/-<br \/>\nfor each of the appeal. Hence, the impugned order passed by the<br \/>\nTribunal deserves to be modified.&#8221;\n<\/p>\n<p>6.\t\tIn<br \/>\nview of above and considering the decision of Shree Ambica Coled<br \/>\nStorage (supra), impugned order dated 03.02.2009 passed by the<br \/>\nTribunal in delay condation application is required to be quashed and<br \/>\nset aside.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe reasons stated above, petition is partly allowed. Order dated<br \/>\n03.02.2009 passed by the Gujarat State Cooperative Tribunal,<br \/>\nAhmedabad in Misc. Civil Application No.557 of 2006  is quashed and<br \/>\nset aside and same is allowed and delay caused in preferring appeal<br \/>\nis condoned  on condition that the petitioner shall pay an amount of<br \/>\nRs.1000\/- (One Thousand only) to the respondent no.1 within three<br \/>\nweeks from today. Rule is made absolute to the aforesaid extent.\n<\/p>\n<p>8.\t\tGujarat<br \/>\nState Cooperative Tribunal, Ahmedabad is directed to decide the<br \/>\nappeal in accordance with law.
