SANKARAN, J.\n                   ---------------------------\n                    B.A. No. 6633 of 2009\n              ------------------------------------\n           Dated this the 10th day of February, 2010\n\n                          O R D E R\n<\/pre>\n<p>     The petitioner had filed B.A. No. 5391 of 2009 for the<\/p>\n<p>same relief, which is prayed for in the present Bail Application.<\/p>\n<p>B.A. No.5391\/2009 was dismissed by a detailed order dated<\/p>\n<p>29\/9\/2009, which is extracted below:<\/p>\n<blockquote><p>           &#8221; This is an application for anticipatory bail<\/p>\n<p>     under Section 438 of the Code of Criminal<\/p>\n<p>     Procedure.    The petitioner is accused No.2 in<\/p>\n<p>     Crime No.677\/2009 of Varkala Police Station.<\/p>\n<\/blockquote>\n<blockquote><p>           2.   The    offence   alleged   against   the<\/p>\n<p>     petitioner is under Section 55(a)(i) of the Abkari<\/p>\n<p>     Act.\n<\/p><\/blockquote>\n<blockquote><p>           3.   The prosecution case is that on<\/p>\n<p>     20.08.2009, the police party got information that<\/p>\n<p>     Indian Made Foreign Liquor was being sold in<\/p>\n<p>     Blue   Berries   Restaurant.    The   police  Party<\/p>\n<p>     conducted a search. Five bottles of beer were<\/p>\n<p>     found kept for sale.      The first accused was<\/p>\n<p>     arrested and he stated that the restaurant is<\/p>\n<p>     being run on partnership basis by the persons<\/p>\n<p>     mentioned in the F.I. Statement. The petitioner<\/p>\n<p>     is one among them.\n<\/p><\/blockquote>\n<p>B.A. No. 6633\/2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>             4.   The learned counsel for the petitioner<\/p>\n<p>      submitted that the property where the restaurant is<\/p>\n<p>      constructed, belongs to one Fazeela. The land was<\/p>\n<p>      taken on lease and a building was constructed by<\/p>\n<p>      Kunju Vareeth (third accused).       Fazeela is an<\/p>\n<p>      influential person. She wanted to get back the<\/p>\n<p>      property.    She made threat to forcibly evict the<\/p>\n<p>      lessee. A suit was filed by Kunju Vareeth against<\/p>\n<p>      Fazeela and temporary injunction was obtained on<\/p>\n<p>      31.08.2009. According to the learned counsel for<\/p>\n<p>      the petitioner, the present case was foisted at the<\/p>\n<p>      instance of Fazeela. According to the petitioner, he<\/p>\n<p>      is a member of the trader&#8217;s organisation and he has<\/p>\n<p>      no connection with the running of business in the<\/p>\n<p>      hotel. The petitioner is made an accused only to<\/p>\n<p>      wreak vengeance on him as he had intervened in<\/p>\n<p>      the dispute when Fazeela made the threat to<\/p>\n<p>      unlawfully evict the lessee.\n<\/p>\n<p>             5. The learned Public Prosecutor brought to<\/p>\n<p>      my notice a menu card seized by the police from<\/p>\n<p>      the restaurant. The menu card would indicate that<\/p>\n<p>      several    items of Indian made foreign liquor are<\/p>\n<p>      being regularly sold in the restaurant. Prima facie,<\/p>\n<p>      I am of the view that there are sufficient materials<\/p>\n<p>      to indicate that the petitioner is involved in the<\/p>\n<p>      offence.    No conclusive finding on this aspect is<\/p>\n<p>B.A. No. 6633\/2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>      desirable,   while    disposing   an   application   for<\/p>\n<p>      Anticipatory Bail.\n<\/p>\n<p>             6.   Taking   into  account    the   facts   and<\/p>\n<p>      circumstances of the case, I do not think that the<\/p>\n<p>      petitioner is entitled to the discretionary relief under<\/p>\n<p>      Section 438 of the Code of Criminal Procedure. If<\/p>\n<p>      anticipatory bail is granted to the petitioner, it<\/p>\n<p>      would seriously affect the proper investigation of<\/p>\n<p>      the case.\n<\/p>\n<p>             The Bail Application is accordingly dismissed.&#8221;<\/p>\n<p>      There is no change of circumstances except that there is<\/p>\n<p>change of counsel for the petitioner. There is no ground to<\/p>\n<p>entertain a second application.\n<\/p>\n<p>      The Bail Application is accordingly dismissed.<\/p>\n<p>                                    K.T.
