She relied upon decision of apex court in Yallwwa (Smt.) &amp;<br \/>\n\tOthers versus National Insurance Company &amp; Others reported in<br \/>\n\t2007 ACJ 1934 = 2007(6) SCC 657 and submitted before this Court that<br \/>\n\tit has been held by apex court that if any objection has been raised<br \/>\n\tby insurance company covered by section 149(2), then, claims<br \/>\n\ttribunal must have to decide and examine such objections even at the<br \/>\n\tstage of application under sec. 140 of MV Act. Apart from that,<br \/>\n\tapplication under sec. 166 of MV Act, 1988 filed by claimant is<br \/>\n\tpending before claims tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\tin view of these facts, admission of this appeal would be having no<br \/>\n\tmeaning because it will have to wait upto decision in an application<br \/>\n\tunder section 166 of  MV Act, therefore, it is better to dispose of<br \/>\n\tthis appeal without expressing any opinion on merits while directing<br \/>\n\tclaims tribunal to examine application under section 166 of MV Act,<br \/>\n\t1988 and to examine and consider objections raised by insurance<br \/>\n\tcompany in accordance with law with a further direction to claims<br \/>\n\ttribunal not to permit claimant to withdraw application under<br \/>\n\tsection 166 of MV Act and claimant cannot abandon such proceedings.<br \/>\n\tIf this appeal is disposed of without expressingany opinion on<br \/>\n\tmerits with such directions, it would met ends of justice between<br \/>\n\tthe parties.\n<\/p>\n<p>In<br \/>\n\tview of these facts, this appeal is disposed of without expressing<br \/>\n\tany opinion on merits. Appellant insurance company is directed to<br \/>\n\tdeposit entire awarded amount together with costs and interest<br \/>\n\tbefore claims tribunal within one month from the date of receipt of<br \/>\n\tcopy of this order. After realizing amounts from insurance company,<br \/>\n\tclaims tribunal is directed to pay 30% amount to claimant  Hajraben<br \/>\n\tFakira Osmanbhai by way of an account payee cheque drawn in her<br \/>\n\tfavour and  rest of the amount is ordered to be invested in any<br \/>\n\tnationalized bank for a period of three years, to be renewed from<br \/>\n\ttime to time with cumulative interest , in the name of respondent<br \/>\n\tclaimant but FDRs to remain in custody of Nazir of the Claims<br \/>\n\tTribunal concerned and claimant will not be entitled to any interest<br \/>\n\tupon such FDRs till application under section 166 of MV Act, 1988 is<br \/>\n\tdecided by claims tribunal in accordance with law. Claims Tribunal<br \/>\n\tis further directed not to permit withdrawal of application under<br \/>\n\tsec. 166 of MV Act and claimant shall not abandon proceedings of an<br \/>\n\tapplication under sec. 166 of MV Act, 1988 but shall have to get it<br \/>\n\tdecided on merits by claims tribunal and claims tribunal shall<br \/>\n\tdecide such application strictly in accordance with law after<br \/>\n\texamining objections raised by insurance company without being<br \/>\n\tinfluenced by award of claims tribunal under sec. 140 of MV Act, as<br \/>\n\twell as present order passed by this court.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, this appeal is disposed of<br \/>\n\twithout expressing any opinion on merits.\n<\/p>\n<p>Since<br \/>\n\tfirst appeal has been disposed of by this court, no order is<br \/>\n\trequired to be passed on civil application, therefore, civil<br \/>\n\tapplication is also disposed of accordingly.\n<\/p>\n<p>(H.K.\n<\/p>\n<p>Rathod,J.)<\/p>\n<p>Vyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Icici vs Hajraben on 18 March, 2009 Author: H.K.Rathod,&amp;Nbsp;
