Heard the learned counsel for the appellant on<\/p>\n<p>                      the interlocutory application No.1686 of 2001 and I.A.<\/p>\n<p>                      No.1687 of 2001.\n<\/p>\n<p>                                I.A.    No.1686      of    2011    is   a     substitution<\/p>\n<p>                      application. Because of delay in filing this substitution<\/p>\n<p>                      application, a separate limitation application has been<\/p>\n<p>                      filed which has been numbered as I.A. No.1687 of<\/p>\n<p>                      2001.\n<\/p>\n<p>                                The      learned     counsel      for   the     appellant<\/p>\n<p>                      submitted that the appellant No.1, namely, Rajendra<\/p>\n<p>                      Prasad, was doing pairvy in this appeal who was posted<\/p>\n<p>                      as B.D.O. at Rajnagar Block, Madhubani and the<\/p>\n<p>                      appellant No.3 was residing in village Barmain and,<\/p>\n<p>                      therefore, the appellant No.1 had no knowledge about<\/p>\n<p>                      his death.       After his retirement, when he came to<\/p>\n<p>                      village, he learned that appellant No.3 had died and<\/p>\n<p>                      then he filed this substitution application in 2001.<\/p>\n<p>                      Thereafter, the appellant No.1 also died.             According to<\/p>\n<p>                      the learned counsel, the said appellant No.1 retired on<\/p>\n<p>                      30.06.2001.        In   view    of    the    above       facts   and<\/p>\n<p>                      circumstances of the case, the learned counsel for the<\/p>\n<p>                      appellant submitted that the delay, if any, is liable to be<\/p>\n<p>                      condoned.        Although copy has been served on the<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>            learned counsel appearing on behalf of the respondent.<\/p>\n<p>            Nobody appeared to object the prayer made on behalf<\/p>\n<p>            of the appellant.\n<\/p>\n<p>                      In view of the above facts and the explanation<\/p>\n<p>            given in the limitation application, I am satisfied that<\/p>\n<p>            the appellant was prevented by sufficient cause from<\/p>\n<p>            not filing the substitution application within time.<\/p>\n<p>            Accordingly, the interlocutory application No.1687 of<\/p>\n<p>            2001 is allowed, the delay is condoned, abatement is<\/p>\n<p>            set aside and the substitution application, i.e. I.A.<\/p>\n<p>            No.1686 of 2001 is allowed. The legal representatives<\/p>\n<p>            of the deceased appellant No.3 as mentioned in detail in<\/p>\n<p>            paragraph    2    of   the   substitution   application   are<\/p>\n<p>            substituted in place of the appellant No.3. All of them<\/p>\n<p>            have appeared by filing Vakalatnama.<\/p>\n<p>                      Heard the learned counsel for the appellant on<\/p>\n<p>            the interlocutory application No.1688 of 2001.<\/p>\n<p>                      This application has been filed on behalf of the<\/p>\n<p>            appellant for expunging the name of the respondent<\/p>\n<p>            No.6 to 20.
