Justice K.HEMA\n\n Dated :15\/10\/2008\n\n O R D E R\n                               K.HEMA, J.\n                  -------------------------------------------------\n                           B.A.No.6281 of 2008\n                  -------------------------------------------------\n             Dated this the 15th day of October, 2008\n\n\n                                  O R D E R\n<\/pre>\n<p>      This petition is for bail.\n<\/p>\n<p>      2.    The alleged offences are under Sections 143, 147,<\/p>\n<p>148, 341, 324 and 307 read with Section 149 IPC. According to<\/p>\n<p>prosecution, petitioners along with other accused assaulted the<\/p>\n<p>defacto complainant, who was riding a bicycle, and formed<\/p>\n<p>themselves into an unlawful assembly, armed with sword stick,<\/p>\n<p>iron rod etc. and attempted to commit murder.<\/p>\n<p>      3.    Learned counsel for the petitioners submitted that the<\/p>\n<p>petitioners are accused nos. 6, 7, 8 and 10 in the crime. They<\/p>\n<p>are in custody for the past 63, 54, 44 and 25 days respectively.<\/p>\n<p>      4.    Learned public prosecutor submitted this is an<\/p>\n<p>offshoot of a political rivalry and he has no objection in granting<\/p>\n<p>bail to the petitioners, but, stringent conditions may be imposed.<\/p>\n<p>      Hence, bail is granted to the petitioners on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<blockquote><p>       (i)  Petitioners shall execute bond for Rs.25,000\/- each<\/p>\n<p>            with two solvent sureties each for the like sum to the<\/p>\n<p>            satisfaction of the Magistrate Court concerned.<\/p>\n<p><span class=\"hidden_text\">BA No.6281\/08                    2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>      (ii) Petitioners shall report before the Investigating<\/p>\n<p>            Officer on every Monday and Thursday between<\/p>\n<p>            10 a.m. and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote><p>      (iii) Petitioners shall not enter the limits of the police<\/p>\n<p>            station within which the crime is registered except for<\/p>\n<p>            compliance of direction in clause no.(ii).<\/p>\n<\/blockquote>\n<blockquote><p>      (iv) Petitioners shall not intimidate any witness or tamper<\/p>\n<p>            with evidence or commit any offence while on bail<\/p>\n<p>            and in case of breach of this condition, bail is liable to<\/p>\n<p>            be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>\n    The petition is allowed.<\/p><\/blockquote>\n<p>                                                K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court T.V.Maharoof vs State Of Kerala Through The Sub on 15 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6281 of 2008() 1.
