DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/03\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition under Articles 226 and 227 of the Constitution of India read<br \/>\nwith Section 482 of the Code of Criminal Procedure, 1973 is filed by<br \/>\nthe petitioner to quash and set aside Criminal Complaint No.824 of<br \/>\n2007 on the ground that complaints under provisions of Negotiable<br \/>\nInstruments Act shall be filed at two different courts for the same<br \/>\namount of cheque, and therefore, it is a clear abuse of process of<br \/>\nlaw and causes undue harassment to the petitioner.  It is further<br \/>\nsubmitted that for the first vehicle, which was financed by<br \/>\ncomplainant company, two chassis numbers were there and a request was<br \/>\nmade to allot another vehicle and subsequently purchased a new<br \/>\nWaganoR car for which also finance was arranged by respondent No.3.\n<\/p>\n<p>\tIt<br \/>\nis submitted by learned advocate for the petitioner that though<br \/>\ncheques were handed over to the finance company in advance for the<br \/>\npurchase of first vehicle and even for second vehicle no outstanding<br \/>\ndues are there, but the respondent No.3 seized the vehicle, and<br \/>\ntherefore,  the issuance of process by the learned Magistrate<br \/>\ndeserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>\tMr.Yogesh<br \/>\nRavani, learned advocate for the respondent No.3 has placed reliance<br \/>\non the affidavit filed by Manager of the respondent No.3 company and<br \/>\nsubmitted that this petition deserves to be thrown out on the ground<br \/>\nof suppression of material facts inasmuch as a complaint was filed by<br \/>\nthe petitioner for illegal seizure of Maruti Van and robbery of<br \/>\nRs.10,000\/- and after due investigation, the Investigating Authority<br \/>\ncame to the conclusion that the complaint was baseless.  It is<br \/>\nsubmitted that agreement was executed for two cars bearing<br \/>\nregistration Nos.MH-28-C-1261 (Maruti Van) and MH 04 AX 189 (Maruti<br \/>\nWaganoR) and accordingly finance was arranged and cheques were issued<br \/>\ntowards agreed installments.  Upon failure to honour the obligation<br \/>\nto pay legal dues statutory notices were issued and compliance was<br \/>\nreported, and therefore, the criminal complaints were lodged against<br \/>\nthe petitioner.  It is therefore submitted that the defence that is<br \/>\nraised by the petitioner in this case cannot be gone into in exercise<br \/>\nof powers under Section 482 of the Code.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties and on perusal of the record<br \/>\nand order impugned passed by the learned Magistrate by which process<br \/>\nis issued, I am satisfied that agreements in accordance with law were<br \/>\nexecuted by the parties and the above agreements were signed by the<br \/>\npetitioner and the representative of finance company, finance was<br \/>\narranged by respondent No.3 and advance cheques for agreed<br \/>\ninstallments were issued by the petitioner and upon depositing the<br \/>\nsame, cheques were returned, and therefore, following the procedure<br \/>\nas laid down under Section 138 of the Negotiable Instruments Act,<br \/>\nstatutory notice was issued and complaint was filed disclosing<br \/>\ningredients of offence under Section 138 of the Negotiable<br \/>\nInstruments Act.  I do not find any substance in the argument of<br \/>\nlearned advocate for the petitioner.  No case is made out to<br \/>\ninterfere in exercise of powers either under Articles 226 and 227 of<br \/>\nthe Constitution of India and under Section 482 of the Code of<br \/>\nCriminal Procedure.\n<\/p>\n<p>\tThis<br \/>\npetition stands dismissed of accordingly.  However, there shall be no<br \/>\norder as to costs.\n<\/p>\n<p>\tNotice<br \/>\ndischarged.\n<\/p>\n<p>[Anant<br \/>\nS.
