RAMKUMAR, J.\n               .........................................\n                      B.A. No.8274 of 2010\n              ..........................................\n           Dated this the 21st day of December, 2010\n\n                               ORDER\n<\/pre>\n<p>     Petitioner, who is the 1st accused in Crime No.106\/2010 of<\/p>\n<p>Kuttampuzha Police Station for offences punishable under<\/p>\n<p>Sections 452 and 332 I.P.C. and Section 3(2)(e) of the P.D.P.P<\/p>\n<p>Act read with 34 IPC, seeks anticipatory bail.<\/p>\n<p>     2.    The    learned     Public    Prosecutor      opposed   the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated    2-12-2010       of the Apex Court      in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a>     (2010(4) KLT 930),           I am of     the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer      has not had         the advantage of<\/p>\n<p>interrogating the petitioner.        But at the same time,      I am<\/p>\n<p>inclined to permit the petitioner to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p><span class=\"hidden_text\">B.A.No.8274 \/2010              -:2:-<\/span><\/p>\n<p>have his application for bail allowed by the Magistrate or the<\/p>\n<p>Court    having jurisdiction.   Accordingly, the petitioner shall<\/p>\n<p>surrender before the investigating officer on 30.12.2010 or on<\/p>\n<p>31.12.2010 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. In case the investigating officer<\/p>\n<p>is of the view that having regard to the facts of the case arrest<\/p>\n<p>of the petitioner is imperative he shall record his reasons for<\/p>\n<p>the arrest in the case diary as insisted in paragraph 129       of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                 The<\/p>\n<p>petitioner shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.     In case the interrogation of the petitioner is<\/p>\n<p>without arresting him, the petitioner shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned        and apply for<\/p>\n<p>regular bail. The Magistrate or the Court on being satisfied that<\/p>\n<p>the petitioner has been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well, release the petitioner on bail.<\/p>\n<p>      4. In case the petitioner while surrendering before the<\/p>\n<p>Investigating Officer has deprived      the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p><span class=\"hidden_text\">B.A.No.8274 \/2010                   -:3:-<\/span><\/p>\n<p>and submit a report to that effect             to the Magistrate or the<\/p>\n<p>Court concerned. Likewise, the Magistrate or the Court also<\/p>\n<p>will not be bound by the time limit fixed as above if sufficient<\/p>\n<p>time was not available after the production or appearance of<\/p>\n<p>the petitioner.\n<\/p>\n<p>      5.     The release of the          petitioner shall be on the<\/p>\n<p>petitioner executing a bond for `15,000\/- (Rupees                fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like amount<\/p>\n<p>to the satisfaction of the Court concerned and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>             1.    The   petitioner       shall   report before   the<\/p>\n<p>             Investigating Officer between 9 a.m. and 11 a.m. on all<\/p>\n<p>             Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             2.  The petitioner shall make himself      available for<\/p>\n<p>             interrogation including custodial interrogation as and<\/p>\n<p>             when required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>             3.    Petitioner shall not influence or intimidate the<\/p>\n<p>             prosecution witnesses nor shall he attempt to tamper<\/p>\n<p>             with the evidence for the prosecution.<\/p>\n<p><span class=\"hidden_text\">B.A.No.8274 \/2010                    -:4:-<\/span><\/p>\n<\/blockquote>\n<blockquote><p>             4.   Petitioner shall not commit any offence while on<\/p>\n<p>             bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             5.
