Satish  Sharma,\tMinister  of<br \/>\nState for  Petroleum &amp; Natural Gas, exercising the powers of<br \/>\nthe Central  Government, have been challenged in this public<br \/>\ninterest petition  under Article  32 of\t the Constitution of<br \/>\nIndia. The petition as originally filed was directed against<br \/>\ncorruption in  various\tfields\tof  public  life.  Mr.\tH.D.<br \/>\nShourie &#8211;  Director &#8220;Common  Cause&#8221; &#8211;  appearing in  person,<br \/>\ninvited this  Court&#8217;s attention\t to a news item dated August<br \/>\n11, 1995,  on the  front page  of &#8220;Indian Express&#8221; under the<br \/>\ncaption &#8220;In Satish Sharma&#8217;s Reign, Petrol and Patronage Flow<br \/>\nTogether&#8221;. The\tsolicitor general  who was present in Court,<br \/>\ntook notice  of the news item and stated that the would have<br \/>\nthe matter  examined in\t the Ministry  concerned and file an<br \/>\naffidavit giving  Ministry&#8217;s response  to the news item. The<br \/>\nnews item, inter alia, stated as under:-\n<\/p>\n<blockquote><p>     &#8220;Not only\tthe relatives of most of<br \/>\n     the officials  working for\t Captain<br \/>\n     Satish  Sharma  but  even\this  own<br \/>\n     driver  and   the\tdriver\t of  his<br \/>\n     additional Private\t Secretary  have<br \/>\n     been allotted  a petrol  pump and a<br \/>\n     gas agency respectively.<br \/>\n     The  wives\t of  two  clerks  and  a<br \/>\n     stenographer in  the Ministry  have<br \/>\n     similarly\tbeen   allotted\t  petrol<br \/>\n     pumps.  Some  of  these  allotments<br \/>\n     have    been    made    from    the<br \/>\n     discretionary   quota    with   the<br \/>\n     Petroleum\tMinister   while  others<br \/>\n     have   been    made   through    an<br \/>\n     ostensibly\t  objective    selection<br \/>\n     process  undertaken   by  the   Oil<br \/>\n     Selection\t    Boards\t (OSBs).<br \/>\n     &#8230;&#8230;&#8230;.A Mr  Poda  Rajshekar,  a<br \/>\n     relative  of   Mr.\t G.  Gurusharan,<br \/>\n     Private Secretary to Captain Sharma<br \/>\n     has been  allotted a petrol pump at<br \/>\n     Banjara Hills, Hyderabad out of the<br \/>\n     Minister&#8217;s\t  discretionary\t   quota<br \/>\n     taking  pity   on\tthe   &#8220;financial<br \/>\n     circumstances that the family finds<br \/>\n     itself in.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     Ms Madhuri\t Safaya, a  relation  of<br \/>\n     the Additional Private Secretary to<br \/>\n     the Minister,  Mr. V.N.  Safaya has<br \/>\n     been allotted  a  petrol  pump  &#8220;on<br \/>\n     compassionate  grounds&#8221;   from  the<br \/>\n     discretionary quota.\n<\/p><\/blockquote>\n<blockquote><p>     Another  relation\tof  Mr.\t Safaya,<br \/>\n     Mrs. Monica  Malla, has also been a<br \/>\n     beneficiary  of   a  petrol   pump,<br \/>\n     courtesy Captain Sharma.<br \/>\n     Mrs Daya  Rani, wife of Mr Hari Ram<br \/>\n     Verma, personal  assistant\t to  the<br \/>\n     Additional PS  to the  Minister, Mr<br \/>\n     V.N. Safaya,  was allotted a petrol<br \/>\n     pump out of the discretionary quota<br \/>\n     &#8230;&#8230;..Mrs Vijaya\t Nair,\twife  of<br \/>\n     Mr, D.V. Pillai, another additional<br \/>\n     Private Secretary to Captain Sharma<br \/>\n     has been  allotted a petrol pump on<br \/>\n     the grounds  that the &#8220;applicant is<br \/>\n     a young unemployed [woman] with the<br \/>\n     responsibility of\tlooking after  a<br \/>\n     large family&#8221;  &#8211;  hardly  a  unique<br \/>\n     classification in\tthis country  of<br \/>\n     900 million. &#8230;&#8230;.The Chairman of<br \/>\n     the  OSB\tfor  Uttar   Pradesh  is<br \/>\n     Justice  S.H.   Abidi  (retd.)  who<br \/>\n     lives at  50, Dariyabad, Allahabad.<br \/>\n     It so  happens  that  Syed\t Shaukat<br \/>\n     Hasan Abidi,  his\tson,  living  at<br \/>\n     50\/1, Daryabad,  Allahabad put in a<br \/>\n     request and  was allotted\ta petrol<br \/>\n     pump on  &#8220;compassionate grounds&#8221; at<br \/>\n     Fatehpur  (80  Km\tMile  Stone)  in<br \/>\n     Uttar Pradesh.\n<\/p><\/blockquote>\n<blockquote><p>     A former  MLA, Mr Shiv Balak Passi,<br \/>\n     from Rae  Bareli is a member of the<br \/>\n     OSB for  Madhya Pradesh and his job<br \/>\n     is to allot petrol pumps to others.<br \/>\n     He too had put in a request for the<br \/>\n     discretionary  allotment\tof   the<br \/>\n     petrol  pump.  Lo\tand  behold,  on<br \/>\n     &#8220;compassionate  grounds&#8221;\the   was<br \/>\n     immediately allotted  a petrol pump<br \/>\n     on the  Rae Bareli-Lucknow\t Road in<br \/>\n     UP.\n<\/p><\/blockquote>\n<blockquote><p>     Mr.  Krishna  Swaroop,  a\tCongress<br \/>\n     party worker  and resident of 18\/7,<br \/>\n     Punjabi Bagh  Extension, New Delhi-<br \/>\n     26 is a member of the OSB for Delhi<br \/>\n     and chandigarh. His son, Mr Pradeep<br \/>\n     Kumar, was\t favoured with\ta petrol<br \/>\n     pump by the Minister on the grounds<br \/>\n     that &#8220;the\tapplicant is a young man<br \/>\n     from Scheduled Caste Community with<br \/>\n     no source\tof regular  income.  The<br \/>\n     case      deserves\t     sympathetic<br \/>\n     consideration. Therefore,\ta retail<br \/>\n     Outlet  for  MS-HSD  in  the  Union<br \/>\n     Territory of  Delhi is  allotted to<br \/>\n     Shri  Pradeep   Kumar,  r\/o   18\/7,<br \/>\n     Punjabi Bagh  Extension, New Delhi-<br \/>\n     110026.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     Mr. Ghulam\t Ahmed\tMir  is\t also  a<br \/>\n     member of\tthe OSB\t for  Delhi  and<br \/>\n     Chandigarh. An application was made<br \/>\n     by\t him  for  the\tallotment  of  a<br \/>\n     petrol  pump.   And  the\tMinister<br \/>\n     passed the\t order on &#8220;compassionate<br \/>\n     grounds&#8221;  from   his  discretionary<br \/>\n     quota.\n<\/p><\/blockquote>\n<blockquote><p>     Similarly\t the\tfollowing    OSB<br \/>\n     members, either themselves or their<br \/>\n     next of  kin,  have  been\tallotted<br \/>\n     petrol  pumps   :\tMr  K.L.  Sharma<br \/>\n     (Member OSB,  West Bengal), Mr R.S.<br \/>\n     Nautiyal (Member  OSB, Punjab), and<br \/>\n     Mr Harbanslal  Gupta  (member  OSB,<br \/>\n     Haryana). Two relation of Mrs Satya<br \/>\n     Bahen (Member  OSB,  Haryana)  were<br \/>\n     allotted a gas agency in Etah and a<br \/>\n     petrol  pump   at\t Itmadpur   near<br \/>\n     Tundla, respectively.<br \/>\n     The son  of a  former Home Minister<br \/>\n     who   is\t currently   a\t Cabinet<br \/>\n     Minister;\tthe  son  of  a\t present<br \/>\n     Minister of  State from  the North-<br \/>\n     East;  the\t  brother-in-law  of   a<br \/>\n     former Janata Dal office-bearer and<br \/>\n     now a  Congressman from Eastern UP;<br \/>\n     the son  of a  Dalit leader who was<br \/>\n     with the  late H.N. Bahuguna at one<br \/>\n     time and  is now  in the  Congress;<\/p><\/blockquote>\n<blockquote><p>     the   son\t  of   former\tCongress<br \/>\n     Councillor\t  of\tthe    Municipal<br \/>\n     Corporation of  Delhi; the\t wife of<br \/>\n     an\t ex-Congress   MP  from\t the  UP<br \/>\n     hills;  the  wife\tof  a  prominent<br \/>\n     Dalit leader  in the Opposition and<br \/>\n     several political hacks from Amethi<br \/>\n     are among\tthe  hundreds  who  have<br \/>\n     been gifted  petrol  pumps\t or  gas<br \/>\n     agencies  during\tthe  tenure   of<br \/>\n     Captain  Satish   Sharma\tas   the<br \/>\n     Petroleum Minister.&#8221;<\/p><\/blockquote>\n<p>     Mr. Vijay\tL. Kelkar,  Secretary  in  the\tMinistry  of<br \/>\nPetroleum  and\tNatural\t Gas,  government  of  India,  filed<br \/>\naffidavit dated\t October 9,  1995. The\trelevant part of the<br \/>\naffidavit is as under:-\n<\/p>\n<blockquote><p>     &#8220;It may  be relevant  to point  out<br \/>\n     here  that\t  under\t  the\tapproved<br \/>\n     Guidelines,  the  Hon&#8217;ble\tMinister<br \/>\n     personally decides\t each  case  and<br \/>\n     the order\tis a  speaking order. An<br \/>\n     unsuccessful applicant  in the same<br \/>\n     category is entitled to have a copy<br \/>\n     of the  order if  a request is made<br \/>\n     for it.\n<\/p><\/blockquote>\n<blockquote><p>     The specific  instances referred to<br \/>\n     in\t the  Indian  Express  newspaper<br \/>\n     dated 11th\t August, 1995, appear to<br \/>\n     relate to\tallotments made prior to<br \/>\n     the order\tof  this  Hon&#8217;ble  Court<br \/>\n     dated 31st\t March,\t 1995.\tHowever,<br \/>\n     those allotments  also were made on<br \/>\n     merits of\teach case  as  appearing<br \/>\n     from   the\t   applications\t   which<br \/>\n     contained the  circumstances  under<br \/>\n     which the request was made. For the<br \/>\n     cases mentioned  in  the  newspaper<br \/>\n     report,  it   is  denied  that  the<br \/>\n     allotments were  made on account of<br \/>\n     alleged  relationship   and\/or  any<br \/>\n     improper motive.  The  relationship<br \/>\n     of a applicant with any official of<br \/>\n     the  Ministry   has  not\tbeen   a<br \/>\n     relevant  factor  in    considering<br \/>\n     discretionary     allotment      on<br \/>\n     compassionate grounds.  Should this<br \/>\n     Hon&#8217;ble Court  direct, the relevant<br \/>\n     files shall be produced for perusal<br \/>\n     for this Hon&#8217;ble Court.&#8221;<\/p><\/blockquote>\n<p>     This Court\t examined the  affidavit of  Mr.  Kelkar  on<br \/>\nOctober 13, 1995 and passed the following order:-\n<\/p>\n<blockquote><p>     &#8220;Mr. Vijay\t L. Kelkar, Secretary in<br \/>\n     the  Ministry   of\t Petroleum   and<br \/>\n     Natural Gas,  Government  of  India<br \/>\n     has filed\tan affidavit pursuant to<br \/>\n     this Court&#8217;s order dated August 11,<br \/>\n     1995.  Without  commenting\t on  the<br \/>\n     affidavit, we  direct the\tMinistry<br \/>\n     of Petroleum  and\tNatural\t Gas  to<br \/>\n     file a further and better affidavit<br \/>\n     within two\t weeks with reference to<br \/>\n     the specific instances.&#8221;<\/p><\/blockquote>\n<p>     Pursuant to  the above  quoted order  Mr. Kelkar  filed<br \/>\naffidavit dated\t October 28,  1995. The relevant part of the<br \/>\naffidavit is as under:-\n<\/p>\n<blockquote><p>     &#8220;That the\tDeponent, in  compliance<br \/>\n     with  the\tsaid  order  dated  13th<br \/>\n     October, 1995,  has ascertained the<br \/>\n     position regarding\t the allegations<br \/>\n     that    allottees\t   under     the<br \/>\n     discretionary quota  are related to<br \/>\n     various\t political\tleaders,<br \/>\n     officials\tand   members\tof   Oil<br \/>\n     Selection\tBoards\t (OSBs)\t or  the<br \/>\n     members themselves.  Such allottees<br \/>\n     can   be\t grouped   under   three<br \/>\n     different categories and allegation<br \/>\n     regarding\teach   one  of\tthem  is<br \/>\n     answered  and\/or\tdealt  with   as<br \/>\n     follows:\n<\/p><\/blockquote>\n<blockquote><p>     A ALLOTTEES  SAID TO  BE RELATED TO<br \/>\n     POLITICIANS\n<\/p><\/blockquote>\n<blockquote><p>     (i)   With\t   reference   to    the<br \/>\n     allegation that the son of a former<br \/>\n     Home Minister,  who is  currently a<br \/>\n     Cabinet Minister, has been allotted<br \/>\n     a Petrol  Pump,&#8230;.. It  is correct<br \/>\n     that  the\tallottee,  Shri\t Sarbjot<br \/>\n     Singh is  the son\tof the said Shri<br \/>\n     Buta Singh.\n<\/p><\/blockquote>\n<blockquote><p>     (ii)   with    reference\tto   the<br \/>\n     allegation\t that\tthe  son   of  a<br \/>\n     present  Minister\t of  State  from<br \/>\n     North-East,  has  been  allotted  a<br \/>\n     petrol  pump.  &#8230;..It  is\t correct<br \/>\n     that the  said allottee  is the son<br \/>\n     of\t a  Minister,  namely,\tShri  K.<br \/>\n     Hollahan, in  the State  Government<br \/>\n     of Nagaland.\n<\/p><\/blockquote>\n<blockquote><p>     B. ALLOTTEES  SAID TO BE RELATED TO<br \/>\n     THE MEMBERS  OF OSBs OR THE MEMBERS<br \/>\n     THEMSELVES.\n<\/p><\/blockquote>\n<blockquote><p>     (i)   With\t   reference   to    the<br \/>\n     allegation that  Shri Syed\t Shaukat<br \/>\n     Hasan Abidi  is the  son of Justice<br \/>\n     S.H.  Abidi  (retd.),  who\t is  the<br \/>\n     Chairman  of   the\t OSB  for  Uttar<br \/>\n     Pradesh,&#8230;&#8230;.\t   Discretionary<br \/>\n     allotment was made in favour of the<br \/>\n     applicant in  January, 1995.  It is<br \/>\n     correct that  the said  allottee is<br \/>\n     the son of the said Chairman of OSB<br \/>\n     for U.P.\n<\/p><\/blockquote>\n<blockquote><p>     (ii)   With    reference\tto   the<br \/>\n     allegation\t that  Shri  Shiv  Balak<br \/>\n     Passi is  a member\t of the\t OSB for<br \/>\n     Madhya Pradesh and he is himself an<br \/>\n     allottee from  discretionary quota,<br \/>\n     &#8230;&#8230;&#8230;.\t    A\t   discretionary<br \/>\n     allotment\twas  sanctioned\t in  his<br \/>\n     favour in\tDecember.  1994.  It  is<br \/>\n     correct that Shri Passi is a Member<br \/>\n     of the OSB for Madhya Pradesh.\n<\/p><\/blockquote>\n<blockquote><p>     (iii)   With   reference\tto   the<br \/>\n     allegation that  the allottee, Shri<br \/>\n     Pradeep Kumar,  is the  son of Shri<br \/>\n     Krishna Swaroop  who is a Member of<br \/>\n     OSB  for\tDelhi  and   Chandigarh,<br \/>\n     &#8230;&#8230;  It\t  is  correct  that  the<br \/>\n     allottee is  the son  of  the  said<br \/>\n     Shri Krishna Swaroop.\n<\/p><\/blockquote>\n<blockquote><p>     (iv)   With    reference\tto   the<br \/>\n     allegation that  the allottee, Shri<br \/>\n     Ghulam Ahmad Mir is a Member of OSB<br \/>\n     for Delhi\tand Chandigarh,&#8230;..  It<br \/>\n     is correct\t that Shri Mir is Member<br \/>\n     of the OSB, Delhi.\n<\/p><\/blockquote>\n<blockquote><p>     (v)   With\t   reference   to    the<br \/>\n     allegation that Shri R.S. Nautiyal,<br \/>\n     who is a Member of OSB, Punjab, has<br \/>\n     been allotted  a Petrol Pump either<br \/>\n     in his  own name  or in the name of<br \/>\n     his next  of kin, it is stated that<br \/>\n     Smt.   Nena   Nautiyal,   made   an<br \/>\n     application in  August, 1994, &#8230;..<br \/>\n     It\t is   correct  that   Smt.  Nena<br \/>\n     Nautiyal is  the wife  of Shri R.S.<br \/>\n     Nautiyal, a Member of OSB, Punjab.\n<\/p><\/blockquote>\n<blockquote><p>     (vi)   With    reference\tto   the<br \/>\n     allegation that  a Petrol\tPump was<br \/>\n     allotted to Shri Justice Harbanslal<br \/>\n     Gupta, a Member of OSB, Haryana, in<br \/>\n     his own  name or in the name of his<br \/>\n     next of  kin, it is stated that one<br \/>\n     Shri  Arun\t  K.   Gupta   made   an<br \/>\n     application  in   September,  1993,<br \/>\n     &#8230;&#8230;. It\t is  correct  that  Shri<br \/>\n     Arun Kumar Gupta is the son of Shri<br \/>\n     Justice  Harbanslal  Gupta\t (Retd.)<br \/>\n     who is  the Chairman  of  the  OSB,<br \/>\n     Haryana.\n<\/p><\/blockquote>\n<blockquote><p>     (viii)  With   reference\tto   the<br \/>\n     allegation that  two  relations  of<br \/>\n     Smt. Satya\t Bahin, a  Member of the<br \/>\n     OSB for  Haryana, were  allotted  a<br \/>\n     Gas Agency and a Petrol Pump, it is<br \/>\n     stated that one Shri Dharmesh Kumar<br \/>\n     made an  application In  September,<br \/>\n     1994,&#8230;..\t   Along     with    his<br \/>\n     application     there     was     a<br \/>\n     recommendation  for   discretionary<br \/>\n     allotment from Smt. Satya Bahin, Ex<br \/>\n     Member  of\t Parliament&#8230;..  It  is<br \/>\n     stated  that  the\trelationship  of<br \/>\n     Shri Dharmesh Kumar with Smt. Satya<br \/>\n     Bahin is not known.\n<\/p><\/blockquote>\n<blockquote><p>     C. ALLOTTEES  WHO ARE  SAID  TO  BE<br \/>\n     RELATED TO VARIOUS OFFICIALS IN THE<br \/>\n     MINISTRY.\n<\/p><\/blockquote>\n<blockquote><p>     (i)   The\t  allegation   is   that<br \/>\n     relatives of  the\tDrivers\t of  the<br \/>\n     Minister  and   of\t the  Additional<br \/>\n     Private Secretary\tto the\tMinister<br \/>\n     have been\tallotted Petrol Pump and<br \/>\n     Gas Agency.  It has been found that<br \/>\n     one Smt.  Leela Devi,  wife of late<br \/>\n     Shri   Kishan   Swaroop   made   an<br \/>\n     application that  her  husband  was<br \/>\n     brutally murdered on 25.1.1994, she<br \/>\n     had no  means of  income to support<br \/>\n     her family and that she belonged to<br \/>\n     a Scheduled  Caste. A retail outlet<br \/>\n     was allotted  to Smt. Leela Devi on<br \/>\n     compassionate  grounds   from   the<br \/>\n     discretionary quota  in may,  1995.<br \/>\n     It has  now been  ascertained  that<br \/>\n     Smt. Leela\t Devi happens  to  be  a<br \/>\n     relative  of   a  Driver\tof   the<br \/>\n     Minister.\n<\/p><\/blockquote>\n<pre>     (ii)   With    reference\tto   the\n     allegation\t   that\t    Shri    Poda\n<\/pre>\n<blockquote><p>     Rajasekhar is a relative of Shri G.<br \/>\n     Gurucharan,  Private  Secretary  to<br \/>\n     the Minister of State, it is stated<br \/>\n     that an  application  was\tmade  by<br \/>\n     Shri Rajasekhar  in July, 1993,&#8230;.<br \/>\n     A Retail  Outlet Dealership for MS-<br \/>\n     HSD at  Secunderabad was sanctioned<br \/>\n     to Shri Rajasekhar on compassionate<br \/>\n     grounds. It  has  been  ascertained<br \/>\n     that  the\t said  allottee\t  is   a<br \/>\n     relative\tof    the   said    Shri<br \/>\n     Gurucharan.\n<\/p><\/blockquote>\n<blockquote><p>     (iii)   With   reference\tto   the<br \/>\n     allegation that  Ms. Madhuri Safaya<br \/>\n     is a  relative of Shri B.N. Safaya,<br \/>\n     Additional Private Secretary to the<br \/>\n     Minister, to  whom a  Retail Outlet<br \/>\n     has been allotted,&#8230;.. It has been<br \/>\n     ascertained that  she is related to<br \/>\n     the said Shri B.N. Safaya.\n<\/p><\/blockquote>\n<blockquote><p>     (iv)   With    reference\tto   the<br \/>\n     allegation that Ms. Monica Malla is<br \/>\n     also related  to Shri  B.N. Safaya,<br \/>\n     &#8230;&#8230; A Retail Outlet was allotted<br \/>\n     to her  in November,  1994\t out  of<br \/>\n     discretionary quota.  It  has  been<br \/>\n     ascertained that the said Ms. Malla<br \/>\n     is related to the wife of Shri B.N.<br \/>\n     Safaya.\n<\/p><\/blockquote>\n<blockquote><p>     (v)   With\t   reference   to    the<br \/>\n     allegation that  the allottee, Mrs.<br \/>\n     Daya Rani, is the wife of Shri H.R.<br \/>\n     Verma, Personal  Assistant\t to  the<br \/>\n     Additional Private Secretary to the<br \/>\n     Minister, Shri B.N. Safaya,&#8230;.. It<br \/>\n     is correct that the allottee is the<br \/>\n     wife of Shri H.R. Verma.\n<\/p><\/blockquote>\n<blockquote><p>     (vi)   With    reference\tto   the<br \/>\n     allegation that  Mrs. Vijaya  Nair,<br \/>\n     who has  been sanctioned  a  Retail<br \/>\n     Outlet, is\t the wife  of Shri  D.V.<br \/>\n     Pillai,\t Additional\t Private<br \/>\n     Secretary\tto   the   Minister   of<br \/>\n     State,&#8230;. It  has been ascertained<br \/>\n     that Mrs.\tVijaya Nair  is not  the<br \/>\n     wife of  Shri D.V.\t Pillai, but she<br \/>\n     is related to him&#8221;.<\/p><\/blockquote>\n<p>     This  Court   issued  notice  to  all  the\t 15  persons<br \/>\nmentioned in  the affidavit  of Mr. Kelkar. Thirteen, out of<br \/>\nthem filed  affidavits justifying  the allotments  of petrol<br \/>\npumps made to them by Capt, Satish Sharma.\n<\/p>\n<p>     This Court by the order dated December 6, 1995 directed<br \/>\nthat &#8220;the  minister may, if he so desires, file an affidavit<br \/>\nin this\t regard&#8221;. Capt.\t Satish\t Sharma\t has,  however,\t not<br \/>\nchosen to file any affidavit.\n<\/p>\n<p>     The relevant records have been produced before us.<br \/>\n     Mr. Sarbjot  Singh in his application mentioned that he<br \/>\nwas a  commerce graduate  belonging to\tthe scheduled  caste<br \/>\ncommunity. He  completed graduation in the year 1991. He was<br \/>\ninterested in  sports  (shooting)  and\twon  awards  at\t the<br \/>\nnational level.\t Because  of  his  pre-occupation  with\t the<br \/>\nsports, he  had average academic record and as a consequence<br \/>\ncould not  get admission  to any  professional\tcourses.  He<br \/>\nfurther stated\tthat in\t spite of  his best efforts he could<br \/>\nnot get\t any suitable  employment for supporting himself and<br \/>\nas such\t a petrol pump in Delhi be allotted to him. The file<br \/>\ndoes not indicate how the application was entertained. There<br \/>\nis no  receipt\/entry on the application. No official\/officer<br \/>\nhas examined  the application  before the  Minister&#8217;s order.<br \/>\nThere is  nothing to shown that any guide-lines were kept in<br \/>\nview. The  application, obviously,  was given by hand to the<br \/>\nMinister, who readily passed the allotment order. There is a<br \/>\nseparate sheet containing the order of the Minister which is<br \/>\nas under:-\n<\/p>\n<blockquote><p>     &#8220;Office of the Minister of State<br \/>\n\t\t (P&amp;NG)<br \/>\n     Placed below  is an  application of<br \/>\n     Shri Sarbjot Singh for allotment of<br \/>\n     a Retail  Outlet dealership for MS-<br \/>\n     HSD. The  applicant has stated that<br \/>\n     he\t is   a\t graduate   without  any<br \/>\n     suitable employment<br \/>\n     Submitted for kind orders.<br \/>\n\t\t\t Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t\t    (G. No one took notice of this fact<br \/>\nand the allotment order was issued.\n<\/p>\n<p>     In all  the cases\tdiscussed hereinafter the pattern of<br \/>\nallotment and the method and procedure followed was the same<br \/>\nas in Sarbjot Singh&#8217;s case.\n<\/p>\n<p>     Benjamin K.  Hollohon stated in his application that he<br \/>\nwas an\teducated unemployed  youth  and\t also  active  party<br \/>\nworker in  the area.  He belonged  to scheduled\t tribe\tfrom<br \/>\nNagaland  State.   He  requested   in  the  application\t for<br \/>\nallotment of  petrol pump  in Purana  Bazar area  of Dimapur<br \/>\ntown, Nagaland.\t The application  was sent to Captain Satish<br \/>\nSharma by  Mr. K. Hollohon, Minister, Industry and Commerce,<br \/>\nNagaland (Father  of the applicant) along with a d.o. letter<br \/>\nwhich reads as under:-\n<\/p>\n<blockquote><p>     &#8220;Me dear Capt. satish Sharma,<br \/>\n     Kindly recall  our\t discussions  of<br \/>\n     date  regarding  allotment\t of  one<br \/>\n     retail outlet petrol pump (petrol &amp;<br \/>\n     Diesel) in the Purana Bazar area of<br \/>\n     Dimapur town  in Nagaland in favour<br \/>\n     of my son Benjamin K. Satish Sharma)<br \/>\n\t       Minister of State&#8221;<\/p><\/blockquote>\n<p>     Mr. Kelkar&#8217;s  affidavit shows  that  Shiv\tBalak  Passi<br \/>\nhimself is  a member  of the  Oil Selection Board for Madhya<br \/>\nPradesh.\n<\/p>\n<p>     Pradeep Kumar, in his application stated that he was an<br \/>\nunemployed young  man from  Scheduled  Caste  category\twith<br \/>\nenterprise, initiative\tand determination  and was very keen<br \/>\nto make petrol pump dealership as his business. He indicated<br \/>\nthat he was appearing in B.A (final). He further stated that<br \/>\nhis father has been an active congress worker since 1952 and<br \/>\nhas held  many important  positions in\tthe organisation  as<br \/>\nwell as\t on the executive side. Satish Sharma)<br \/>\n\t\t Minister of State&#8221;<\/p><\/blockquote>\n<p>     While processing  the order,  noting on  the file is as<br \/>\nunder:-\n<\/p>\n<blockquote><p>     &#8220;Reference notes  on pre-page.  MOS<br \/>\n     has  sanctioned   a  retail  outlet<br \/>\n     dealership\t    at\t    Delhi     on<br \/>\n     compassionate   grounds   to   Shri<br \/>\n     Pradeep Kumar  who is  belonging to<br \/>\n     SC category.  He has  stated in his<br \/>\n     application vide  p-1\/c that  he is<br \/>\n     appearing in  BA final  year. He is<br \/>\n     son of  Shri Krishna Swaroop member<br \/>\n     of OSB,  Delhi. The  allowances and<br \/>\n     perks of  the Member  of OSB exceed<br \/>\n     Rs. 5000\/- per month.\n<\/p><\/blockquote>\n<blockquote><p>     2.\t However,   in\t view\tof   the<br \/>\n     sanction by  MOS, file  is\t put  up<br \/>\n     with a  fair  sanction  letter  for<br \/>\n     signature, if approved.<br \/>\n\t\t\t Sd\/-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">\t\t\t 27\/6<\/span><\/p>\n<blockquote><p>     Allotment of  a dealership\t to  the<br \/>\n     son of  a sitting Member of the OSB<br \/>\n     will invite  adverse criticism.  It<br \/>\n     will  also\t  create  an   avoidable<br \/>\n     impression\t   that\t    govt.     is<br \/>\n     influencing the OSB in this manner.<br \/>\n\t\t\t   sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t 27.6.94&#8243;<\/p><\/blockquote>\n<p>     Mr. Kelkar&#8217;s affidavit shows that Shri Pradeep Kumar is<br \/>\nthe son of Shri Krishan Swaroop, who was at that time member<br \/>\nof Oil\tSelection Board\t for Delhi  and Chandigarh.  Pradeep<br \/>\nKumar in his application did not mention this fact. The file<br \/>\nindicates that\tdespite the  noting to\tthe effect  that the<br \/>\nallotment would\t invite\t adverse  criticism,  the  allotment<br \/>\norders were issued.\n<\/p>\n<p>     Mr. Ghulam\t Ahamd Mir  in his application, addressed to<br \/>\nthe Minister, stated that due to the escalation of extremist<br \/>\nviolence in  Kashmir   Valley in  the recent  years, it\t has<br \/>\nbecome difficult  to lead a normal life in the Valley and as<br \/>\nsuch earning  a livelihood  has become\tvery  difficult.  He<br \/>\nfurther stated that the family was forced to sell some of he<br \/>\nancestral property.  He added  that despite being a Graduate<br \/>\nhe could  not get  regular employment. He also stated in the<br \/>\napplication that he was an active social worker and had been<br \/>\npromoting the  nationalist cause  in the Valley due to which<br \/>\nhe and his family have been facing constant threats from the<br \/>\nmilitants and  extremists in the Valley. The Minister passed<br \/>\nthe following order on the applications:\n<\/p>\n<blockquote><p>     &#8220;Office of the Minster<br \/>\n     of State for (P&amp;NG)<br \/>\n     Placed below  is an  application of<br \/>\n     Shri Ghulam Ahamd Min for allotment<br \/>\n     of a  Retail Outlet for MS-HSD. The<br \/>\n     applicant\thas  not  been\table  to<br \/>\n     obtain any\t suitable employment  in<br \/>\n     Delhi and\tis finding  it difficult<br \/>\n     to support\t his immediate family in<br \/>\n     Delhi and his parents in Jammu. The<br \/>\n     case      deserves\t     sympathetic<br \/>\n     consideration.  Therefore\t an  `A&#8217;<br \/>\n     site Retail  Outlet for  MS-HSD  in<br \/>\n     the Union\tTerritory  of  Delhi  is<br \/>\n     allotted to  Shri Ghulam  Ahmad Mir<br \/>\n     s\/o Haji  Gh. Hassan  Mir r\/o 71-D,<br \/>\n     Pocket `K&#8217;,  Sheikh Sarai\tII,  New<br \/>\n     Delhi.\n<\/p><\/blockquote>\n<blockquote><p>     Orders may be issued accordingly.<br \/>\n\t\t\t Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t       (Capt. He\thad six\t  sons and a house on Kalibari Marg.<br \/>\nLate husband  of Leela\tDevi was living away from the family<br \/>\nfor 7-8\t years\tprior  to  his\tdeath.\tMr.  Kelkar  in\t his<br \/>\naffidavit has  stated that Leela Devi is the relative of the<br \/>\ndriver of  the Minister.  The affidavit\t filed by Leela Devi<br \/>\nand the\t documents attached  with the  affidavit  read\twith<br \/>\nKelkar&#8217;s affidavit  clearly show  that\tLeela  Devi  is\t the<br \/>\nmother of  Nand Kishor\twho was\t working as  driver of Capt.<br \/>\nSatish Sharma.\tMr. Kelkar  in his affidavit has stated that<br \/>\n&#8220;Smt. Leela  Devi happens  to be a relative of the driver of<br \/>\nthe Minister&#8221;.\tLeast we  can say  is that Mr. Kelkar should<br \/>\nhave known that Leela Devi was Minister&#8217;s drivers&#8217;s mother.\n<\/p>\n<p>     Poda Rajasekhar has, in his application, stated that he<br \/>\ncompleted his B.Com in 1980 and in spite of his best efforts<br \/>\nhe could  not settle  in regular  employment. His father was<br \/>\nserving as  an Inspector  of Customs  and Central Excise. He<br \/>\nexpired in  January 1981.  His mother,\twho was\t a  teacher,<br \/>\nretired on 19.4.1993. He finds it difficult to cope with the<br \/>\npresent circumstances. She  is a  young lady and has been<br \/>\nrendered homeless  due to  the increasing  militancy in\t the<br \/>\nValley. Due  to sudden\tmigration to  Delhi she has not been<br \/>\nable  to  complete  her\t education. The<br \/>\n     applicant\thas  not  been\table  to<br \/>\n     obtain a  suitable job  for herself<br \/>\n     and is  without any  regular source<br \/>\n     of\t income. She has to support her<br \/>\nparents who  are not  keeping good  health. It was difficult to live with the meagre salary of<br \/>\nher husband.  She wanted  to share the responsibility of her<br \/>\nhusband and  as such  requested the  Minister to allot her a<br \/>\npetrol\tpump. Therefore,\ta Retail<br \/>\n     Outlet in\tthe Union  Territory  of<br \/>\n     Delhi is allotted to Smt. Daya Rani<br \/>\n     w\/o Shri  H.R.  Ramakrishna  Ashram<br \/>\n     Marg, Gole Market, New Delhi.<br \/>\n     Orders may be issued accordingly.<br \/>\n\t\t\t Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t       (Capt. Satish Sharma)<br \/>\n\t\tMinister of State&#8221;<\/p><\/blockquote>\n<p>     Shri S.K.\tSingh, Under Secretary, while processing the<br \/>\nMinister&#8217;s order noted on the file as under:\n<\/p>\n<blockquote><p>     &#8220;Smt. Daya\t Rani, the  allottee  is<br \/>\n     the wife of Shri Hari Ram Verma who<br \/>\n     is working\t in this  Ministry as an<br \/>\n     Assistant and  presently posted  to<br \/>\n     Minister&#8217;s\t  Office.   His\t  annual<br \/>\n     income  from   pay\t and  allowances<br \/>\n     during  1993-94   is  reported  Rs.<br \/>\n     52,925\/-. However, the allottee has<br \/>\n     shown   the    annual   income   as<br \/>\n     Rs.36,000\/- which\tis factually not<br \/>\n     correct.  It  seems  that\tshe  has<br \/>\n     shown only\t the take-home pay after<br \/>\n     deductions. It is for consideration<br \/>\n     whether the  sanction letter placed<br \/>\n     below as per Orders of MOS recorded<br \/>\n     at p-1\/n may be issued<br \/>\n\t\t\t      Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t (S.K. SINGH)<br \/>\n\t\t    US (M.II)\/25.10.94&#8243;<\/p><\/blockquote>\n<p>     Allotment\torder  was  issued  to\tDaya  Rani  on\t31st<br \/>\nOctober, 1994.\tMr. Kelkar  has stated in his affidavit that<br \/>\nDaya Rani  is the  wife of H.R. Verma, Personal Assistant to<br \/>\nthe Add1. Private Secretary (B.N. Safaya) to the Minister.\n<\/p>\n<p>     Vijaya Nair has stated in her application that she is a<br \/>\nyoung housewife\t with a\t large family  to support.  She\t has<br \/>\nstudied up  to B.A.  level. The meagre income of her husband<br \/>\ncould not  sustain  their  liabilities.\t She  requested\t the<br \/>\nMinister to  allot her\ta petrol  pump which was done by the<br \/>\nfollowing order:\n<\/p>\n<blockquote><p>     &#8220;Office of the Minister<br \/>\n     of State (P&amp;NG)<br \/>\n     Placed below  is the application of<br \/>\n     Smt. Vijaya  Nair. The applicant is<br \/>\n     a young  educated unemployed person<br \/>\n     with the  responsibility of looking<br \/>\n     after a  family which  has a meagre<br \/>\n     income. The  applicant  has  stated<br \/>\n     that despite  best efforts\t she has<br \/>\n     been unable to obtain suitable job.<br \/>\n     She has,  therefore requested  that<br \/>\n     as\t a   special  case  she\t may  be<br \/>\n     allotted a\t Retail Outlet MS-HSD in<br \/>\n     the Union Territory of Delhi.<br \/>\n     For kind orders.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t\t    (G. Gurucharan)<br \/>\n\t\t    PS to MOS (P&amp;NG)<br \/>\n\t\t\t 23.7.93<br \/>\n     Minister<br \/>\n     I\thave  examined\tthe  application<br \/>\n     carefully.\t The   applicant  is  an<br \/>\n     educated unemployed housewife whose<br \/>\n     family  circumstance   is\tone   of<br \/>\n     considerable financial  difficulty.<br \/>\n     The applicant  has also prayed that<br \/>\n     she has  the  necessary  drive  and<br \/>\n     initiative to  run a Retail Outlet.<br \/>\n     This is a fit case to be considered<br \/>\n     sympathetically.\tAccordingly,   a<br \/>\n     Retail   Outlet   for   MS-HSD   is<br \/>\n     allotted to Smt. Vijaya Nair, 2213,<br \/>\n     Lodi Road\tComplex,  New  Delhi-110<br \/>\n     003,  in  the  Union  Territory  of<br \/>\n     Delhi as  a special case.<br \/>\n     Orders may be issued accordingly.<br \/>\n\t\t\t Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>\t       (Capt. Satish Sharma)<br \/>\n\t       Minister of  State&#8221;<\/p><\/blockquote>\n<p>     Mr. Kelkar has stated in his affidavit that Vijaya Nair<br \/>\nis related  to\tD.V.  Pillai,  Add1.  Private  Secretary  to<br \/>\nMinister.\n<\/p>\n<p>     All the  15 allotments  &#8211; discussed  above &#8211;  have been<br \/>\nmade  by   the\tMinister   in  a   stereotyped\tmanner.\t The<br \/>\napplications  have  not\t been  officially  received  by\t the<br \/>\nPetroleum Ministry.  There is  no receipt  &#8211; entry on any of<br \/>\nthe applications. The applicants seem to have approached the<br \/>\nMinister directly.  None of the applications have been dealt<br \/>\nwith in\t any of\t the branches  of  the\tMinistry.  There  is<br \/>\nnothing on the record to indicate that the Minister kept any<br \/>\ncriteria in  view  while  making  the  allotments.  How\t the<br \/>\napplicants came to know about the availability of the petrol<br \/>\npumps is  not known. No advertisement was made to invite the<br \/>\napplications. There  is nothing\t on the\t record to show that<br \/>\nany other method of inviting applications was adopted. There<br \/>\nis no  indication in the allotment-orders or anywhere in the<br \/>\nrecord to show that the Minister kept any guidelines in view<br \/>\nwhile making these allotments. The allotments have been made<br \/>\nin a cloistered manner. The petrol pumps &#8211; public property &#8211;<br \/>\nhave been doled out in a wholly arbitrary manner. This Court<br \/>\nin <a href=\"\/doc\/1281050\/\">Ramana Dayaram Shetty vs. International Airport Authority<br \/>\nof India and others<\/a> (1979) 3 SCC 489, held ad under:\n<\/p>\n<blockquote><p>     &#8220;It must, therefore, be taken to be<br \/>\n     the law  that where  the Government<br \/>\n     is dealing with the public, whether<br \/>\n     by way  of gibing\tjobs or entering<br \/>\n     into contracts or issuing quotas or<br \/>\n     licences or granting other forms of<br \/>\n     largesse, the Government cannot act<br \/>\n     arbitrarily at  its sweet will and,<br \/>\n     like  a  private  individual,  deal<br \/>\n     with any person it pleases, but its<br \/>\n     action must  be in\t conformity with<br \/>\n     standard  or  norms  which\t is  not<br \/>\n     arbitrary,\t     irrational\t      or<br \/>\n     irrelevant. The power or discretion<br \/>\n     of the  Government in the matter of<br \/>\n     grant of  largesse including  award<br \/>\n     of\t  jobs,\t   contracts,\t quotas,<br \/>\n     licences, etc. must be confined and<br \/>\n     structured\t by  national,\trelevant<br \/>\n     and non-discriminatory  standard or<br \/>\n     norm and  if the Government departs<br \/>\n     from such\tstandard or  norm in any<br \/>\n     particular\t case\tor  cases,   the<br \/>\n     action of\tthe Government\twould be<br \/>\n     liable to be struck down.&#8221;<\/p><\/blockquote>\n<p>     The allotments have been made by the Minister either on<br \/>\nthe ground  of poverty\tor unemployment.  Assuming that\t the<br \/>\nallottees belong  to either of these two categories then how<br \/>\nthe Minister has selected them court of millions of poor and<br \/>\nunemployed in  this country.  As mentioned above no criteria<br \/>\nwas fixed,  no guidelines  were kept  in view, none knew how<br \/>\nmany  petrol   pumps  were\tavailable   for\t  allotment,<br \/>\napplications were  not invited\tand the allotments of petrol<br \/>\npumps were made in an arbitrary and discriminatory manner.\n<\/p>\n<p>     We may  examine these   allotments\t from another  angle<br \/>\nwhich has  very serious repercussions. Six of the  allottees<br \/>\nare related  to various officials working with the Minister.<br \/>\nLeela  Devi   is  the  mother  of  Minister&#8217;s  driver.\tPoda<br \/>\nRajasekhar is a relation of G. Gurucharan, Private Secretary<br \/>\nto the Minister. Madhuri Safaya and Monika Malla are related<br \/>\nto B.N.\t Safaya, Add1.\tPrivate Secretary  to the  Minister.<br \/>\nDaya Rani  is the  wife of H.R. Verma. Personal Assistant to<br \/>\nB.N. Safaya  and Vijaya\t Nair is  the wife  of D.V.  Pallai,<br \/>\nAdd1. Private Secretary. Two of the allottees are related to<br \/>\nthe politicians.  Sarbjot Singh is the son of Buta Singh who<br \/>\nwas Home  Minister and\tat the\trelevant  time\twas  Cabinet<br \/>\nMinister heading  the Civil  Supplies portfolio. Benjamin K.<br \/>\nHollohan is  the son  of Shri  K. Hollahan,  Minister in the<br \/>\nState of  Nagaland. Remaining  seven  allottees\t are  either<br \/>\nmembers of  the Oil  Selection Boards  or  their  relations.<br \/>\nShaukat Hasan Abidi is the son of Justice S.H. Abidi(Retd.),<br \/>\nwho was\t the Chairman  of the  Oil  Selection  Board,  Uttar<br \/>\nPradesh. Similarly,  Arun Kumar\t Gupta is the son of Justice<br \/>\nHarbans Lal  Gupta (Retd.)  who\t was  the  Chairman  of\t Oil<br \/>\nSelection Board,  Haryana.  Pradeep  Kumar  is\tthe  son  of<br \/>\nKrishna Swaroop,  who was  Member of Oil Selection Board for<br \/>\ndelhi and  Chandigarh. Nena  Nautiyal is  the wife  of\tR.S.<br \/>\nNautiyal, who\twas  member of\tOil Selection Board, Punjab.<br \/>\nDharmesh Kumar was the recommended of Satya Bahin, Ex.Member<br \/>\nof Parliament  and Member  of the  Oil Selection  board\t for<br \/>\nHaryana.  Shiv\t Balak\tPassi  and  Ghulam  Ahamd  Mir\twere<br \/>\nthemselves members  of\tthe  Oil  Selection  Boards.  It  is<br \/>\nobvious that  Capt. Satish  Sharma was personally interested<br \/>\nin making  allotments of petrol pumps in favour of all these<br \/>\n15 persons. He made allotments in favour of relations of his<br \/>\npersonal staff\tunder the  influence of\t the staff on wholly<br \/>\nextraneous considerations.  The allotments  to the  sons  of<br \/>\nMinisters were\tonly to oblige the Ministers. The allotments<br \/>\nto  the\t  members  of\tthe   Oil   Selection\tBoards\t and<br \/>\ntheir\/chairmen&#8217;s relations  have been done to influence them<br \/>\nand to\thave favours  from them.  All these  allotments\t are<br \/>\nwholly arbitrary, nepotistic and are motivated by extraneous<br \/>\nconsiderations.\n<\/p>\n<p>     The Government  today &#8211;  in a  welfare State &#8211; provides<br \/>\nlarge number  of benefits  to the  citizens. It\t distributes<br \/>\nwealth in  the form  of allotment  of plots,  houses, petrol<br \/>\npumps, gas  agencies, mineral  leases, contracts, quotas and<br \/>\nlicences etc.  Government distributes  largesses in  various<br \/>\nforms.\tA   Minister  who  is  the  executive  head  of\t the<br \/>\ndepartment  concerned\tdistributed   these   benefits\t and<br \/>\nlargesses. He  is elected by the people and is elevated to a<br \/>\nposition where\the holds a trust on behalf of the people. He<br \/>\nhas to\tdeal with  the peoples&#8217;\t property in a fair and just<br \/>\nmanner. He  cannot commit breach of the trust reposed in him<br \/>\nby the\tpeople. We have no hesitation in holding  that Capt.<br \/>\nSatish Sharma  in his  capacity as  a Minister for Petroleum<br \/>\nand Natural gas Deliberately acted in a wholly arbitrary and<br \/>\nunjust manner.\tWe have\t no doubt  in our  mind\t that  Capt.<br \/>\nSatish Sharma  knew that the allottees were relations of his<br \/>\npersonal  staff,   sons\t of   Ministers,  sons\/relations  of<br \/>\nChairmen and  members of  the Oil  Selection Boards  and the<br \/>\nmembers\t of   the  Oil\t Selection  Boards  themselves.\t The<br \/>\nallotments made\t by him\t were wholly  mala fide\t and as such<br \/>\ncannot be sustained.\n<\/p>\n<p>     We are  further of\t the view  that Capt.  Satish Sharma<br \/>\nacted in  a wholly  biased manner  inasmuch as\the  unfairly<br \/>\nregarded with  favour the  cases of 15 allottees before him.<br \/>\nThe  relevant\tcircumstances  available   from\t record\t and<br \/>\ndiscussed by  us leave\tno manner  of doubt in our mind that<br \/>\nCapt. Satish Sharma deliberately acted in a biased manner to<br \/>\nfavour these  allottees and as such the allotment orders are<br \/>\nwholly vitiated and are liable to be set aside.\n<\/p>\n<p>     The orders\t of the Minister reproduced above read: &#8220;the<br \/>\napplicant has  no regular  income to support herself and her<br \/>\nfamily&#8221;, &#8220;the  applicant is  an educated lady and belongs to<br \/>\nscheduled tribe\t community, &#8220;the applicant is unemployed and<br \/>\nhas no\tregular source\tof income&#8221;,  &#8220;the  applicant  is  an<br \/>\nuneducated, unemployed scheduled tribe youth without regular<br \/>\nsource of  livelihood&#8221;, &#8220;the  applicant\t is  an\t uneducated,<br \/>\nunemployed scheduled  tribe youth  without regular source of<br \/>\nlivelihood&#8221;, &#8220;the  applicant is\t a housewife whose family is<br \/>\nfacing difficult  financial circumstances&#8221;  etc. etc.  There<br \/>\nwould be  literally millions of people in the country having<br \/>\nthese circumstances  or worse.\tThere  is  no  justification<br \/>\nwhatsoever to  pick up\tthese person except that they happen<br \/>\nto have\t won  the  favour  of  the  Minister  on  mala\tfide<br \/>\nconsiderations.\t None\tof  these   cases  fall\t within\t the<br \/>\ncategories placed  before this Court in writ petition (civil<br \/>\nNo. 886\/93  titled Centre  for public  interest ligation vs.<br \/>\nUnion of India &amp; Anrs. decided on March 31, 1995 but even if<br \/>\nwe assume for argument sake that these cases fall in some of<br \/>\nthose or  similar guidelines  the exercise of discretion was<br \/>\nwholly\tarbitrary.  Such  a  discretionary  power  which  is<br \/>\ncapable of  being exercised  arbitrarily is not permitted by<br \/>\nArticle 14  of the  Constitution of  India. While Article 14<br \/>\npermits a  reasonable classification having a rational nexus<br \/>\nto the\tobjective sought  to be achieved, it does not permit<br \/>\nthe power  to pick  and choose\tarbitrarily out\t of  several<br \/>\npersons falling\t in  the  same\tcategory.  A  transport\t and<br \/>\nobjective criteria\/procedure  has to  be evolved so that the<br \/>\nchoice among  the members  belonging to\t the same  class  or<br \/>\ncategory  is   based  on   reason,   fair   play   and\t non<br \/>\narbitrariness. It  is essential\t to lay\t down as a matter of<br \/>\npolicy as  to how  preferences would be assigned between two<br \/>\nperson falling\tin the\tsame  category.\t If  there  are\t two<br \/>\neminent sportsmen  in distress\tand only  one patrol pump is<br \/>\navailable, there  should be clear, transparent and objective<br \/>\ncriteria\/procedure to  indicate who  out of the two is to be<br \/>\npreferred. Lack\t of  transparency  in  the  system  promotes<br \/>\nneptosism and arbitrariness. It is absolutely essential that<br \/>\nthe entire  systems should  be transparent  right  from\t the<br \/>\nstage of  calling for  the upto\t the stage  of\tpassing\t the<br \/>\norders of  allotment. The names of the allottees, the orders<br \/>\nand the reasons for allotment should be available for public<br \/>\nknowledge and  scrutiny. Mr.  Shanti Bhushan  has  suggested<br \/>\nthat the  petrol pumps,\t agencies etc.\tmay be\tallotted  by<br \/>\npublic auction\t&#8211; category-wise\t amongst  the  eligible\t and<br \/>\nobjectively selected  applicants. We  do not  wish to impose<br \/>\nany procedure  on the  Government. It  is a matter of policy<br \/>\nfor the Government to lay down. We, however, direct that any<br \/>\nprocedure laid\tdown by\t the Government must be transparent,<br \/>\njust, fair and non-arbitrary,<br \/>\n     This Court in The Centre for Public Interest Litigation<br \/>\ncase (supra)  has endorsed  the guidelines  submitted by the<br \/>\nAttorney General for allotment of petrol pumps, gas agencies<br \/>\netc. The  Court in  that case  did not\thave before  it\t the<br \/>\nactual manner  of exercise  of discretion by the Minister in<br \/>\nthe allotment  of pups\/agencies.  The allotment orders which<br \/>\nare now\t before the  Court clearly indicate that leaving the<br \/>\nauthorities to\tenjoy absolute\tdiscretion even\t within\t the<br \/>\nguidelines would  inevitably lead  to gross violation of the<br \/>\nconstitutional norms  when the\tpersons\t for  allotment\t are<br \/>\npicked up arbitrarily and discriminatory.\n<\/p>\n<p>     This Court\t as back  as in 1979 in Ramana Shetty&#8217;s case<br \/>\n(supra) held  &#8220;it  must,  therefore,  be  taken\t to  be\t the<br \/>\nlaw&#8230;.&#8221; that  even in\tthe matter  of\tgrant  of  largesses<br \/>\nincluding award of jobs, contracts, quotas and licences, the<br \/>\nGovernment  must  act  in  fair\t and  just  manner  and\t any<br \/>\narbitrary distribution\tof wealth would violative the law of<br \/>\nthe land.  Mr. Satish Sharma has acted in utter violation of<br \/>\nthe law\t laid-down by  this Court  and\thas  also  infarcted<br \/>\nArticle 14 of the Constitution of India. As already stated a<br \/>\nminister in  the Central  Government is\t in a  position of a<br \/>\ntrustee in  respect of\tthe public property under his charge<br \/>\nand discretion.\t The petrol pumps\/gas agencies are a kind of<br \/>\nwealth which  the Government  must distribute in a bona fide<br \/>\nmanner and  in conformity  with law. Capt. Satish Sharma has<br \/>\nbetrayed the  trust reposed  in him  by the people under the<br \/>\nconstitution. It  is high  time\t that  the  public  servants<br \/>\nshould be  held personally  responsible for  their mala fide<br \/>\nacts in the discharge of their functions as public servants.<br \/>\nThis Court  in Lucknow\tDevelopment  Authority\tversus\tM.K.<br \/>\nGupta  (1994)\t1  Supreme   Court   Cases   243,   approved<br \/>\n&#8220;Misfeasance in\t public offices&#8221;  as a\tpart of\t the Law  of<br \/>\nTort.  Public\tservants  may\tbe  liable  in\tdamages\t for<br \/>\nmalicious, deliberate or injurious wrong-doing. According to<br \/>\nWade &#8220;There is, thus, tort which has been called misfeasance<br \/>\nin public  office and  which  includes\tmalicious  abuse  of<br \/>\npower, deliberate  maladministration, and perhaps also other<br \/>\nunlawful acts  causing injury&#8221;.\t With the  change in  socio-<br \/>\neconomic outlook,  the public  servants are  being entrusted<br \/>\nwith more  and more discretionary power even in the field of<br \/>\ndistribution of\t Government wealth in various forms. We take<br \/>\nit to  be perfectly  clear, that  if a public servant abuses<br \/>\nhis office  either by  an act of omission or commission, and<br \/>\nthe consequence\t of that  is injury to an individual or loss<br \/>\nof public property, an action may be maintained against such<br \/>\npublic servant. No public servant can say &#8220;you may set-aside<br \/>\nan order  on the  ground of mala fide but you cannot hold me<br \/>\npersonally  liable&#8221;.  No  public  servant  can\tarrogate  to<br \/>\nhimself the power to act in a manner which is arbitrary.\n<\/p>\n<p>     For the  reasons indicated\t above, we conclude that the<br \/>\norders passed  by Capt.\t Satish Sharma, the then Minister of<br \/>\nState for  Petroleum and  Natural Gas,\tGovernment of India,<br \/>\nallotting  petrol   pumps  to  Sarbjot\tSingh,\tBenjamin  K.<br \/>\nHollohon,  Syed\t Hasan\tShaukat\t Abidi,\t Shiv  Balak  Passi,<br \/>\nPradeep Kumar,\tGhulam Ahmad  Mir, Nena Nautiyal, Arun Kumar<br \/>\nGupta, Dharmesh\t Kumar, Leela Devi, Poda Rajasekhar, Madhuri<br \/>\nSafaya,\t Monika\t  Malla,  Daya\tRani  and  Vijaya  Nair\t are<br \/>\narbitrary, discriminatory,  mala fide, wholly illegal and as<br \/>\nsuch are liable to be quashed.\n<\/p>\n<p>     We, therefore, hold and direct as under:\n<\/p>\n<p>1.   The  orders  &#8211;  reproduced\t in  earlier  part  of\tthis<br \/>\njudgment &#8211;  allotting petrol  pumps to\tthe above  mentioned<br \/>\nfifteen persons are hereby quashed.\n<\/p>\n<p>2.   The allocation,  allotment of  the petrol\tpumps\/retail<br \/>\noutlet dealerships  by the  Government of  India, Indian Oil<br \/>\nCorporation Ltd.  or any  other corporation  in names of the<br \/>\nabove  said  fifteen  persons  shall  stand  cancelled\twith<br \/>\nimmediate effect.\n<\/p>\n<p>3.   Most of  these 15\tpersons have not as yet commissioned<br \/>\nthe petrol  pumps. Those  who have  commissioned the  petrol<br \/>\npumps and  are running\tthe same  shall stop  operating\t the<br \/>\npetrol pumps  and running the said business with effect from<br \/>\nOctober 31,  1996. The\tGovernment of  India\/Oil Corporation<br \/>\n(concerned) shall  take over  the petrol  pump premises from<br \/>\nthese  persons\t within\t ten   days  thereafter.   The\t Oil<br \/>\nCorporation shall  have the market-value of the site and the<br \/>\nconstruction thereon,  determined in  a fair and just manner<br \/>\nbefore October 31, 1996.\n<\/p>\n<p>4.   Each of  the commissioned\tpetrol pumps,  taken over by<br \/>\nthe Government\/Oil  Corporation (concerned) and the built-up<br \/>\narea along with the site (whether lease-hold or owned by the<br \/>\noriginal allottee)  shall be  disposed of  by way  of public<br \/>\nauction. The  original allottees may also participate in the<br \/>\nauction. The  petrol pump  shall be  allotted to the highest<br \/>\nbidder. The  said allottee  shall run the petrol pump on the<br \/>\noriginal terms\tand conditions. He shall have all the rights<br \/>\nin respect  of the  site and the construction thereon as the<br \/>\noriginal allottee  had on  the date  of auction.  Out of the<br \/>\nauction money  the value of the site and the construction as<br \/>\ndetermined by  the Oil\tCorporation shall  be  paid  to\t the<br \/>\noriginal allottee  and the  remaining money  shall go to the<br \/>\nGovernment  coffer.  On\t receipt  of  the  said\t amount\t the<br \/>\noriginal allottee  shall cease to have any right or interest<br \/>\nin the\tsite and the construction thereon. If the successful<br \/>\nbidder is the original allottee, he shall pay the difference<br \/>\nbetween the  auction money  and the  value of  the site\t and<br \/>\nconstruction as determined by the Oil Corporation.\n<\/p>\n<p>5.   Capt. Satish  Sharma shall\t show-cause within two weeks<br \/>\nwhy a  direction be  not issued\t to the\t appropriate  police<br \/>\nauthority  to  register\t a  case  and  initiate\t prosecution<br \/>\nagainst him  for criminal  breach  of  trust  or  any  other<br \/>\noffence under  law. He\tshall further  show-cause within the<br \/>\nsaid period  why he  should not, in addition, be made liable<br \/>\nto pay\tdamages for his mala fide action in allotting petrol<br \/>\npumps to the above mentioned fifteen persons.\n<\/p>\n<p>     We place  on  record  our\tappreciation  for  Mr.\tH.D.<br \/>\nShourie, who,  very ably,  assisted us\tin this\t matter.  He<br \/>\nshall be  entitled to  costs which  was quantify  as  rupees<br \/>\nfifty thousand.\t The cost  shall be  paid  by  Capt.  Satish<br \/>\nSharma personally.\n<\/p>\n<p>     Before parting with this judgment, we may mention about<br \/>\nCivil Writ  Petitions Numbers  400.\/95 and 4430\/95 which are<br \/>\npending before\tthe Delhi High Court. In the said petitions,<br \/>\nallotment of  petrol pumps\/gas\tagencies  to  various  other<br \/>\npersons during\tthe period  1992-93,  1993-94,\t1994-95\t and<br \/>\n1995-96 have  been challenged.\tTransfer petition  No.127\/96<br \/>\nhas been  filed in this Court seeking transfer of those writ<br \/>\npetitions from\tDelhi High  Court to  this  Court.  We\thave<br \/>\nissued notice  in the  transfer\t petition  and\thave  stayed<br \/>\nfurther proceedings  before  the  High\tCourt  in  the\twrit<br \/>\npetitions. Various  affidavits have  been filed on behalf of<br \/>\nthe Ministry  of Petroleum  &amp; Natural  Gas. Mr.\t Devi Dayal,<br \/>\nJoint Secretary\t of the\t Ministry, in  his  affidavit  dated<br \/>\nMarch  26,  1995,  has\tstated\tthat  in  1995-96  petroleum<br \/>\nproducts agencies  were allotted  to 99\t persons  under\t the<br \/>\ndiscretionary powers of the Government. It is further stated<br \/>\nthat  orders   on  file\t have  been  made  allotting  petrol<br \/>\npumps\/agencies to 61 more persons. An affidavit filed by Mr.<br \/>\nSrinivasan, Advocate  supporting the transfer petition gives<br \/>\na long\tlist of\t persons who  are related  to the then Prime<br \/>\nMinister\/Ministers and other VIPs and who have been allotted<br \/>\npetrol\tpumps  and  gas\t agencies.  Mr.\t Devi  Dayal,  Joint<br \/>\nSecretary in  the Ministry  of Petroleum  has filed  another<br \/>\naffidavit dated\t April 18, 1996 in reply to the affidavit of<br \/>\nMr. Srinivasan. Para 6 of the affidavit is as under:-\n<\/p>\n<blockquote><p>     &#8220;As regards  the list  of allottees<br \/>\n     mentioned in  paras 3  to 6 and the<br \/>\n     alleged relationship with the Prime<br \/>\n     Minister, other Ministers, V.I.Ps.,<br \/>\n     M.Ps\/M.L.As, etc.,\t it is to submit<br \/>\n     that  enquiries   have  been   made<br \/>\n     through the  Oil Companies from the<br \/>\n     allottees, who have replied through<br \/>\n     affidavits.  The  comments\t of  the<br \/>\n     Ministry, on  the\tbasis  of  above<br \/>\n     enquiry and  records, are contained<br \/>\n     in Annexure &#8211; I to this affidavit.&#8221;<\/p><\/blockquote>\n<p>     Annexure 1\t with the  affidavit shows that gas agencies<br \/>\nwere allotted  to six  relations of the then Prime Minister,<br \/>\nan agency  to a\t son of\t the OSD in Prime Minister&#8217;s office,<br \/>\nLPG dealership\tto daughter-in-law  of the  OSD tot  eh then<br \/>\nMinister of  Petroleum, a petrol pump to the real brother of<br \/>\nChadraswamy  (Nemi   Chand  Jain),  LPG\t distributorship  to<br \/>\nbrother of  Shri Bhagwan Shri Satya Sai Baba, LPG dealership<br \/>\nto Manju  Devi, wife  of  private  secretary  to  additional<br \/>\nprivate secretary  of Capt.  Satish Sharma, a petrol pump to<br \/>\nwife  of   V.K.\t Aggarwal,   additional\t private  secretary,<br \/>\nMinistry of Law, RO dealership to Rakesh Saluja, son of R.L.<br \/>\nSaluja, who  was employed  in the Ministry of Petroleum till<br \/>\nJune, 1993,  RO dealership to Prathiba Singh related to Shri<br \/>\nKalapnath Rai,\tRO dealership in January, 1995 to Kanti\t Lal<br \/>\nBhuriya, who at that time was Minister for Tribal Welfare in<br \/>\nhe Madhya Pradesh Government, a gas agency to the son-in-law<br \/>\nof Mr.\tG. Ganga  Reddy, Member\t of Parliament\tand  various<br \/>\nothers.\n<\/p>\n<p>     Since the\ttwo writ  petitions,  mentioned\t above,\t are<br \/>\npending before the High Court wherein the allotments made to<br \/>\nall the\t persons  mentioned  above  and\t others,  have\tbeen<br \/>\nchallenged, it\tis not necessary for us to transfer the writ<br \/>\npetitions to this Court. We vacate the stay order granted by<br \/>\nthis Court  and dispose\t of the transfer petition. We direct<br \/>\nthe Registry  of this Court to send all the affidavits filed<br \/>\nby the parties in the transfer petition along with annexures<br \/>\nto the\tHigh Court.  We have  no doubt\tthat the  High Court<br \/>\nshall examine  the issues  involved in he writ petitions and<br \/>\nshall also  go into  the validity of the allotment of petrol<br \/>\npumps\/gas agencies  to various\tpersons, after hearing them,<br \/>\nin accordance  with  law.
