Justice S.SIRI JAGAN\n\n Dated :04\/04\/2008\n\n O R D E R\n                         S.SIRI JAGAN, J.\n                     =======================\n                      W.P.(C) No.23364 of 2007(F)\n                     =======================\n\n                  Dated this the 4th day of April, 2008\n\n\n                            JUDGMENT\n<\/pre>\n<p>     A very difficult situation    which would affect the future of<\/p>\n<p>the students of a College is presented before me by a Lecturer<\/p>\n<p>who has been appointed by the manager to save the situation.<\/p>\n<p>There are posts of Lecturers, Assistant Professors and Professor<\/p>\n<p>in the Department of MCA in the 5th respondent&#8217;s college. The<\/p>\n<p>post of Assistant Professors and Professor are lying vacant in<\/p>\n<p>spite of several attempts to get the same filled up by qualified<\/p>\n<p>hands through direct recruitment.        The existing Lecturers are<\/p>\n<p>also not qualified  to be promoted to those posts. In the above<\/p>\n<p>circumstances, the management appointed the petitioner as a<\/p>\n<p>Lecturer in one of the posts of Assistant Professors.    However,<\/p>\n<p>the   appointment was not approved.         In view of the peculiar<\/p>\n<p>circumstances, letters were exchanged between the Government,<\/p>\n<p>management and the University.           Nobody took any definite<\/p>\n<p>decision regarding the same, apparently, because of the fact that<\/p>\n<p><span class=\"hidden_text\"> W.P.(C) No.23364\/2007\/F           -2-<\/span><\/p>\n<p>such promotion would go counter to the AICTE norms. They can<\/p>\n<p>approach the AICTE for appropriate orders,      if the Government<\/p>\n<p>conveys their no objection for the same.         The Government<\/p>\n<p>Pleader submits that the Government cannot permit this because<\/p>\n<p>it is against the existing norms and rules. It is also stated that<\/p>\n<p>after the earlier attempts the management has not attempted<\/p>\n<p>any fresh selection by direct recruitment again.<\/p>\n<p>      2.     I have considered rival contentions in detail. I am of<\/p>\n<p>the opinion that since the very object    of a college is to teach<\/p>\n<p>students, when there are no sufficient qualified hands available<\/p>\n<p>the students cannot be allowed to suffer because of lack of<\/p>\n<p>qualified hands available for promotion or for direct recruitment.<\/p>\n<p>Here is a situation whereby the management is unable to obtain<\/p>\n<p>qualified hands either by direct recruitment or by promotion to<\/p>\n<p>the post of Assistant Professor.     In such circumstances, it is<\/p>\n<p>imperative that some way out should be found,         for providing<\/p>\n<p>faculty to teach       students, since unless there are sufficient<\/p>\n<p>faculty in the College to teach the students, the students would<\/p>\n<p><span class=\"hidden_text\"> W.P.(C) No.23364\/2007\/F           -3-<\/span><\/p>\n<p>suffer. Admittedly, when the post of Assistant Professors and one<\/p>\n<p>post of Professor are lying vacant, the petitioner and the 5th<\/p>\n<p>respondent can approach the AICTE for appropriate orders only if<\/p>\n<p>the Government conveys its no objection in this regard. In the<\/p>\n<p>above circumstances, this writ petition is disposed of with the<\/p>\n<p>following directions:\n<\/p>\n<p>      The Government shall give its no objection for appointment<\/p>\n<p>of the petitioner in any one of the post of Assistant Professors<\/p>\n<p>lying vacant so that the 5th respondent can seek approval of<\/p>\n<p>their action with the support of that no objection.  This shall be<\/p>\n<p>done within one month from the date of receipt of a copy of the<\/p>\n<p>judgment.      On receipt of the same, the management shall<\/p>\n<p>address the AICTE detailing the circumstances seeking approval<\/p>\n<p>for their action.       If the AICTE approved the same, the<\/p>\n<p>Government shall         accord sanction and the University shall<\/p>\n<p>approve the appointment of the petitioner in accordance with the<\/p>\n<p>approval of the AICTE.
