SHAH\n\t\t\t\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/08\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tAll<br \/>\nthese Miscellaneous Civil Applications have been preferred by the<br \/>\nrespective applicants-original petitioners for recall\/modification of<br \/>\nthe order dated 23\/08\/2010 relying upon some subsequent communication<br \/>\ndated 13\/08\/2010 issued by the Deputy Estate Officer (West Zone),<br \/>\nAhmedabad Municipal Corporation  by which some other persons are<br \/>\nissued notices and are called upon to remove the deficiencies with<br \/>\nrespect to their applications for regularisation of illegal<br \/>\nconstruction.  It is submitted that Ahmedabad Municipal Corporation<br \/>\nand their Officers have even accepted the impact fees till yesterday<br \/>\ni.e. 29\/08\/2010.  It is submitted that when  the Corporation has<br \/>\nextended the time to remove the deficiencies with respect to the<br \/>\napplications for regularisation of the unauthorised construction and<br \/>\ntime to pay the impact fees is extended, similar treatment should be<br \/>\ngiven to the petitioners also, who have as such agreed to demolish<br \/>\nthe illegal construction, which is already removed now.\n<\/p>\n<p>2.\tOn<br \/>\nan advance copy being served, Shri S.N. Shelat, learned Senior<br \/>\nadvocate has appeared with Shri R.M. Chhaya, learned advocate<br \/>\nappearing on behalf of the opponent-Corporation and an<br \/>\naffidavit-in-reply is filed on behalf of the opponents, affirmed by<br \/>\none Shri Utpal C. Padia, Deputy Municipal Commissioner in charge of<br \/>\nUrban Development Department in  Ahmedabad Municipal Corporation .<br \/>\nIn paragraph 3 it is stated as under;\n<\/p>\n<p>&#8220;I<br \/>\nsay the communication dated 03\/08\/2010 issued by the Corporation<br \/>\nAnnexure &#8211; B to the application has been examined by the<br \/>\nCorporation and taking into consideration the provisions of GRUDA the<br \/>\nsame could not have been issued thereunder and hence no further<br \/>\nactions have been taken by the Corporation.  It is decided that the<br \/>\nCorporation shall not take any further action\/s in lieu of any such<br \/>\nsimilar communication.&#8221;\n<\/p>\n<p>3.\tShri<br \/>\nS.N. Shelat, learned Senior advocate appearing with Shri R.M. Chhaya,<br \/>\nlearned advocate appearing on behalf of the opponent-Corporation,<br \/>\nunder instructions from Shri Rajeshbhai Patel, Deputy Town<br \/>\nDevelopment Officer and Deputy Estate Officer (West Zone,) has made a<br \/>\nstatement that no amount of impact fees has been accepted by the<br \/>\nCorporation so far as west zone is concerned and there is no question<br \/>\nof further processing the applications of regularisation of the<br \/>\nillegal\/unauthorised construction by extending the time to remove the<br \/>\ndeficiencies and\/or extending the time to pay the impact fees. Shri<br \/>\nS.N. Shelat, learned Senior advocate appearing with Shri R.M. Chhaya,<br \/>\nlearned advocate appearing on behalf of the opponent-Corporation has<br \/>\nfurther submitted at the bar that if the opponent-Corporation has<br \/>\naccepted any amount of impact fees with respect to other zones,<br \/>\npursuant to the aforesaid communications, the  same shall be returned<br \/>\nto the respective parties and as such no further actions are to be<br \/>\ntaken pursuant to the aforesaid communications.<br \/>\n It is further submitted that as such, earlier some notices<br \/>\nwere issued and\/or it was published in the newspapers with respect to<br \/>\nextension of time to pay the impact fees and to remove the<br \/>\ndeficiencies with respect to the applications for regularisation of<br \/>\nthe illegal\/unauthorised construction, however, the same are issued<br \/>\ninadvertently and\/or there was no proper advice.  It is stated at the<br \/>\nbar that all such earlier communications have been withdrawn and it<br \/>\nis made very much clear that no further actions are to be taken by<br \/>\nthe Corporation with respect to such similar communications.  It is<br \/>\nsubmitted that even otherwise the same is not permitted at all<br \/>\nconsidering the provisions of GRUDA. Shri S.N. Shelat, learned Senior<br \/>\nadvocate appearing on behalf of the opponent-Corporation has stated<br \/>\nat the bar that appropriate authorities are appropriately advised<br \/>\nnow.  He has also stated at the bar that appropriate press<br \/>\nrelease\/press note shall be given in the local newspaper clarifying<br \/>\nthe aforesaid position at the earliest so that there is no further<br \/>\nconfusion and\/or illusion amongst such person, who have made<br \/>\nunauthorised\/illegal construction.  Opponents are directed to act as<br \/>\nstated hereinabove.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, Shri Nanavati, learned Senior advocate appearing<br \/>\non behalf of the respective applicants does   not press the present<br \/>\napplications.
