Justice S.SIRI JAGAN\n\n Dated :22\/12\/2009\n\n O R D E R\n                        S.SIRI JAGAN,J.\n                      -------------------------\n                  W.P ( C) No.33596 of 2005\n                      --------------------------\n             Dated this the 22nd December,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>     The petitioner entered service of the Government of<\/p>\n<p>Kerala in the Revenue Department as a Second Grade<\/p>\n<p>Surveyor on 17.5.1972.        He was promoted as Head<\/p>\n<p>Surveyor on 20.7.2000.         He was later promoted as<\/p>\n<p>Superintendent of Survey on 29.6.2005. In the post of<\/p>\n<p>Head Surveyor, the petitioner was senior to respondents 3<\/p>\n<p>and 4. By Ext.P6, the petitioner was assigned the date of<\/p>\n<p>promotion as Superintendent of Survey as           1.9.2002.<\/p>\n<p>Overlooking the seniority of the petitioner, respondents 3<\/p>\n<p>and 4 were promoted as Assistant Director and then as<\/p>\n<p>Deputy Director.    The petitioner is aggrieved by such<\/p>\n<p>supersession in the matter of promotion and therefore he<\/p>\n<p>is seeking the following reliefs.\n<\/p>\n<blockquote><p>           &#8220;i.  Issue a writ in the nature of<br \/>\n     mandamus or any other appropriate writ,<br \/>\n     direction or order directing the 2nd respondent<br \/>\n     to assign seniority to the petitioner in the cadre<br \/>\n     of Superintendent Assistant Director and Deputy<br \/>\n     Director above 3rd and 4th respondents and<br \/>\n     grant him all consequential benefits arising<br \/>\n     therefrom.\n<\/p><\/blockquote>\n<p>W.P ( C) No.33596 of 2005<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>             ii.    Issue a  writ  in  the   nature  of<br \/>\n       mandamus or any other appropriate writ,<br \/>\n       direction or order directing the respondents to<br \/>\n       promote the petitioner provisionally as Deputy<br \/>\n       Director of Survey with immediate effect since<br \/>\n       his juniors have been promoted as per Ext.P9<br \/>\n       order;\n<\/p>\n<p>             iii    Issue a  writ  in  the   nature  of<br \/>\n       mandamus to the 1st respondent to convene a<br \/>\n       proper D.P.C       and to issue select list for<br \/>\n       promotion as Assistant Director and Deputy<br \/>\n       Director of Survey with entitled dates with all<br \/>\n       consequential benefits including fixation of pay<br \/>\n       and arrears of salary.&#8221;\n<\/p>\n<p>      2.     Petitioner contends that by Ext.P9, respondents<\/p>\n<p>3 and 4 who were juniors to the petitioner in service were<\/p>\n<p>promoted ahead of the petitioner as Assistant Director and<\/p>\n<p>Deputy Director, which is unsustainable.         He further<\/p>\n<p>submits that although there were vacancies, the petitioner<\/p>\n<p>was not promoted as Deputy Director.\n<\/p>\n<p>       3.    A counter affidavit has been filed by the 1st<\/p>\n<p>respondent contending that although the petitioner was<\/p>\n<p>senior to respondents 3 and 4 in the post of Head Surveyor,<\/p>\n<p>he became junior to them in the post of Superintendent of<\/p>\n<p>Survey since he did not satisfactorily complete the<\/p>\n<p>probation in the post of Head Surveyor before respondents<\/p>\n<p>3 and 4, consequent to which respondents 3 and 4<\/p>\n<p>W.P ( C) No.33596 of 2005<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>happened to be promoted earlier than the petitioner in the<\/p>\n<p>post of Superintendent of Survey. Therefore, in the cadre<\/p>\n<p>of Superintendent of Survey, respondents 3 and 4 became<\/p>\n<p>senior to the petitioner and consequently for promotion to<\/p>\n<p>the post of Assistant Director and Deputy Director,<\/p>\n<p>respondents 3 and 4 had to be considered ahead of the<\/p>\n<p>petitioner which only was done. It is also denied in the<\/p>\n<p>counter affidavit that there was any vacancy to which the<\/p>\n<p>petitioner could have been promoted before his date of<\/p>\n<p>retirement on 31.5.2006.\n<\/p>\n<p>       4.    I have considered the rival contentions in detail.<\/p>\n<p>       5.    Admittedly, respondents 3 and 4 were promoted<\/p>\n<p>to the cadre of Superintendent of Survey ahead of the<\/p>\n<p>petitioner years ago. Petitioner did not care to challenge<\/p>\n<p>their promotion at the right time. As such, it is too late<\/p>\n<p>the day for the petitioner to contend that respondents 3<\/p>\n<p>and 4       could not have been promoted in the post of<\/p>\n<p>Assistant Director and Deputy Director ahead of the<\/p>\n<p>petitioner.       The petitioner could not produce any<\/p>\n<p>satisfactory materials on record to prove before me that<\/p>\n<p>W.P ( C) No.33596 of 2005<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>petitioner was denied promotion to a vacancy which arose<\/p>\n<p>before his retirement on 31.5.2006. Without a vacancy, the<\/p>\n<p>petitioner cannot seek a direction to promote him.<\/p>\n<p>       In the above circumstances, there is no merit in the<\/p>\n<p>prayer for promotion of the petitioner prior to his date of<\/p>\n<p>retirement also.
