No.23914 of 2011\n                   Surendra Prasad Yadav son of late Yadunandan Bhagat\n                                          Versus\n                                    The State Of Bihar\n                                         -----------\n<\/pre>\n<p>2\/   25.07.2011                     Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                    The petitioner was refused bail by order dated<\/p>\n<p>                       15.03.2011 vide Cr. Misc. No.43229 of 2010, but he was granted<\/p>\n<p>                       liberty to renew his prayer after framing of charge.<\/p>\n<p>                                    It has been submitted that charges have been framed<\/p>\n<p>                       jointly against the petitioner and one Purohit Yadav by order dated<\/p>\n<p>                       20.12.2010 and, therefore, he deserves bail.\n<\/p>\n<p>                                    Considering the same, let the petitioner, above named,<\/p>\n<p>                       be released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                       thousand) with two sureties of the like amount each or any other<\/p>\n<p>                       surety to be fixed by the court below to the satisfaction of the FTC<\/p>\n<p>                       5th, Patna, in connection with Sessions Trial No.1809 of 2010,<\/p>\n<p>                       subject to the conditions (i) That one of the bailors will be a close<\/p>\n<p>                       relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                       genealogy as to how he is related with the petitioner. The bailor will<\/p>\n<p>                       undertake to furnish information to the court about any change in the<\/p>\n<p>                       address of the petitioner, (ii) That the affidavit shall clearly state that<\/p>\n<p>                       the petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>                       shall not be released on bail, (iii) That the bailor shall also state on<\/p>\n<p>                       affidavit that he will inform the court concerned if the petitioner is<\/p>\n<p>                       implicated in any other case of similar nature after his release in the<\/p>\n<p>                       present case and thereafter the court below will be at liberty to<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>       misuse, (iv) That the petitioner will be well represented on each date<\/p>\n<p>       and if he fails to do so on two consecutive dates, his bail will be<\/p>\n<p>       liable to be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                          (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Surendra Prasad Yadav vs The State Of Bihar on 25 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
