Application No.507 of 2002 whereby, the lower<br \/>\nCourt had rejected the application seeking condonation of delay and<br \/>\napplication for restoration of the civil suit.\n<\/p>\n<p>2.\tThe<br \/>\nshort facts giving rise to the present Revision Application are that<br \/>\nthe applicants-plaintiffs had filed a suit being Civil Suit No.6051<br \/>\nof 1997 in the City Civil and Sessions Court, Ahmedabad seeking<br \/>\nspecific performance of the agreement dated 08.05.1994 in respect of<br \/>\nthe  suit property being Flat No.D\/2 admeasuring 100 sq.yards in<br \/>\nRussian Colony, F.P. No.343 Paiki, Ellisbridge Ward &#8211; A\/1,<br \/>\nAhmedabad (hereinafter referred to as the &#8216;suit property&#8217;) executed<br \/>\nby the present respondents (defendants). The said suit came to be<br \/>\ndismissed for want of prosecution by order dated 19.10.2000 passed by<br \/>\nthe learned (Aux.) Chamber Judge, City Civil Court, Ahmedabad. It<br \/>\nappears that the plaintiffs were unaware about the said dismissal of<br \/>\nthe suit and when they came to know about the same, filed Misc. Civil<br \/>\nApplication No.507 of 2002 on 18.09.2002 for restoration of the suit<br \/>\nwhich was dismissed for default, and also for condonation of delay<br \/>\nwhich had occurred in filing the said application for restoration.<br \/>\nThe said Civil Misc. Application No.507 of 2002 came to be dismissed<br \/>\nby the learned Judge, Court No.12, City Civil Court, Ahmedabad vide<br \/>\norder dated 30.07.2004. Being aggrieved by the said order, the<br \/>\napplicants-plaintiffs have filed the present proceedings under<br \/>\nSection 115 of the Code of Civil Procedure.\n<\/p>\n<p>3.\tIt<br \/>\nhas been submitted by learned advocate Mr.M.A. Bukhari for the<br \/>\napplicants that the concerned advocate appearing for the plaintiffs<br \/>\nin the suit did not remain present and also did not remove the<br \/>\nobjections raised by the office, and hence, the said suit filed by<br \/>\nthe plaintiffs came to be dismissed for default. According to<br \/>\nMr.Bukhari, even after the dismissal of the suit, the said advocate<br \/>\ndid not inform the plaintiffs and, therefore, the delay was caused in<br \/>\nfiling the application for restoration of the suit. According to<br \/>\nMr.Bukhari, the lower Court has materially erred in not considering<br \/>\nthe said cause as sufficient cause for condoning the delay and for<br \/>\nrestoring the suit on file and, therefore, has committed<br \/>\njurisdictional error which requires to be rectified by this Court in<br \/>\nthe interest of justice.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Shalin Mehta for Ms.Viraj S. Fozdar for the respondents,<br \/>\nhowever, submitted that there was no sufficient cause shown by the<br \/>\nplaintiffs for not approaching the Court immediately after the<br \/>\ndismissal of the suit and there being gross negligence on the part of<br \/>\nthe plaintiffs and their advocate, the lower Court has rightly<br \/>\nrejected the application of the plaintiffs for condonation of delay<br \/>\nand for restoration of the suit.\n<\/p>\n<p>5.\tHaving<br \/>\nregard to the submissions made by the learned advocates for the<br \/>\nparties and the documents on record, more particularly, the impugned<br \/>\norder, it clearly transpires that the suit of the plaintiffs came to<br \/>\nbe dismissed for default as the concerned advocate appearing for the<br \/>\nplaintiffs did not attend the suit and did not remove the office<br \/>\nobjections raised in the suit. Not only that, even after the<br \/>\ndismissal of the suit, the said advocate did not inform the<br \/>\nplaintiffs and, therefore, the plaintiffs were absolutely unaware<br \/>\nabout the dismissal of the suit. It was also stated by the plaintiffs<br \/>\nin the application seeking restoration of the suit that when they<br \/>\ncame to know about the said dismissal of the suit, they applied for<br \/>\nthe certified copies of the proceedings and had come to know that the<br \/>\nconcerned advocate appearing for them had not paid process fees and<br \/>\nhad not removed the office objections raised by the Registry, which<br \/>\nhad resulted into dismissal of the suit. Having regard to the facts<br \/>\nand averments made by the plaintiffs on affidavit, it clearly<br \/>\ntranspires that there was sheer negligence and carelessness on the<br \/>\npart of the learned advocate appearing for the plaintiffs at the<br \/>\nrelevant time. It cannot be gainsaid that the party should not be<br \/>\nmade to suffer for the negligence and carelessness of the advocate.<br \/>\nThe lower Court ought to have considered the said reasons as the<br \/>\nsufficient cause for condonation of delay and for the restoration of<br \/>\nthe suit in the interest of justice. It appears that the lower Court<br \/>\nunfortunately dismissed the application on technical grounds without<br \/>\nconsidering the negligence of the then learned advocate for the<br \/>\nplaintiffs. The said order being perverse, leading to miscarriage of<br \/>\njustice, deserves to be set aside.\n<\/p>\n<p>6.\tFor<br \/>\nthe reasons stated above, order dated 30.07.2004 passed by the<br \/>\nlearned Judge, Court No.12, City Civil Court, Ahmedabad in Civil<br \/>\nMisc. Application No.507 of 2002 is quashed and set aside and the<br \/>\nsaid Civil Misc. Application No.507 of 2002 is allowed, restoring<br \/>\nCivil Suit No.6051 of 1997 on file.\n<\/p>\n<p>7.\tAccordingly,<br \/>\nthe said suit shall be proceeded further in accordance with law. This<br \/>\nCivil Revision Application stands allowed.
