Since both the appeals arise out of<\/p>\n<p>                  the common order, both the appeals are being<\/p>\n<p>                  disposed of by the common order.<\/p>\n<p>                            The     present     appeals        have      been<\/p>\n<p>                  preferred       under     Section     299     of     India<\/p>\n<p>                  Succession       Act    against      an     order    dated<\/p>\n<p>                  22.10.2009 passed in Probate Case No.17 of<\/p>\n<p>                  2007     by     A.D.J.\/F.T.C.       Vth,     Lakhisarai,<\/p>\n<p>                  whereby the prayer of           the appellants for<\/p>\n<p>                  intervention was dismissed.<\/p>\n<p>                            Shri    Umesh     Prasad    Singh,        learned<\/p>\n<p>                  Senior    Counsel       appearing      on     behalf    of<\/p>\n<p>                  respondent no.2, while referring to averment<\/p>\n<p>                  made in paragraph-6 of the affidavit filed<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        on behalf of respondent no.2 submits that<\/p>\n<p>        during pendency of the present appeals, the<\/p>\n<p>        probate case has already               been    decided by<\/p>\n<p>        judgment dated 30.6.2010. He further points<\/p>\n<p>        out that a suit vide Title Suit No.76 of<\/p>\n<p>        2010 has been preferred for declaration of<\/p>\n<p>        the title and confirmation of possession and<\/p>\n<p>        same is also pending.\n<\/p>\n<p>                   In   view     of    the    fact    that    during<\/p>\n<p>        pendency of the present appeals, the probate<\/p>\n<p>        case has already been decided, no purpose<\/p>\n<p>        would   be      served    in     keeping      the     matter<\/p>\n<p>        pending,     which      were    filed    primarily        for<\/p>\n<p>        setting aside of an order whereby prayer for<\/p>\n<p>        intervention\/addition            of     party        of   the<\/p>\n<p>        appellant in probate case was rejected.<\/p>\n<p>                   The court is of            the opinion that<\/p>\n<p>        both    the          appeals     have        now      become<\/p>\n<p>        infructuous.\n<\/p>\n<p>                   Accordingly, both the appeals stand<\/p>\n<p>        disposed of.\n<\/p>\n<\/p>\n<pre>N.H.\/                        ( Rakesh Kumar,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sri Surendar Singh &amp; Ors. vs The State Of Bihar &amp; Anr. on 17 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Miscellaneous Appeal No.419 of 2010 Kailash Devi wife of Shyam Nandan Singh, resident of village Jaitpur, P.S.
