SEMA &amp; MARKANDEY KATJU\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<br \/>\nO R D E R<\/p>\n<p>CIVIL APPEAL NO.5707 OF 2002<\/p>\n<p>\tHeard the parties.\n<\/p>\n<p>\tThis appeal is filed by the defendants against the judgment passed by the High<br \/>\nCourt in Second Appeal. The plaintiffs&#8217; suit was dismissed by the trial court.  In<br \/>\nappeal the First Appellate Court confirmed the decree of the trial court.  Aggrieved<br \/>\nthereby, the plaintiffs filed Second Appeal before the High Court.<br \/>\n\tThe High Court framed a substantial question of law as under :\n<\/p>\n<p>1.\tIt is open to the appellants to challenge the sale on the following<br \/>\ngrounds :\n<\/p>\n<p>a)The property was subject to mortgage and there was<br \/>\ncontravention of the sections 35 and 85 of the Karnataka Co-<br \/>\noperative Societies Act, 1959.\n<\/p>\n<p>b)The sale was in breach of Order 21 Rule 64 CPC on the ground<br \/>\nthat the property sold was worth much more than the amount<br \/>\nsought to be recovered.\n<\/p>\n<p>c)Status as debtor of the father of the appellants who suffered<br \/>\ndecree for money?\n<\/p>\n<p>2.\tWhether the decree made by the lower appellate court is vitiated<br \/>\nfor its failure to consider the points involved in question No.1?<br \/>\n\tAt the time of hearing of the Second Appeal the High Court has also framed<br \/>\nthe additional substantial question of law reads :<br \/>\n&#8220;12.\tThe question of law was framed as mentioned<br \/>\nsupra. At the time of hearing, one more question was framed<br \/>\nand the counsel was directed to address arguments on the basis<br \/>\nof that question as well. The question is :\n<\/p>\n<p>&#8220;Once a property is found to be ancestral property whether<br \/>\nthat the property of the minors who get the right by birth<br \/>\ncould be brought to sale ?&#8221;\n<\/p>\n<p>\tIt is submitted that the property is ancestral property and the father was<br \/>\nacting as Manager and Karta of the family. If that is the case the question of<br \/>\nframing the additional substantial question of law would not arise.  Similarly, the<br \/>\nsubstantial question of law as framed by the High Court, a),b) and c), referred to<br \/>\nabove, in our view, does not constitute the substantial question of law as<br \/>\ncontemplated under Section 100 CPC.  We, therefore, set aside the order of the<br \/>\nHigh Court and remand the case to the High Court to frame fresh substantial<br \/>\nquestion of law strictly compliance of Section 100 CPC, if any, and decide the<br \/>\nappeal afresh.  The order of the High Court is accordingly set aside.<br \/>\n\tThe appeal is allowed. No costs.
