(ORAL)\n<\/pre>\n<p>                 Vide impugned order dated 16.02.2009, the Motor<\/p>\n<p>Accident Claims Tribunal, has permitted the claimant-respondent to<\/p>\n<p>withdraw the claim petition with liberty to file a fresh petition on<\/p>\n<p>account of technical flaw.\n<\/p>\n<p>                 Counsel for the petitioner has contended that the<\/p>\n<p>said permission has been granted contrary to the provisions of Order<\/p>\n<p>23 Rule 1 CPC.\n<\/p>\n<p>                 The respondent had not been able to point out any<\/p>\n<p>formal defect or any technical flaw. The claimant-respondent had led<\/p>\n<p>evidence and produced witnesses, but on 16.02.2009, instead of<\/p>\n<p>                               &#8230; 1<br \/>\n C.R.No.3039 of 2009<\/p>\n<p>producing the witnesses of the claimant, counsel for the claimant<\/p>\n<p>made a statement for withdrawal of the claim petition with a request<\/p>\n<p>for permission to file fresh one.\n<\/p>\n<p>                  I have heard counsel for the petitioner as well as<\/p>\n<p>counsel for the respondents.\n<\/p>\n<p>                  Counsel for the respondents has submitted that on<\/p>\n<p>account of improper verification as required under Order      Rule 14<\/p>\n<p>CPC, and other technicalities which have though not been noted in<\/p>\n<p>the order, the respondent-claimant wanted to withdraw the petition<\/p>\n<p>and file a fresh one.\n<\/p>\n<p>                  Without expression of any opinion regarding the<\/p>\n<p>technical flaws, I do not deem appropriate to interfere in the order.<\/p>\n<p>However, I am of the opinion that the claim Tribunal, should have<\/p>\n<p>ordered the deposit of costs in case fresh claim petition is filed on<\/p>\n<p>the same cause of action.\n<\/p>\n<p>                  I do not find any ground to interfere in the order<\/p>\n<p>dated 16.02.2009, because it has been informed by counsel for the<\/p>\n<p>respondents that the fresh petition has been filed and the written<\/p>\n<p>statement has also been filed by the petitioner.<\/p>\n<p>                  In view of the above circumstances, this petition is<\/p>\n<p>disposed of having rendered infructuous.<\/p>\n<p>                                              (M.M.S.BEDI)<br \/>\n                                                 JUDGE<br \/>\nAugust 17, 2009.\n<\/p>\n<p>rka<\/p>\n<p>                                    &#8230; 2\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Lakhbir Singh vs Davinder Kaur And Others on 17 August, 2009 C.R.No.3039 of 2009 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH C.R.No.3039 of 2009.
