No. II-147\/2010,<br \/>\nregistered with Bharuch City &#8216;A&#8217; Division Police Station, Bharuch,<br \/>\nfor the offences punishable under Sections-302, 323, 504, 506(2),<br \/>\n143, 147, 148, 149, 452 and 325 of the Indian Penal Code,<br \/>\nSections-135 of the Bombay Police Act and Section-3(2)(5) of the<br \/>\nScheduled Castes and Scheduled Tribes (Prevention of Atrocities Act),<br \/>\n1989.\n<\/p>\n<p>2.\t\tThe<br \/>\ncomplaint was lodged by one Bhavik Ashokchandra Parmar, alleging<br \/>\nthat, on the date of alleged incident i.e. on 08.08.2010, when he<br \/>\nwas, in the evening hours, at his home, two persons namely, one<br \/>\nAkshaybhai and Nareshbhai (&#8216;Nareshbhai&#8217;, being the present<br \/>\npetitioner) came with two more persons and started quarreling with<br \/>\nhim and started beating him with sticks. Sticks blows were given on<br \/>\nthe head, legs, hands and also on the chest. His family members<br \/>\nintervened and saved him from further beating. These people,<br \/>\nthereafter, left the house, giving threats.\n<\/p>\n<p>3.\t\tOn<br \/>\n13.08.2010, the complainant succumbed to the injuries, while, still,<br \/>\nunder the treatment.  The Investigating Officer, therefore, submitted<br \/>\na report for addition of Section-302 of the Indian Penal Code.\n<\/p>\n<p>4.\t\tLearned<br \/>\nCounsel for the petitioner submitted that the investigation is over<br \/>\nand the charge-sheet is filed.  The petitioner, therefore, be<br \/>\nreleased on bail. He relied on a bail order dated 29.12.2010, passed<br \/>\nby this Court(Coram: Hon&#8217;ble Mr. Justice Anant S. Dave) in Criminal<br \/>\nMiscellaneous Application No. 15056 of 2010, passed in the case of<br \/>\none co-accused.\n<\/p>\n<p>5.\t\tFrom<br \/>\na perusal of the material on record, however, I find that there are<br \/>\ndirect allegations against the present petitioner of having given<br \/>\nstick blows to the deceased, along with other co-accused Akshay.<br \/>\nMoreover, the complaint is lodged by the deceased himself, who later<br \/>\non succumbed to the injuries. Further, the stick blows were given on<br \/>\nall parts of the body.  The case of the co-accused is clearly<br \/>\ndistinguishable. He is neither named in the FIR nor any direct role<br \/>\nis attributed to him.  It was, therefore, in the case of one<br \/>\nPravinbhai Lallubhai Vasava and another(who were not named in the<br \/>\nFIR) this Court granted bail, making following observations:\n<\/p>\n<p>&#8220;5.\t\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and as per  the post mortem report, the injuries to lungs and<br \/>\ncomplications which had arisen due to multiple injuries and the role<br \/>\nattributed to the applicant and the charge sheet is filed, I am<br \/>\ninclined to enlarge the applicants on bail.&#8221;\n<\/p>\n<p>6.\t\tThe<br \/>\ncase of the present petitioner is different.    The deceased himself<br \/>\nhad filed the complaint, before his death, involving the present<br \/>\npetitioner and one Akshay and also described their role.\n<\/p>\n<p>7.\t\tUnder<br \/>\nthe circumstances, no case, for granting bail, is made out.  This<br \/>\npetition stands DISMISSED.
