impugned judgment and award dated 18.7.2006. <\/p>\n
No.95\u20aca\/2002 passed by the E Addl.\n<\/p>\n
Member, MACT II, Mangalore ((hefeiIi_afi\u00abef*\u00abireferted<\/p>\n
‘Tribunal’ for short).\n<\/p>\n
2. The Tribunal by  and

against.ti1e_ci’airh’:\u00a2iof ti1e’~clai\ufb011*ahts for ?18,00,000\/– on
\naccountof the  of4V_th:e”deceased late Sri.Abdul Jalal<\/p>\n
in the roadtzeaffici accivderit. The claimants claiming that<\/p>\n
 i.Vthe._’:giua:_Iitu.m ot’V’coh1pensation awarded by the Tribunal<\/p>\n
 have presented this appeal.\n<\/p>\n
   facts of the case are :-\n<\/p>\n
Civaiimant; No.1 is the wife, claimants 2 to 6 are the<\/p>\n
 children and ciaimants 7 and 8 are the parents of<\/p>\n
   deceased. They filed claim petition under Section<\/p>\n
V’ 166 of the MN. Act ciaiming cornpeI1sai’.ion on account.<\/p>\n
of the death of the deceased cxozitezidirag that,, on<\/p>\n
28.4.2002 at about 3.30 am. when the deceased was<\/p>\n

Mangalore and when he reached near Rajapura<\/p>\n
on Bangaloreivlangalore road in Chenn_araya'p',a–t.na.._g' i.<\/p>\n
Taluk, at that time, the bus bearing'  if<\/p>\n
driven by its driver in a high speed:-and in. a _r'ash~vl'i_a1fi1d.:<\/p>\n
negligent manner, came frorH,_iopposii,\u20ac._sideV-froinrwyong " V<\/p>\n
side and dashed against they–lorry and dn'evvt.o..Vtl1e said
\nimpact, the lorry was  and the<\/p>\n
deceased sustaii-riled giiievoiis injuiifi.es'and succumbed to<\/p>\n
the same-_ the further case of the<\/p>\n
claimants' that tVl'1e."'d'ecea\u00bbsed was aged about 36 years,<\/p>\n
 owner–ucu:n–driVlerv"earning ?l5,00()\/~ p.m. He was the<\/p>\n
 *soVIe.Vbrevad'vyinner in the family. Due to his untimely<\/p>\n
  telaimants have suffered socially and<\/p>\n
 econoifnically severeiy, The first claimant, being the<\/p>\n
if  lost her husband at the young age, claimants<\/p>\n
  to 6, being the children have lost the love and<\/p>\n
 affection of their father, their security in life and their<\/p>\n
expectation. and guidance of their father and their<\/p>\n

parents. senior citizens. instead of seeing the progress
\nof their son have lost their son during their life time.<\/p>\n
The Tribunal taking into consideration a_ll\u00bb.t”h_es_e<\/p>\n
relevant. aspects, after assessing the gorapl’<\/p>\n
documentary evidence and other ..re_leVa:’1t”1i1*ateri’al’_”\u00bbon_ it<\/p>\n
file, has allowed the claim petitioliap in:<\/p>\n
compensation and the elainianlts not ‘beingVsati”s..fie’di With ” V<\/p>\n
the quantum of c0mpensaticn’p_’*.li’aV.e pres–en,ted this
\nappeal, as stated supra.’ it  l<\/p>\n
5. We  heard’  V’c’e-unsel appellants<\/p>\n
and the -_ learn.e”d_h*counsel’ for the insurer for a
\nconsiderabl_e ‘length of “ClI;i_}v\u20ac.<\/p>\n
 After careful’pc:0nsideration of the submission of<\/p>\n
 ‘the~1ea.1jned.,:c’ounsel on both sides and after perusal of<\/p>\n
the  award of the Tribunal. what emerges<\/p>\n
 is t.h’at; thehoccurrence of the accident, resultant death of<\/p>\n
A i~:lj’\u00bbi’hel”deceased on account of the injuries sustained by<\/p>\n
‘  him in the accident are not in dispute. Further. the age<\/p>\n
 and occupation of the deceased are also not in dispute.<\/p>\n
However. the Tribunal has assessed the income of the<\/p>\n
cleceased at ?5,OOO\/W pm. which is on the lower side.<\/p>\n

Having regard to the age, occupation, year of occurrence
