{"id":110892,"date":"2010-09-06T00:00:00","date_gmt":"2010-09-05T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ratan-lal-soni-vs-the-state-of-madhya-pradesh-on-6-september-2010"},"modified":"2019-03-04T16:39:56","modified_gmt":"2019-03-04T11:09:56","slug":"ratan-lal-soni-vs-the-state-of-madhya-pradesh-on-6-september-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ratan-lal-soni-vs-the-state-of-madhya-pradesh-on-6-september-2010","title":{"rendered":"Ratan Lal Soni vs The State Of Madhya Pradesh on 6 September, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Ratan Lal Soni vs The State Of Madhya Pradesh on 6 September, 2010<\/div>\n<pre>                          W.P.No.11241\/2010\n\n\n   Ratan Lal Soni                           State of M.P. &amp; others\n\n\n\n\n6.9.2010\n       Shri S.P.Sinha and Shri Ashok Sinha, counsel for petitioner.\n       Shri T.S.Ruprah, learned Senior Advocate with Shri Harmeet\nRuprah, counsel for respondent no.3 to 17.<\/pre>\n<p>       This petition is directed against an order dated 13.7.2010 by<br \/>\nwhich the petitioner&#8217;s application under Order 6 Rule 17 C.P.C., was<br \/>\nrejected.\n<\/p>\n<p>       Learned counsel for petitioner submitted that the proposed<br \/>\namendment was necessary to decide the dispute between the parties.<br \/>\nThe petitioner has taken alternative plea in the plaint, but the trial<br \/>\nCourt erred in rejecting the application.\n<\/p>\n<p>       Learned counsel appearing for respondent nos.3 to 17<br \/>\nsupported the order and submitted that the case of plaintiff was very<br \/>\nspecific that the disputed house was constructed by the petitioner on<br \/>\nsurvey no.111\/3 of village Chhota Chhindwara, but now the petitioner<br \/>\nwants to change the stand in respect of his possession on the land<br \/>\nsurvey no.109\/2 and 111\/2 of same village, which has been rightly<br \/>\nrejected by the trial Court.\n<\/p>\n<p>       From the perusal of pleadings, it appears that the plaintiff filed<br \/>\na suit in respect of house which was constructed by the petitioner on<br \/>\nsurvey no.111\/3. Now the petitioner wants to amend the pleadings<br \/>\nby taking an alternate plea that in case the house is found on survey<br \/>\nnos.111\/2 or 109\/2, even then the order passed by the Tehsildar<br \/>\ndirecting dispossession of petitioner from the disputed land be<br \/>\ndeclared as void. It appears that the plea raised by the petitioner is<br \/>\nan alternate.   The trial has not commenced and only issues have<br \/>\nbeen framed.        In view of aforesaid the petitioner is entitled for<br \/>\namendment of pleadings. So far as belated filing of application is<br \/>\nconcerned, for this purpose heavy cost can be imposed on the<br \/>\n                         W.P.No.11241\/2010<\/p>\n<p>   Ratan Lal Soni                          State of M.P. &amp; others<\/p>\n<p>petitioner.\n<\/p>\n<p>       In view of aforesaid, the impugned order passed by the trial<br \/>\nCourt rejecting the application of petitioner for amendment is set<br \/>\naside and it is directed that the petitioner shall be permitted to amend<br \/>\nthe pleadings, but on payment of costs, which we quantify Rs.1,000\/-<br \/>\n(Rupees one thousand only) payable by the petitioner to the other<br \/>\nside within a period of thirty days from today.
