Respondents\n                                  ----------------------------------\n<\/pre>\n<p>02\/   26.09.2011               Heard learned counsel for the petitioner<\/p>\n<p>                    and the State, who has filed counter affidavit duly<\/p>\n<p>                    affirmed by the Regional Deputy Director of<\/p>\n<p>                    Education, Tirhut Division on 19.9.2011 without<\/p>\n<p>                    serving copy thereof in advance on the learned<\/p>\n<p>                    counsel for the petitioner. In the circumstances,<\/p>\n<p>                    averments made therein are not to be taken into<\/p>\n<p>                    consideration as learned counsel for the State is not<\/p>\n<p>                    ready to pay cost to the learned counsel for the<\/p>\n<p>                    petitioner for delayed service of the counter affidavit<\/p>\n<p>                    on the learned counsel for the petitioner.<\/p>\n<p>                               Petitioner superannuated while serving on<\/p>\n<p>                    the post of Block Education Extension Officer in the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Lower Division of the Bihar Subordinate Education<\/p>\n<p>Service with effect from 31.1.1995. He has filed this<\/p>\n<p>writ petition praying, inter alia, to direct the<\/p>\n<p>authorities of the State to consider his case for<\/p>\n<p>granting him seniority in the Bihar Subordinate<\/p>\n<p>Education Service from the year 1975 as was done in<\/p>\n<p>case of those who were brought to the Lower<\/p>\n<p>Division of the Bihar Subordinate Education Service<\/p>\n<p>in the first transaction.\n<\/p>\n<p>           It is submitted on behalf of the petitioner<\/p>\n<p>that his aforesaid prayer was not being considered by<\/p>\n<p>the State- authorities as petitioner was not confirmed<\/p>\n<p>in the Lower Division of the Bihar Subordinate<\/p>\n<p>Education Service which confirmation has come to<\/p>\n<p>the petitioner and others under order bearing Memo<\/p>\n<p>No. 105 dated 21.1.2011 annexed along with the<\/p>\n<p>supplementary affidavit, copy whereof was served on<\/p>\n<p>the counsel for the State on 12.9.2011.<\/p>\n<p>           Having heard counsel for the parties,<\/p>\n<p>petitioner is directed to represent before the Director,<\/p>\n<p>Primary Education, Bihar, Patna for granting him<\/p>\n<p>seniority and consequential benefit with effect from<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>         the year 1975 annexing a copy of this order as also<\/p>\n<p>         the order dated 21.1.2011, whereafter the Director,<\/p>\n<p>         Primary Education shall pass appropriate order in the<\/p>\n<p>         matter as early as possible in any case within two<\/p>\n<p>         months from the date of receipt of the representation<\/p>\n<p>         along with a copy of this order. In case, petitioner is<\/p>\n<p>         allowed seniority from the earlier time, he be paid<\/p>\n<p>         consequential benefit until the date of superannuation<\/p>\n<p>         i.e. 31.1.1995 as also his pension be revised within<\/p>\n<p>         the same time.\n<\/p>\n<\/p>\n<pre>Arjun\/                                    ( V.
