Heard learned counsel for the petitioners in all<\/p>\n<p>                             the three quashing applications and also learned counsel<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>for the State. Notice has been served on the Opposite<\/p>\n<p>Party No.2, the Complainant and he has appeared<\/p>\n<p>through counsels in two of the cases. The names of the<\/p>\n<p>counsels appear in the daily cause list but they have<\/p>\n<p>chosen not to appear and contest these applications.<\/p>\n<p>          2. Prayer in all these applications filed under<\/p>\n<p>section 482 of the Code of Criminal Procedure is for<\/p>\n<p>quashing the entire criminal prosecution against the<\/p>\n<p>petitioners in a complaint case bearing No. C 658\/97<\/p>\n<p>pending before Chief Judicial Magistrate, Bhagalpur<\/p>\n<p>relating to offences under sections 420, 406 of the Indian<\/p>\n<p>Penal Code and also for quashing of order of cognizance<\/p>\n<p>dated 30-9-1997.\n<\/p>\n<p>          3. On behalf of the petitioners, it has been<\/p>\n<p>submitted that a perusal of the entire complaint petition<\/p>\n<p>would show that the complainant claims to be a<\/p>\n<p>contractor with whom the four petitioners as Engineers<\/p>\n<p>and employees under the Bihar State Agriculture<\/p>\n<p>Marketing Board entered into an agreement for<\/p>\n<p>execution of a civil work and pursuant to such agreement<\/p>\n<p>dated   6-9-88 the complainant begun the contract work<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>and was paid an amount of Rs. 1, 75, 234\/- but thereafter<\/p>\n<p>his work was neither measured nor his outstanding bills<\/p>\n<p>were paid and this was followed by the accused persons<\/p>\n<p>getting the contract work completed departmentally<\/p>\n<p>causing loss to the complainant-contractor to the tune of<\/p>\n<p>Rs. 1, 94, 320\/- for which he gave notice but in vain.<\/p>\n<p>          4. It has been submitted on behalf of the<\/p>\n<p>petitioners that the allegations in the complaint petition<\/p>\n<p>disclose at best a breach of agreement executed between<\/p>\n<p>the parties due to subsequent dispute on account of a<\/p>\n<p>boundary wall being constructed at a different point than<\/p>\n<p>the specified place by the Marketing Board and hence for<\/p>\n<p>such breach of contract, only a civil liability could have<\/p>\n<p>been maintained against the petitioners or the Marketing<\/p>\n<p>Board and no criminal offence is made out on the basis<\/p>\n<p>of allegations noticed above.\n<\/p>\n<p>          5. Learned counsel for the State has submitted<\/p>\n<p>that the complainant has mentioned in paragraph 1 of the<\/p>\n<p>complaint petition that he was assured and convinced by<\/p>\n<p>an agreement dated 6-9-88 that on performance of his<\/p>\n<p>work he would be paid the agreed amount and since that<br \/>\n<span class=\"hidden_text\">                   4<\/span><\/p>\n<p>was not done the complainant is justified in alleging that<\/p>\n<p>he has been cheated by the accused persons.<\/p>\n<p>          6. No doubt the word &#8220;assurance&#8221; has been<\/p>\n<p>mentioned by the complainant in paragraph 1 but such<\/p>\n<p>assurance was not a verbal assurance and it was duly<\/p>\n<p>entered by way of formal agreement. Clearly, there was<\/p>\n<p>no dishonest intention at the beginning of transaction<\/p>\n<p>because the complainant has admitted that in the<\/p>\n<p>beginning his work was supervised and measured and he<\/p>\n<p>was paid on account a huge amount of Rs. 1. 7 lacs and<\/p>\n<p>odd. Admittedly, there was a dispute over situation of the<\/p>\n<p>boundary wall and the complainant has admitted that he<\/p>\n<p>shifted the boundary wall at a considerable distance on<\/p>\n<p>the dictates of Sub-divisional Officer\/ Chairman, Bazar<\/p>\n<p>Samiti, Pakur. Whether the dispute was justified or not is<\/p>\n<p>not the subject matter of enquiry for the purpose of<\/p>\n<p>considering the present application of the petitioners<\/p>\n<p>under section 482 of the Code of Criminal Procedure.<\/p>\n<p>The issue is whether they were working with dishonest<\/p>\n<p>intention from the very inception of the contract or not.<\/p>\n<p>The facts mentioned in the complaint petition show that<br \/>\n<span class=\"hidden_text\">                    5<\/span><\/p>\n<p>differences arose at a later stage and on account of such<\/p>\n<p>differences the contractor was not allowed to work or<\/p>\n<p>was not paid further money. In paragraph 10 the<\/p>\n<p>complainant has made a grievance that the accused<\/p>\n<p>persons ought to have stopped the work of the<\/p>\n<p>complainant or cancelled the agreement before getting<\/p>\n<p>the work done by the department causing loss to the<\/p>\n<p>complainant. This may be a ground for claiming<\/p>\n<p>damages through properly constituted civil suit before a<\/p>\n<p>competent civil court but on such allegation it is difficult<\/p>\n<p>to hold that any criminal offence is made out against the<\/p>\n<p>petitioners who are working only in the capacity of<\/p>\n<p>Executive     Engineer,   Assistant    Engineer,    Market<\/p>\n<p>Secretary and Chief Engineer of the concerned<\/p>\n<p>organization.\n<\/p>\n<p>            7. Considering all the facts and circumstances<\/p>\n<p>and the submissions noticed above, this court has no<\/p>\n<p>difficulty in holding that the facts alleged in the<\/p>\n<p>complaint petition when considered in their substance do<\/p>\n<p>not make out any criminal offence either of breach of<\/p>\n<p>trust or cheating against the petitioners.
