JUSTICE R.M.DOSHIT)<\/p>\n<p>\t\tThis<br \/>\nAppeal preferred under Clause 15 of the Letters Patent arises from<br \/>\nthe judgment and order dated 21st September, 2005 passed<br \/>\nby the learned Single Judge in Special Civil Application No.5584 of<br \/>\n1986.\n<\/p>\n<p>\t\tThe<br \/>\nappellants writ petitioners were the tenants of the erstwhile<br \/>\nGirasdar of Kotdapitha. The dispute centres around the claim made by<br \/>\nthe respondent Girasdar for allotment of more land for personal<br \/>\ncultivation and the decision of the authority below that the Girasdar<br \/>\nwas entitled to retain 80 acres of land. The order of the authority<br \/>\nbelow has been confirmed by the Gujarat Revenue Tribunal in Revision<br \/>\nApplication No.375 of 1977 by judgment and order dated 1st<br \/>\nMay, 1986. The learned Tribunal upheld that the Girasdar was entitled<br \/>\nto 80 acres of land. However, ordered the remand of the matter to<br \/>\nascertain whether the lands of Kharaba and Bid lands would be part of<br \/>\nthe land given to the Girasdar for personal cultivation.\n<\/p>\n<p>\t\tFeeling<br \/>\naggrieved by the finding that the Girasdar was entitled to retain 80<br \/>\nacres of land for personal cultivation, the appellants preferred the<br \/>\nabove Special Civil Application No.5584 of 1986 which has been<br \/>\nrejected by the learned Single Judge by the impugned judgment and<br \/>\norder. The learned Single Judge has, relying upon the judgment of<br \/>\nthis Court in Special Civil Applications No.305 and 368 of 1962,<br \/>\nconfirmed the said finding. Therefore, the present Appeal.\n<\/p>\n<p>\t\tMr.Hathi<br \/>\nhas submitted that the above referred judgment of the High Court<br \/>\npassed in Special Civil Applications No.305 and 368 of 1962 requires<br \/>\nreconsideration. The appeal, therefore, be admitted.\n<\/p>\n<p>\t\tWe<br \/>\nare unable to agree with Mr.Hathi. No case for interference is made<br \/>\nout. The Appeal is dismissed in limine.
