Being aggrieved by the order made by the learned<br \/>\n     Single Judge in Civil Application No. 3753 of 1992 in<br \/>\n     First Appeal (Stamp) No.     4861 of 1992, the appellants<br \/>\n     have preferred this appeal. By an order dated 13.1.1994,<br \/>\n     the learned Single Judge rejected       the   application<br \/>\n     submitted by the appellant under Section 5 of the<br \/>\n     Limitation Act for condonation of delay. It seems that<br \/>\n     on the ground that the appellants have abandoned the idea<br \/>\n     of preferring an appeal and after the lapse of about 9<br \/>\n     months, they thought it fit to take a chance before the<br \/>\n     High Court by preferring appeal, the learned Single Judge<br \/>\n     arrived at a conclusion that it is a fit case where delay<br \/>\n     is not required to be condoned. No doubt that the appeal<br \/>\n     is preferred after the prescribed period of limitation.\n<\/p><\/blockquote>\n<p>     It may be noted that the appeal was preferred by the<br \/>\n     appellants as indigent persons and the order passed by<br \/>\n     the learned Single Judge was exparte order.        It is<br \/>\n     contended in the application preferred under Section 5 of<br \/>\n     the Limitation Act that the applicants are illiterate and<br \/>\n     are residing at a distant village in Talaja taluka. It<br \/>\n     was further contended that with a        view   to   earn<br \/>\n     livelihood, the applicant no.     1 who was looking after<br \/>\n     the litigation had been to Surat and\/or Valsad district<br \/>\n     and was working as a labourer in the field of sugarcane.<br \/>\n     The said place was far away from the place where the<br \/>\n     applicant was residing.     It is also contended that the<br \/>\n     advocate was engaged by them and applicant no. 1 did not<br \/>\n     come to know about the disposal of the suit as he was in<br \/>\n     Surat and\/or Valsad district. It is also contended that<br \/>\n     the applicant no.1 was under bonafide impression that the<br \/>\n     suit was not disposed of till the inquiry was made on 1st<br \/>\n     February, 1992.\n<\/p>\n<p>     #. In view of these facts, we allow this appeal and the<br \/>\n     order made by the learned Single Judge is quashed and set<br \/>\n     aside.    Resultantly,   the   application namely Civil<br \/>\n     Application No. 3753 of 1992 submitted by the appellants\n<\/p>\n<p>     &#8211; original applicants shall be placed for admission and<br \/>\n     the learned Single Judge shall pass appropriate order in<br \/>\n     the said Civil Application.\n<\/p>\n<p>     [B.C.
