Petitioner is a commissioned officer in the Indian Army and<br \/>\nholds the rank of a Lieutenant Colonel. He works in the Corps Of<br \/>\nSignals.\n<\/p>\n<p>2.     With respect to equipments needed by the Indian Army, it<br \/>\nworks very closely with Directorate General of Quality Assurance<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 3929\/2011                                             1<\/span><br \/>\n (DGQA) and to bring synergy between the two departments,<br \/>\ntechnically qualified officers of the Indian Army are sent, from<br \/>\ntime to time, on deputation to DGQA. Permanent absorption of<br \/>\nofficers of the armed forces in DGQA is one of the mode of<br \/>\nappointment in DGQA.\n<\/p>\n<p>3.     The petitioner has a domestic problem, in that, he has an<br \/>\nold and ailing mother who suffers from various medical problems<br \/>\nas also a wife having medical problems.\n<\/p>\n<p>4.     It is not in dispute that the armed forces have always been<br \/>\nsympathetic        to   the   petitioner   and   for   said   reason   have<br \/>\naccommodated him at Delhi for long durations.\n<\/p>\n<p>5.     Realizing that he cannot be permanently stationed at Delhi,<br \/>\nway back in the year 2006, petitioner sought premature<br \/>\nretirement, for the obvious reason, he found it difficult to cope up<br \/>\nwith his work in the Indian Army as also his domestic<br \/>\nresponsibilities. The request for premature retirement was<br \/>\nrejected.\n<\/p>\n<p>6.     Fortunately for the petitioner a proposal materialized<br \/>\nwherein he could be at Delhi. On 11.1.2008, for tenure of 3 years,<br \/>\npetitioner was sent on deputation to DGQA.\n<\/p>\n<p>7.     The Indian Army required hands in the Corps of Signals.<br \/>\nCurtailing the tenure to 2 years, vide order dated 12.1.2010<br \/>\npetitioner was repatriated to the Corps of Signals. Representation<br \/>\nfiled by him was rejected.\n<\/p>\n<p>8.     In April 2010, DGQA constituted a Board to consider<br \/>\npermanent secondment of such armed forces personnel who<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 3929\/2011                                                    2<\/span><br \/>\n were found fit for permanent absorption in DGQA. The Board<br \/>\nfound petitioner fit to be absorbed in DGQA as per Board&#8217;s<br \/>\nrecommendations dated 28.4.2010.\n<\/p>\n<p>9.     Needless to state, being a permanently commissioned<br \/>\nofficer in the Indian Army, unless Indian Army formally releases<br \/>\nthe petitioner for permanent secondment in DGQA, he could not<br \/>\nbe the beneficiary of the Board decision dated 28.4.2010.\n<\/p>\n<p>10.    Requisition sent by DGQA with respect to the Board&#8217;s<br \/>\nopinion dated 24.8.2010 to the Indian Army was responded to by<br \/>\nthe Indian Army on 28.8.2010. Unfortunately for the petitioner,<br \/>\nthe Indian Army declined to accord its approval for petitioner&#8217;s<br \/>\npermanent secondment in DGQA.\n<\/p>\n<p>11.    Reason given by the Armed Forces was that it functions in a<br \/>\ncommand hierarchy which is ego centric and it normally<br \/>\nrecommends permanent secondment of such officers who are<br \/>\nsuperceded. The obvious reason is that these officers who are<br \/>\nsuperceded become junior to other erstwhile juniors and this<br \/>\ncauses ego clashes. It was pleaded that petitioner&#8217;s requirement<br \/>\nin the Army was necessary in public interest.\n<\/p>\n<p>12.    Petitioner filed W.P.(C)No.6564\/2010 in this Court, titled<br \/>\nS.Ahluwalia Vs. Union of India &amp; Ors. The writ petition was<br \/>\ndisposed of vide order dated 4.2.2011 finding merit in the stand<br \/>\ntaken by the army authorities who generally accord permission<br \/>\nfor permanent absorption in DGQA of such officers who were<br \/>\nsuperceded.\n<\/p>\n<p>13.    However, the extreme family hardship of the petitioner was<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 3929\/2011                                           3<\/span><br \/>\n noted and thus while disposing of the writ petition it was directed<br \/>\nthat in view of the observations made in the decision, which were<br \/>\npeculiar to the petitioner, the matter may be reconsidered for<br \/>\npetitioner&#8217;s secondment under DGQA. Alternatively, it was<br \/>\nproposed that if petitioner was to re-seek premature retirement,<br \/>\nthe same should be considered in the alternative.\n<\/p>\n<p>14.    Reconsidering the matter, vide impugned order dated<br \/>\n29.3.2011,      the     army    authorities   have declined    permanent<br \/>\nsecondment of the petitioner to DGQA.\n<\/p>\n<p>15.    Instant writ petition was immediately filed praying that the<br \/>\ndecision dated 29.3.2011 be quashed.\n<\/p>\n<p>16.    In the counter affidavit filed, the Indian Army disclosed to us<br \/>\nthat in May 2011, DGQA had requested Military Secretary Branch<br \/>\nof Army Headquarters to intimate availability of officers who have<br \/>\nconcluded 2 year&#8217;s tenure with DGQA and in response thereto,<br \/>\nthe    petitioner       was    made   available   for   consideration   for<br \/>\npermanent secondment in DGQA.\n<\/p>\n<p>17.    In other words, the Indian Army informed this Court that it<br \/>\nhas no objection if petitioner proceeds on permanent secondment<br \/>\nto DGQA.\n<\/p>\n<p>18.    On 11.8.2011, the selection Board of DGQA met and<br \/>\nconsidered the names of various persons including that of<br \/>\npetitioner for permanent secondment in DGQA. The Board noted<br \/>\nthat the petitioner had already been found fit for permanent<br \/>\nsecondment at the Board meeting which was held on 28.4.2010<br \/>\nbut did not make any recommendation qua the petitioner on the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 3929\/2011                                                    4<\/span><br \/>\n reason that the petitioner had already been reverted to the<br \/>\nIndian Army in April 2010, and the instant writ petition was<br \/>\npending. It was opined that it would be advisable to await the<br \/>\noutcome of the instant case.\n<\/p>\n<p>19.    We have asked learned counsel for the respondent, who on<br \/>\ninstructions from Ms.Asha Anand, Joint Director, DGQA informs<br \/>\nthat there are several vacancies available in DGQA where officers<br \/>\nof the armed forces can still be inducted on permanent<br \/>\nsecondment with DGQA.\n<\/p>\n<p>20.     From the facts noted hereinabove, the following emerges:-\n<\/p>\n<blockquote><p>         i.   The medically infirmity of petitioner&#8217;s wife and his<br \/>\n              aged mother requires petitioner to devote time with<br \/>\n              his family.\n<\/p><\/blockquote>\n<blockquote><p>        ii.   Petitioner has completed 2 year&#8217;s tenure on<br \/>\n              deputation with DGQA before he was repatriated to<br \/>\n              the Indian Army.\n<\/p><\/blockquote>\n<blockquote><p>       iii.   The Board of DGQA which met on 28.4.2010 evaluated<br \/>\n              the petitioner and found him suitable for permanent<br \/>\n              absorption in DGQA.\n<\/p><\/blockquote>\n<blockquote><p>       iv.    When consent of Indian Army was sought, it declined<br \/>\n              to relieve the petitioner for permanent secondment<br \/>\n              alleging shortage of staff.\n<\/p><\/blockquote>\n<blockquote><p>        v.    The Indian Army has now no objection to petitioner&#8217;s<br \/>\n              permanent secondment with DGQA.<br \/>\n       vi.    The Board of DGQA which met on 11.8.2011 deferred<br \/>\n              considering petitioner&#8217;s entitlement for permanent<br \/>\n              absorption in DGQA to await the decision in the instant<br \/>\n              writ petition.\n<\/p><\/blockquote>\n<p>21.    The conspectus of aforesaid facts lead us to the conclusion<br \/>\nthat petitioner&#8217;s evaluation for absorption in DGQA has already<br \/>\n<span class=\"hidden_text\">W.P.(C) No. 3929\/2011                                              5<\/span><br \/>\n been completed at the Board which met on 28.4.2010. The Indian<br \/>\nArmy has no objection now to his permanent absorption in DGQA.<br \/>\nIt is not a vacancy based appointment. No body&#8217;s right is<br \/>\nadversely affected if we are to direct that on the strength of the<br \/>\nearlier selection strengthened by the current decision taken by<br \/>\nthe Indian Army to release petitioner to be permanently<br \/>\nseconded in DGQA, petitioner be permanently                   seconded to<br \/>\nDGQA.\n<\/p>\n<p>22.    The     writ     petition   stands   disposed   of   declaring     that<br \/>\npetitioner&#8217;s entitlement for permanent secondment in DGQA as<br \/>\nregards the said organization would be treated as having been<br \/>\nsettled with respect to the QASB selection dated 28.4.2010.<br \/>\nArmy&#8217;s concurrence for petitioner&#8217;s permanent absorption in<br \/>\nDGQA would be treated as final so far as the Indian Army is<br \/>\nconcerned in view of the stand taken in the counter affidavit.\n<\/p>\n<p>23.    Mandamus          is   issued   that   necessary     formalities    be<br \/>\ncompleted within 4 weeks and petitioner be released from Indian<br \/>\nArmy for permanent absorption in DGQA.\n<\/p>\n<p>24.    Learned counsel for the respondent is desirous and learned<br \/>\ncounsel for the petitioner on instructions from the petitioner<br \/>\nstates that for the purposes of seniority in DGQA, the petitioner<br \/>\nwould not claim ante dated seniority. Seniority would be<br \/>\nreckoned with effect from the date he joins DGQA on permanent<br \/>\nbasis.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 3929\/2011                                                       6<\/span><\/p>\n<p> 25.
