M. Shah waives service of notice of rule on<br \/>\nbehalf of respondent-State.\n<\/p>\n<p>2.\tPresent<br \/>\napplication is filed by the applicant-original accused with a prayer<br \/>\nto modify the order dated 22\/9\/2001 passed by the learned Additional<br \/>\nSessions Judge, Gandhidham-Kutch in Criminal Misc. Application No.426<br \/>\nof 2011 by directing the applicant to furnish surety of Rs.10,000\/-<br \/>\nfrom any place.\n<\/p>\n<p>3.\tIn<br \/>\nthe case of the applicant-accused the learned Additional Sessions<br \/>\nJudge, Gandhidham-Kutch has imposed the condition that surety should<br \/>\nbe from the local area of the concerned place.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Ms. Subhadra Patel appearing for the applicant has contended<br \/>\nthat it is the right of the applicant to produce surety from all over<br \/>\nIndia and learned Judge cannot impose such condition of surety that<br \/>\nthe same should be of local area.\n<\/p>\n<p>5.\tHeard<br \/>\nboth the parties and perused the documents on record.   I have also<br \/>\nconsidered decision of learned Judge.  The observation made by the<br \/>\nlearned Judge to give surety of local area is not proper.  The<br \/>\nlearned Judge has to consider and peruse the judgment of the Hon&#8217;ble<br \/>\nSupreme Court in which Hon&#8217;ble Apex Court has observed that the Court<br \/>\ncannot direct to give surety from local area.\n<\/p>\n<p>6.\tIn<br \/>\nview of above, the applicant is permitted to move before the learned<br \/>\nTrial Court.  The Trial Court is directed to consider the case of the<br \/>\napplicant and permit the applicant to give surety from any place.<br \/>\nThis application is disposed of with the above observation and<br \/>\ndirection.  Rule is discharged.
