It is also<br \/>\n\tan admitted position that the eviction suit is filed by the<br \/>\n\trespondent No.2 against the petitioner for recovery of the<br \/>\n\tpossession and the said dispute is pending before the Civil Court.<br \/>\n\tIt appears that the electricity was disconnected on the alleged<br \/>\n\tground of theft and non-payment of electricity bills.  By the<br \/>\n\tpresent petition, the petitioner is seeking electricity connection,<br \/>\n\tin any case, so along as he is occupying the premises.\n<\/p>\n<p>Mr.Das,<br \/>\n\tlearned Counsel appearing for respondent No.2 submitted that earlier<br \/>\n\tthe petitioner had preferred Regular Civil Suit No.30 of 2005 for<br \/>\n\tprotecting the possession and in the said suit prayer is also made<br \/>\n\tfor granting interim relief for electricity connection.  However,<br \/>\n\tthe trial Judge had rejected the said prayer, against which the<br \/>\n\tpetitioner has preferred appeal being Civil Misc. Appeal No.46 of<br \/>\n\t2007, which has also been rejected and, therefore, in this petition,<br \/>\n\tthe petitioner would not be entitled to the relief for getting the<br \/>\n\telectricity connection and he submitted that this Court in a<br \/>\n\tpetition under Article 226 of the Constitution of India may not<br \/>\n\tentertain such prayer.\n<\/p>\n<p>It<br \/>\n\tappears that so far as the proceedings of the Civil Suits are<br \/>\n\tconcerned, the learned Counsel has already declared that the same<br \/>\n\twould be withdrawn and, therefore, Court has no reasons to<br \/>\n\tdisbelieve the same.  The consequence would be it would not be<br \/>\n\tsimultaneous proceedings. Further, the peculiar and larger aspect is<br \/>\n\tfor supply of the electricity to a tenant, who is up till now not<br \/>\n\tevicted by the landlord.  However, the landlord, who is respondent<br \/>\n\tNo.2, by resisting the supply of the electricity cannot create a<br \/>\n\tsituation that the tenant is left without electricity.  The need of<br \/>\n\telectricity is as good as necessity and, therefore, for convenient<br \/>\n\tuse of the premises by the tenant until he is evicted, the<br \/>\n\telectricity would be a basic requirement.  The supply, in any case,<br \/>\n\tis to be taken at the cost and risk of the tenant   petitioner<br \/>\n\therein and respondent No.2 will not suffer any loss or injury.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, Rule.\n<\/p>\n<p>\tBy interim order, it is directed that if the petitioner applies for<br \/>\n\tgrant of electricity connection to respondent No.1, the same shall<br \/>\n\tbe considered in accordance with law and respondent No.1 Company<br \/>\n\tshall grant the electricity connection as per the seriatum in case<br \/>\n\tif there is a waiting list.  It would be required for the petitioner<br \/>\n\tto pay all necessary charges for such purpose and any resistance by<br \/>\n\trespondent No.2 shall not be taken into consideration by respondent<br \/>\n\tNo.1.  It is also clarified that in the event in the eviction suit<br \/>\n\tthe respondent No.2 succeeds, the petitioner will not be in a<br \/>\n\tposition to claim any additional equity on the ground that he had<br \/>\n\tincurred expenses for electricity connection and that the<br \/>\n\telectricity connection exists on his name.  The Civil Court shall be<br \/>\n\tat liberty to pass the order of eviction, if ultimately landlord<br \/>\n\tsucceeds by handing over of the possession  with the said<br \/>\n\telectricity connection.
