Justice K.HEMA\n\n Dated :17\/02\/2009\n\n O R D E R\n                             K.HEMA, J.\n                       --------------------------------\n                       B.A. No.289 OF 2009\n                       --------------------------------\n           Dated this the 17th day of February, 2009\n\n\n                              O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.<\/p>\n<p>      2. The alleged offence is under Section 420 I.P.C.<\/p>\n<p>According to prosecution, during 2001 to 2006, an amount of<\/p>\n<p>Rs.9Lakhs were received from the defacto complainant<\/p>\n<p>promising that interest at the rate between 18% and 21% will<\/p>\n<p>be paid on the amount. Neither the amount nor the interest<\/p>\n<p>was paid and hence, the complaint.\n<\/p>\n<p>      3. Learned counsel for petitioner submitted that<\/p>\n<p>petitioner has not committed any offence. He is a money<\/p>\n<p>lender by profession and due to financial stringency, he could<\/p>\n<p>not repay the amount in full. No offence under Section 420<\/p>\n<p>I.P.C. is made out on the allegations made. It is also submitted<\/p>\n<p>that petitioner has a settlement with the defacto complainant<\/p>\n<p>and Rs.1,50,000\/- was returned. Petitioner is prepared to raise<\/p>\n<p>the amount and pay the entire money due. Therefore,<\/p>\n<p>anticipatory bail may be granted, it is submitted.<\/p>\n<p>      4. Learned Public Prosecutor submitted that Rs.1.5 Lakhs<\/p>\n<p>B.A.No.289 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>are already paid and there was an agreement to pay the<\/p>\n<p>balance. But petitioner has not complied with the terms of<\/p>\n<p>agreement. Therefore, this petition is opposed.<\/p>\n<p>       On hearing both sides, considering the serious nature of<\/p>\n<p>the allegations made, I do not think that it is fit to grant<\/p>\n<p>anticipatory bail to petitioner. However, petitioner is at liberty<\/p>\n<p>to surrender before the Magistrate court concerned and seek<\/p>\n<p>bail under Section 437 Cr.P.C. It is made clear that the<\/p>\n<p>consideration for grant of bail under Section 437 Cr.P.C. are<\/p>\n<p>different from consideration for granting anticipatory bail<\/p>\n<p>under Section 438 Cr.P.C. The rejection of anticipatory bail<\/p>\n<p>may not be a ground to refuse bail under Section 437 Cr.P.C.<\/p>\n<p>Learned Magistrate will consider the various facts and dispose<\/p>\n<p>of the bail application if any filed, untrammelled by any of the<\/p>\n<p>observations if any made, on merit in this case. Petitioner is<\/p>\n<p>bound to surrender to law.\n<\/p>\n<p>       Hence, the following order is passed :-<\/p>\n<p>        i) Petitioner    shall   surrender    before  the<\/p>\n<p>            investigating officer or before the Magistrate<\/p>\n<p>            court concerned without any delay and<\/p>\n<p>B.A.No.289 of 2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>            co-operate with the investigation.
