Nalanda.\n             7.Sri Surendra Kumar Sudhanshu, son of\n                not known, District Statistics Officer,\n                Nalanda.\n             8.Sri Sanjay Kumar, son of not known,\n                B.D.O.,Sarmera.\n             9.Sri Mani Roushan Prasad son of not\n                known, Block Agriculture Officer, Sarmera.\n             10.Sri Mithilesh Prasad, son of not known C.I.,\n                 Sarmera.\n             11.Sri Ambika Rajak son of not known,\n                 Junior Statistics Supervisor, Sarmera Block.\n             12.Sri M.K.Poddar son of not known,\n                 Managing Director, Agriculture\n                 Insurance Company of India Ltd.\n             13.Sri K.K.Mahapatra son of not known,\n                 Zonal Manager(Officer in-charge,\n                 Agriculture Insurance Company Ltd.\n                 Ground Plaza, Fraser Road, Patna.\n                                                         Opp. Parties.\n                                -----------\n<\/pre>\n<p>2.   29.08.2011              Heard learned counsel for the petitioner and the<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                              Even if we accept he entire submissions advanced<\/p>\n<p>                   on behalf of petitioner, the situation is as such:<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>          The Division Bench directed the Agriculture<\/p>\n<p>Production Commissioner, Bihar as well as the District<\/p>\n<p>Magistrate, Nalanda to ensure that the figures required by the<\/p>\n<p>Insurance Company with regard to the actual yield of<\/p>\n<p>Agahani Paddy crop in Sarmera Anchal for Kharif- Season<\/p>\n<p>2008   be made available to the Insurance Company within<\/p>\n<p>one month from the date of the order dated 26th April 2010.<\/p>\n<p>Thereafter the Insurance Company was to take decision as<\/p>\n<p>per the policy within two months. According to the<\/p>\n<p>petitioner, in stead of taking 16 cuttings of crops,       the<\/p>\n<p>subordinate authorities of the Sarmera Anchal procured only<\/p>\n<p>12 cuttings and hence the actual yield report was defective<\/p>\n<p>and was not     accepted by     the Insurance Company for<\/p>\n<p>payment of insurance amount.\n<\/p>\n<p>          In the aforesaid situation, the opposite parties to<\/p>\n<p>this   contempt application, the Agriculture Production<\/p>\n<p>Commissioner, Bihar and the District Magistrate, Nalanda<\/p>\n<p>cannot be faulted for submitting whatever figures of yield<\/p>\n<p>was made available by the Block authorities. They have also<\/p>\n<p>made recommendation for payment as submitted by the<\/p>\n<p>learned counsel for the petitioner. Hence, in our view, it is<\/p>\n<p>not a case where the opposite parties can be held guilty of<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>       deliberate      disobedience of this Court.
