Justice K.HEMA\n\n Dated :28\/07\/2010\n\n O R D E R\n                             K.HEMA, J.\n                          ------------------\n                      B.A. No. 2272 of 2010\n                     -----------------------------\n               Dated this the 28th day of July, 2010\n\n                             O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.\n<\/p>\n<p>     2. The alleged offences are under sections 3, 4, 5 and 7 of<\/p>\n<p>Immoral Traffic(Prevention) Act.      According to prosecution,  on<\/p>\n<p>07.01.2010 at about 1 P.M., a raid was conducted by the police in<\/p>\n<p>the guest house run by petitioner and in one of the rooms<\/p>\n<p>prostitution was being carried on and accused nos. 1 to 3 were<\/p>\n<p>found indulging in sexual activities. Accused nos. 1 to 3 were<\/p>\n<p>arrested from the spot; 4th accused, who is the manager of the<\/p>\n<p>guest house was arrested subsequently. The 5th accused is the<\/p>\n<p>owner of the guest house and he allegedly committed the various<\/p>\n<p>offences alleged in the case.\n<\/p>\n<p>     3. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>is the owner of the guest house         and he has    absolutely no<\/p>\n<p>knowledge about the indulgence of prostitution in the guest<\/p>\n<p>house. Petitioner was not even present in the hotel at the time of<\/p>\n<p>the raid.   On knowing that guest house           was used for such<\/p>\n<p>purpose, he closed down the guest house. Petitioner requested<\/p>\n<p><span class=\"hidden_text\">B.A. No. 2272 \/ 2010                 2<\/span><\/p>\n<p>for an opportunity to explain his innocence before the<\/p>\n<p>investigating officer. As per the direction of this court, he<\/p>\n<p>appeared         before the investigating officer and he was also<\/p>\n<p>questioned.\n<\/p>\n<p>       4. Learned Public Prosecutor submitted that petitioner<\/p>\n<p>surrendered before the investigating officer and he was<\/p>\n<p>thoroughly interrogated and he has no objection in granting<\/p>\n<p>anticipatory bail on conditions, it is submitted.<\/p>\n<p>       5. On hearing both sides, I am satisfied that petitioner can<\/p>\n<p>be     granted anticipatory bail on the conditions. Hence, the<\/p>\n<p>following order is passed:\n<\/p>\n<blockquote><p>               1.   Petitioner shall, in the event of his arrest<\/p>\n<p>                    be released on bail on his executing a<\/p>\n<p>                    bond for Rs. 25,000\/- with two solvent<\/p>\n<p>                    sureties each for the like sum to the<\/p>\n<p>                    satisfaction of the arresting officer on the<\/p>\n<p>                    condition   that  petitioner  shall   report<\/p>\n<p>                    before the      investigating officer as and<\/p>\n<p>                    when directed and co-operate with the<\/p>\n<p>                    investigation.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 2272 \/ 2010                 3<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                2. This order will be in force only for a period<\/p>\n<p>                    of 25 days from today. In the meantime,<\/p>\n<p>                    petitioner shall seek regular bail from the<\/p>\n<p>                    court concerned in accordance with law.<\/p>\n<p>         This petition is allowed.<\/p><\/blockquote>\n<p>                                               K.
