( Oral )<\/p>\n<p>             The petitioner has filed the instant petition for issuing direction<\/p>\n<p>to the respondents for not effecting the recovery from him on the basis of<\/p>\n<p>punishment order passed against him.\n<\/p>\n<p>             Concededly, against the order of punishment, the petitioner has<\/p>\n<p>filed an appeal, which is still pending. It is also admitted position that along<\/p>\n<p>with the appeal, the petitioner has also filed an application for stay of the<\/p>\n<p>penalty order and on that application, notice has been issued for September<\/p>\n<p>14, 2009, but no interim stay has been granted by the Appellate Authority.<\/p>\n<p>             After hearing counsel for the petitioner and in view of the<\/p>\n<p>aforesaid facts, at this stage, I do not find any ground to entertain this<\/p>\n<p>petition for staying the recovery.
