(C) No. 11462\/2002)<\/p>\n<p>RAJENDRA BABU,  CJI :\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tA writ petition was filed in the High Court by a<br \/>\nresident within the vicinity of a unit of the appellant on<br \/>\nthe allegation that the appellant was letting out its<br \/>\ntrade effluents outside factory premises.  On<br \/>\n16.12.1996 the High Court appointed a Committee to<br \/>\nmake a report regarding discharge of effluent.  On the<br \/>\nfiling of Report by that Committee a show cause notice<br \/>\nwas issued to the appellant on 26.12.1996 in the light<br \/>\nof the contents thereof. Thereafter,  the High Court on<br \/>\n9.1.1997 directed the closure of the factory.  In the<br \/>\ncourse of the order made by the High Court it was<br \/>\nnoticed that the appellant could not say that there was<br \/>\nno discharge of trade effluent.  The High Court directed<br \/>\nthe appellant to deposit a sum of Rs. 75,000\/- and also<br \/>\nordered its closure.  On 16.1.1997 by another order<br \/>\nmade the High Court directed the appellant to deposit a<br \/>\nsum of Rs. 75 lakhs as a condition for restarting of the<br \/>\nunit .  On depositing such amounts in instalments the<br \/>\nHigh Court directed restarting of certain activities which<br \/>\ndo not generate any kind of effluent.  Then by an order<br \/>\nmade on 27.1.1998 the High Court disposed of the<br \/>\nmatter.  In the course of the order made on that day it<br \/>\nwas noticed that an agreement had been entered into<br \/>\nbetween the petitioner and certain other persons<br \/>\nresiding in the village with the appellant;  that effluent<br \/>\ntreatment plant (ETP) was about to be commissioned<br \/>\nand this would include training of the people of the<br \/>\nindustry for the operation and of the maintenance of<br \/>\nthe ETP;  that the report filed by the Gujarat Pollution<br \/>\nControl Board on examining the samples collected on<br \/>\n20.01.1999 indicated that the appellant is meeting the<br \/>\nnorms; that the petitioners and others in the writ<br \/>\npetition filed before the High Court had been paid<br \/>\ndamages arising on account of discharge of effluents<br \/>\nand had entered into an agreement which was filed<br \/>\nbefore the High Court;  and that the unit having met<br \/>\nwith the requirements of the Gujarat Pollution Control<br \/>\nBoard.  On that basis, the High Court disposed of the<br \/>\nwrit petition allowing the same to be withdrawn.<br \/>\nHowever, as regards the refund of the amount<br \/>\ndeposited by the appellant before the Court, the High<br \/>\nCourt stated that this aspect could be considered at a<br \/>\nlater stage.\n<\/p>\n<p> \tThereafter,  an application was made for refund of<br \/>\nthe said amount in deposit.  The High Court disposed of<br \/>\nthat application without making any order by making it<br \/>\nclear that such application could be revived after the<br \/>\ncases pending before this Court are disposed of.\n<\/p>\n<p>\tIn this appeal, it is urged before us that the writ<br \/>\npetition having been withdrawn and the concerned<br \/>\npersons who had suffered damage on account of<br \/>\ndischarge of effluents having been compensated,<br \/>\nquestion of continuing to keep the said amounts<br \/>\ndeposited in Court would not arise. It is further<br \/>\nsubmitted that this case stands entirely on different<br \/>\nfooting from other cases pending before this Court<br \/>\nbecause in other cases discharge of effluent was to a<br \/>\ncommon ETP while no such discharge had been made<br \/>\nin this case, except some of the effluents having been<br \/>\ndischarged into lands surrounding the factory.\n<\/p>\n<p> \tDegradation of environment or damage, if any,<br \/>\nsuffered by the residents residing in the vicinity having<br \/>\nbeen satisfied with the compensation paid to them in<br \/>\nterms of the agreement which was produced before the<br \/>\nHigh Court, the ETP having been set up and with<br \/>\npollution control norms having been satisfied,  the High<br \/>\nCourt ought to have considered question of refund of<br \/>\nthe amounts deposited with Court and should have<br \/>\ntreated this case on a different footing altogether and<br \/>\nnot connected with other cases pending before this<br \/>\nCourt.\n<\/p>\n<p>\tTherefore,  we set aside the order made by the<br \/>\nHigh Court, remit the matter to the High Court for fresh<br \/>\nconsideration of the application for refund and to<br \/>\ndispose of the matter in accordance with law.\n<\/p>\n<p>\tThe appeal is allowed accordingly.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Modern Terry Towel Ltd vs Solanki Muljibhai Revabhai &#8230; on 5 May, 2004 Author: R Babu Bench: Cji, G.P.
