No.11755 of 2011\n NAKSI SAHANI @ NAKSI MAHTON @ NAKESHWAR MAHTON @ NAGESHWAR\n      MAHTON, SON OF LATE MISHRILAL SAHANI @ MISHRI MAHTON\n                                 Versus\n                        THE STATE OF BIHAR\n                                -----------\n<\/pre>\n<p>03   21.04.2011            Heard learned counsels for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                           The petitioner is apprehending his arrest in a<\/p>\n<p>                  case registered under Section 3 of R.P. (U.P.) Act.<\/p>\n<p>                           The accusation is of seizure of two bundles of<\/p>\n<p>                  wire of the Railway. It is alleged that the petitioner<\/p>\n<p>                  alongwith four others fled away from the place of<\/p>\n<p>                  seizure. It is alleged that the bundles of wire were thrown<\/p>\n<p>                  by the petitioner and others.\n<\/p>\n<p>                           It is submitted by the learned counsel for the<\/p>\n<p>                  petitioner that the petitioner has been made accused as<\/p>\n<p>                  Naksi Sahani S\/o Mishrilal Sahani, whereas the<\/p>\n<p>                  petitioner&#8217;s name is Nageshwar Mahton.<\/p>\n<p>                           A supplementary affidavit has been filed, stating<\/p>\n<p>                  therein that petitioner has no criminal antecedent. The<\/p>\n<p>                  voter identity card reflects the name of petitioner as<\/p>\n<p>                  Nageshwar Mahton. Moreover, no recovery has been<\/p>\n<p>                  made from possession of the petitioner.<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>                       Considering the aforesaid facts, let the above<\/p>\n<p>               named, petitioner, be released on anticipatory bail, in the<\/p>\n<p>               event of his arrest or surrender before the learned court<\/p>\n<p>               below within a period of 12 weeks from today, on<\/p>\n<p>               furnishing bail bond of Rs. 10,000\/- (ten thousand) with<\/p>\n<p>               two sureties of the like amount each to the satisfaction of<\/p>\n<p>               the learned Railway Judicial Magistrate, Sonepur,<\/p>\n<p>               Chapra in connection with Hazipur Rail P.S.
